Morning Bell: Harry Reid Opts for Political Theater on Judicial Nominees

Majority Leader Harry Reid (D-NV) has rightfully earned the reputation of running a do-nothing Senate. More than 1,000 days have elapsed since the upper chamber approved a budget. He’s currently ignoring the House-passed JOBS Act and actively opposing steps to lower gas prices. Now, in a blatant political stunt, Reid is attempting to blame the Republican minority for the Senate’s failure to confirm 17 of President Obama’s district court nominees. >> UPDATE: Realizing his stunt wouldn’t work, Reid reversed course late Wednesday, agreeing to deal with Republicans on some of the nominees. … More

Morning Bell: Obama’s Continuing Assault on the Constitution

With tens of millions of Americans watching, Barack Obama stood at the West Front of the U.S. Capitol on January 20, 2009, with his left hand on the Bible and his right hand held aloft, swearing to God and country that he would preserve, protect and defend the Constitution of the United States. Yet despite that pledge, President Obama has time and time again taken actions contrary to the principles of the founding document he swore to uphold, setting forth on a heretofore uncharted path of unconstitutionality that will fundamentally change the … More

VIDEO: Obama ‘Manifestly Wrong’ on U.S. Constitution, Says Sen. Mike Lee

Few lawmakers have expressed as much outrage over President Obama’s unconstitutional “recess” appointments as Sen. Mike Lee (R-UT). He was among the first to warn about the consequences of the president’s unilateral action on Jan. 4. More than a month later, a new director is running the Consumer Financial Protection Bureau and three members of National Labor Relations Board are conducting business—all in blatant violation of the U.S. Constitution, Lee said in an interview with Heritage following a speech Monday. “He’s reading the Constitution in a way that’s manifestly wrong,” … More

House Committee Examines Obama’s Unconstitutional Appointments

President Obama’s illegal non-recess appointments are unconstitutional and defy the process the Founding Fathers intended, Sen. Mike Lee (R-UT) told a House committee Wednesday. The House Oversight and Government Reform Committee invited a handful of constitutional law experts to discuss the four controversial appointments Obama made in January. Citing delays in the Senate, Obama installed Richard Cordray (pictured) as director of the Consumer Financial Protection Bureau and Richard Griffin Jr., Sharon Block, and Terence F. Flynn as members of the National Labor Relations Board. Lee, a constitutional expert and scholar, … More

Sen. Lee to Testify at Hearing on Illegal Non-Recess Appointments

A handful of constitutional law experts are slated to testify before the House Oversight and Government Reform Committee tomorrow about President Obama’s four unconstitutional non-recess appointments. The witnesses include Sen. Mike Lee (R-UT), one of Congress’ chief critics of Obama’s unprecedented decision. Lee will offer his expertise as a former clerk for a Supreme Court justice and attorney specializing in Supreme Court litigation. His testimony will come on the heels of a testy exchange with the president that began with the former’s announcement that he may block all of Obama’s … More

Two House Hearings Scheduled on Illegal Non-Recess Appointments

Two House committees have scheduled hearings on President Obama’s unconstitutional appointments of four federal officials earlier this month. On Tuesday, the financial services panel of the Oversight and Government Reform Committee will examine the role that Richard Cordray will play at the helm of the newly created Consumer Financial Protection Bureau.  The hearing will be streamed live at http://oversight.house.gov. Subcommittee chairman Patrick McHenry (R-N.C.) called Cordray’s appointment an “apparent contravention of constitutional requirements for a recess appointment” in a Jan. 4 statement. The panel, McHenry added, “is deeply interested in … More

NLRB Appointee Will Continue to Receive Payments from Union

Financial disclosure documents filed by two of President Obama’s illegal appointments to the National Labor Relations Board show that one will continue to receive payments from a major labor union during his time on the board. Richard Griffin, the former general counsel for the International Union of Operating Engineers, will receive regular payments under two different IUOE pension plans. The payment amounts are not listed on the disclosure form. He will also receive a single lump sum payment equal to three weeks of salary (one week for each of the … More

Grassley Not Buying DOJ’s Non-Recess Appointment Apologia

Calling the president’s illegal non-recess appointments “an escalation in a pattern of contempt for the elected representatives of the American people,” Sen. Chuck Grassley (R-IA), ranking Republican on the Judiciary Committee, dismissed a Justice Department memo on Thursday that sought to lend retroactive constitutional weight to the president’s move. Grassley hinted at Senate “action to check and balance” the president’s power grab, though he declined to go into specifics. The DOJ Office of Legal Counsel’s memo, also debunked by Heritage’s Todd Gaziano, claims that pro forma Senate sessions do not … More

Whitewash on Illegal Appointments Won’t Work

The Obama Administration’s 23-page Office of Legal Counsel (OLC) opinion rationalizing illegal appointments the President made last week, released this morning, falls far short of its intended goal. The opinion makes claims that are demonstrably false and is at times, frankly, embarrassing. Apart from failing to prove that President Obama’s unprecedented act was constitutional, the opinion also  raises further questions about the legal advice process and the competence of those involved. The opinion, dealing with the President’s illegal appointments to the National Labor Relations Board (NLRB) and Consumer Financial Protection … More

    Morning Bell: Obama’s Arrogant Authoritarianism

Last week, President Barack Obama took the latest step on his road toward an arrogant, new authoritarianism with four illegal appointments that entirely trampled on the Constitution’s requirements. More troubling still, the President chose to shred the Constitution all in the name of serving his Big Labor agenda while killing jobs in the process. The President’s actions once again gave voice to his animating view of governing: doing so is much easier when one isn’t constrained by the Constitution and its checks and balances. “We can’t wait,” the President exclaimed … More
