Don’t Blame Heritage for ObamaCare Mandate

Is the individual mandate at the heart of “ObamaCare” a conservative idea? Is it constitutional? And was it invented at The Heritage Foundation? In a word, no. The U.S. Supreme Court will put the middle issue to rest. The answers to the first and last can come from me. After all, I headed Heritage’s health work for 30 years. And make no mistake: Heritage and I actively oppose the individual mandate, including in an amicus brief filed in the 11th Circuit Court of Appeals to the Supreme Court. Nevertheless, the … More

Jon Stewart Forces Secretary Sebelius to Sweat Obamacare’s Details

Monday on The Daily Show, comedian Jon Stewart interviewed Health and Human Services (HHS) Secretary Kathleen Sebelius. The Secretary didn’t escape the hot seat in what turned out to be an interesting discussion regarding the implementation of Obamacare. One notable topic covered during the interview was the surprise proposal by HHS to let states determine their own definitions of “essential health benefits.” Obamacare explicitly instructs HHS to fill in the details of the legislation’s mandatory minimum benefit package, but as the Galen Institute’s John Hoff previously noted in a Heritage … More

“Lie of the Year” – Democrats’ Claims about Medicare Reform

Politics is home to some pretty exaggerated accusations, and this year was no exception, particularly in the area of health care. Case in point: Democrats’ claim that “Republicans voted to end Medicare.” In fact, the assertion was so off the wall that PolitiFact.com named it “Lie of the Year 2011.” Democrats made the claim about House Budget Committee Chairman Paul Ryan’s (R-WI) FY 2012 “Path to Prosperity” budget, which included a proposal to provide premium support to Medicare enrollees, helping them to purchase a health care plan of their choice. … More

Obama Administration Agrees: Florida Medicaid Reform Pilot Good for Patients and Taxpayers

Florida’s Medicaid Reform Pilot is pro-patient and pro-taxpayer, and the Obama Administration agrees. In original research published by The Heritage Foundation and also submitted to the Centers for Medicare and Medicaid Services (CMS) during the agency’s deliberations, I showed that the program’s patients are healthier and happier with their care and that Florida taxpayers saved more than $100 million each year of the program. The Florida reforms work by giving patients a choice of the private health plan that works best for them. Enrollees can choose from plans with varied … More

Ryan-Wyden: The Basic Ingredients of Structural Medicare Reform

Congressman Paul Ryan (R–WI) and Senator Ron Wyden (D–OR) have proposed a new bipartisan framework for structural Medicare reform. It continues the conversation with the American people on a solution to save the popular but financially troubled entitlement program. While there are differences between the proposal and the Heritage plan outlined in Saving the American Dream, and while their proposal does not go as far or as fast as it should in changing the massive entitlement program, it would establish a premium-support system of financing for Medicare, a variant of … More

Obamacare Oral Argument: What the High Court’s Order Suggests

When the Supreme Court agreed this month to hear the Obamacare constitutional challenge, it didn’t surprise most Court watchers, but the amount of time it set aside for oral argument is highly unusual. That is surprising for a few reasons, most of which should be unsettling to the current administration that is defending the law. The Supreme Court’s Nov. 14 orders were a bit ambiguous on one point, but it seems to have scheduled 5 ½ hours of oral argument on issues related to the one case brought by 26 … More

In Michigan, Obamacare is Already a Job-Killer

While the White House continues its rhetoric on job creation, the job-killing effects of Obamacare are already taking effect. One provision of the law, its tax on medical device manufacturers, is already having a detrimental impact on a Michigan-based manufacturer. Stryker Corporation has announced that it will cut approximately 5 percent of its workforce by 2013 due to the tax. As Heritage has shown, this isn’t the first device manufacturer to voice concerns about job loss in the U.S. resulting from the tax, and it is sure not to be … More

New Poll: Americans Want Obamacare Repealed

Just as the Supreme Court has decided to take up the court cases challenging the constitutionality of Obamacare, a new Gallup poll shows that the plurality of Americans–including even a plurality of independents–want to see the law repealed. Meanwhile, a new survey by the PwC Health Research Institute shows that health care and the deficit are tied as the second-most important issue in the presidential election, after jobs. Gallup reports that, “Given a choice, 47% of Americans favor repealing the 2010 Patient Protection and Affordable Care Act, while 42% want it kept … More

Court To Hear Obamacare Challenge: What It Means

It’s official. The Supreme Court will consider challenges to Obamacare stemming from the Eleventh Circuit decision striking down the law’s individual mandate. In that case, 26 states and the National Federation of Independent Business (NFIB) partially won their suit, claiming that the Patient Protection and Affordable Care Act (PPACA) should be voided as unconstitutional. The Eleventh Circuit ruled that the mandate — considered by many to be the linchpin of the overhaul of the U.S. health system — was unconstitutional. But the court declined to strike down the law in its … More

The Individual Mandate: A Step Closer, but the Fight Against Obamacare Must Continue

As expected, the Supreme Court has decided to take up the court cases challenging Obamacare’s individual mandate and the question of whether the whole law should be struck down if the Court finds the mandate unconstitutional. This is another important step toward undoing this unpopular and unworkable health care law. Recall the process by which the law came to be: Due to the special circumstances of Senator Scott Brown’s election, the House and Senate (under duress) jammed through the poorly drafted health care law, bypassing the normal conference process intended … More
