  • Hobby Lobby Files Suit over HHS Mandate, Could Face $1.3 Million in Fines

    Another family-owned business joined the fray over the Health and Human Services (HHS) anti-conscience mandate this morning.

    Hobby Lobby Stores, Inc., an arts and crafts supply retailer, filed a lawsuit against the Obamacare anti-conscience mandate, demanding that the government respect the business’s desire to operate in accordance with Christian principles. Represented by the Becket Fund for Religious Liberty, Hobby Lobby joins over 80 other organizations and businesses in the now 27 lawsuits pending against the HHS mandate.

    David Green, CEO of Hobby Lobby who founded the company in 1972, explained in a press conference this morning:

    [W]e seek to honor God by operating the company in a manner consistent with Biblical principles. The conflict for me is that our family is being forced to choose between following the laws of the country that we love or maintaining the religious beliefs that have made our business successful and have supported our family and thousands of our employees and their families.

    Headquartered in Oklahoma City, Hobby Lobby has grown from one 300-square-foot garage to over 500 stores in 41 states employing more than 22,500 individuals. The Green family is not only committed to serving their customers and employees but also to investing in communities through partnerships with numerous Christian ministries.

    The Green family’s company, which closes all its locations on Sundays, seeks to operate in accordance with Christian principles—including offering an employee health care plan that aligns with those values. Under the HHS mandate, however, Hobby Lobby will be forced to provide and pay for abortion-inducing drugs such as the “morning after” and “week after” pills, regardless of their religious or moral objections to doing so.

    The mandate’s offensively narrow religious exemption doesn’t apply to a large number of religious organizations, let alone for-profit businesses. Like all for-profit employers, Hobby Lobby is also ineligible for the Obama Administration’s “temporary safe harbor” and will be subject to the HHS mandate at the beginning of its next health plan year on January 1, 2013.

    Moreover, unless the Green family violates its deeply held beliefs and gets in line with the coercive government mandate, Hobby Lobby could face fines of up to $1.3 million per day.

    “This nationwide litigation against this HHS mandate is a fight for religious freedom for all Americans,” explained Kyle Duncan, general counsel for the Becket Fund. “Today, [Hobby Lobby is] asking a federal court to defend their right to run their business as they always have in harmony with their Christian faith.… The government cannot fine any American, including business owners like the Greens, for refusing to violate their faith.”

    Today’s lawsuit continues the widespread outcry by many organizations and businesses over the Obama Administration’s assault on religious liberty. Given the Administration’s continual refusal to adequately protect Americans’ religious freedom from the coercive HHS mandate, Hobby Lobby’s lawsuit today is unlikely to be the last.

      This is America now run by fakes, phonies and godless people who resent the good will of peoples' own and free thought, who are in position to do much harm in anyway to anyone they want…

      God Bless the Hobby Lobby and all who stand on God's rule to defend mankind's inalienable right and personal dignity to freedoms once respected by American leadership, not to interfere.

        I agree completely. I was thinking if each one of us who feels the same way donated a dollar to each organization fighting this unconstitutional mandate we may be able to stop this marxist goverment at east until the election.

    8. I would be in on the dollar a person idea to get this mess overturned and help with legal fees…great Idea. Something needs to be done because we can't fight these people alone, we have to band together.

      This regime will eagerly denounce a movie, or any speech, that offends Muslims, or any religion, but here they are offending those of the Christian faith.

      Perhaps a Muslim business owner needs to bring a lawsuit against HHS. Would that get their attention?

      Even if Chief Justice Roberts has a change of heart on this law, I suspect it will be so woven into the fabric of society by the time he hears it that it will be too late to undo the damage. Congress and Romney must fully repeal it. If he is elected, that must be his domestic policy focus. That will be the first test of his character.

      This HHS decision is an insult to all Americans. First Chick-O-Fil, now Hobby Lobby. Who next? Will our Muslim President next fine Christian churches for being open on Sundays, and parishioners for going to church on Sundays, or cut their hand off as in other Muslim countries. The U Nited States of AMerica is a CHRISTIAN country and all-inclusive. The HHS s trying to overrun Amendment #1 of the Constitution. If there is a march to stand up for Right, I will be there.

    14. I know Mr. Green has been torn by intentionally filing suit in court. God has His hand in all governments (Rom. 12-13). Even though we are chastised for bringing our brother to court, God has provided the courts of this nation to be his tool to protect us and others from the horrors of humanity. I believe that Daniel Green, by using the tool God gave him, is being a tool of salvation to the many voiceless children in our nation today.

      If Hobby Lobby is so "God-loving and principled," why are the majority of its employees on the "part-time payroll" (and work without the option for any kind of healthcare) rather than "full time" which would mean the company would have to offer benefits. why are its employees forced to "physically do inventory and receive shipments weekly without any type of automation — rather "lead pencil and list". (imagine counting every art tube etc). why do employees only get 30 minutes for lunch, including clock out and in times. if a cashier makes a mistake, she/he is written up and the "mistake" is posted at the employees' timeclock for all to see (humiliating, huh). why are slightly damaged item thrown in trash, HL won't consider donating or allowing employees to take. there is usually one plantation-style store manager with a few brown-nosing "department leads" and employees are constantly abused, especially verbally. nothing irks me more than a "hypocrite" and that's just what I know about Hobby Lobby. so much about nothing.
