  • Morning Bell: President Obama's Fast and Furious Scandal Grows

    On the night of December 15, 2010, U.S. Border Patrol Agent Brian Terry was shot and killed by an untraceable assault weapon that was deliberately handed to Mexican drug lords by U.S. officials via Operation Fast and Furious. Ever since, the Terry family and Americans across the nation have asked how this could have happened.

    And ever since, Attorney General Eric Holder has stonewalled Congress in its attempts to find these answers. Yesterday, President Obama joined this stonewalling effort, asserting executive privilege over many of the documents about the operation that Congress had subpoenaed but still had not received.

    Executive privilege is legitimate when properly invoked. But even then, the Supreme Court has maintained that it is not absolute. The Department of Justice (DOJ) must provide a compelling rationale for each assertion. Shielding wrongdoing has never been a qualifying rationale.

    Heritage legal expert and former Department of Justice counsel Todd Gaziano explains:

    First, the Supreme Court in United States v. Nixon (1974) held that executive privilege cannot be invoked at all if the purpose is to shield wrongdoing. The courts held that [President] Nixon’s purported invocation of executive privilege was illegitimate, in part, for that reason. There is reason to suspect that this might be the case in the Fast and Furious cover-up and stonewalling effort. Congress needs to get to the bottom of that question to prevent an illegal invocation of executive privilege and further abuses of power. That will require an index of the withheld documents and an explanation of why each of them is covered by executive privilege—and more.

    It is now up to Congress to ascertain the specific reasoning for executive privilege with every withheld document. Even in the unlikely case it is determined that this was a proper invocation of executive privilege, the administration is still not off the hook to inform Congress of what they know.

    Gaziano explains further:

    [T]he President is required when invoking executive privilege to try to accommodate the other branches’ legitimate information needs in some other way. For example, it does not harm executive power for the President to selectively waive executive privilege in most instances, even if it hurts him politically by exposing a terrible policy failure or wrongdoing among his staff. The history of executive–congressional relations is filled with accommodations and waivers of privilege. In contrast to voluntary waivers of privilege, Watergate demonstrates that wrongful invocations of privilege can seriously damage the office of the presidency when Congress and the courts impose new constraints on the President’s discretion or power (some rightful and some not).

    President Obama now owns the Fast and Furious scandal. It is entirely up to him whether he wants to live up to the transparency promises he made four years ago, or further develop a shroud of secrecy that would make President Richard Nixon blush. If the stonewalling continues, and the privilege is not waived, it will be up to the American people and the media to demand the reasoning for the cover-up.

    It is also time for the media to begin responsibly covering this scandal. For more than 16 months, only a handful of reporters have appropriately researched the facts and sought answers. Most members of the national media would not even acknowledge the existence of the scandal. Reportedly, NBC Nightly News ran its first story on the scandal just this past Tuesday.

    The national media must now follow the lead of their colleagues CBS reporter Sharyl Attkisson or Townhall’s Katie Pavlich and investigate the specific facts and details of the operation and administration involvement. Attkisson, as you may remember, was screamed and cussed at by White House spokesman Eric Schultz in October for asking questions about Operation Fast and Furious.

    Answers must be demanded. When was the first time President Obama was briefed on this operation? Given his previous conflicting testimony, when in fact did Attorney General Eric Holder become involved? What exactly did he know and when did he know it?

    Despite the fact that Mexico was left in the dark by the Obama administration, this was still an international operation. If Secretary of State Hillary Clinton must approve the Keystone pipeline, wouldn’t she also be consulted on this cross-border operation?

    Liberals will try and pretend this operation that began in mid-2009 is connected to former President George W. Bush’s administration. The media should challenge this false assertion. Operation Wide Receiver in 2006 did not remotely resemble Fast and Furious, as National Review’s Andrew McCarthy has ably examined. Mexico helped coordinate it, and there was traceable controlled delivery. Even Holder admitted in testimony that you cannot “equate the two.”

    We will also hear that this is “election-year politics.” The problem with that refrain is that this investigation has been ongoing since early 2011, well before campaign season started. It has been Attorney General Holder’s evasiveness that has dragged this process closer to Election Day.

    If it were not for conservative media outlets, bloggers, a few dogged reporters and the steadfastness of House Government Reform Chairman Darrell Issa (R-CA), this troubling scandal would have been buried long ago.

    A brave American border agent is dead. At least 200 Mexicans have been slaughtered with these weapons. Drug violence on the border remains unabated. Now, President Obama is attempting to conceal the facts of what happened. This is an opportunity for Congress and the media to demand sunlight.

        politicians afraid of their own shadows. They are more concerned with preserving their outlandish benefits and pay and being on the inside of the next get rich opportunity. It was better when politicians did not get paid, but volunteered their time and devotion to country and liberty. It is way past time to gut the benefits and cut the pay so they have to live like an average American, then perhaps they will understand the needs of the citizens of this Great Nation in which we live.

What about the hundreds of Mexican citizens killed. Every one of them was special to someone. Where is the justice, not vengence, just justice.       It will be very interesting to see how the MSM handles this scandal now that it's out in the open.
      Democrats will claim that it's election year politics, but will the media echo that claim?
      The very fact that Obama has resorted to Executive Privilege tells us that he, or more certainly, Holder is going to be damaged by the documents that they're trying to hide.
      Whether this issue becomes a "cause celebre" of the coming election will depend on how the media tries to spin it away from Obama. Don't be surprised to see Holder thrown under Obama's bus.

              No, Fast and Furious was not started by Bush. Bush started "Operation Wide Receiver", which was done in conjunction with the Mexican government to track the guns that went from the U.S. to Mexico for the purpose of catching violent criminals in Mexico. Fast and Furious was not done with the Mexican government's involvement and the guns were not tracked; they were just let loose to the Mexican criminals. The purpose of Fast and Furious was to create a false claim that United States citizens' freedom to own guns was causing crime in Mexico, and then ban guns in the U.S.
              The goals were completely different between these two programs; Eric Holder even admitted so in front of Congress.

        The Sinaloa Cartel was the driving force behind the 911 attacks. The Taliban had cut off their source of opium and Iran was cutting off their smugging routes across Iran. They have the same concerns today.

        Actually you have a good point. Certainly the President is obligated to carry out the laws of the land which Congress is mandated to have the power to develop under the Constitution. And the President cannot make or change laws. So in effect they are perhaps indeed covering up a scheme developed by Obama and the Mexican President and coordinated by Napolitano and (to me) obstructing justice in a murder investigation let alone exceeding Separation of Powers.

        Interesting argument for accessory liability, however several hurdles must be crossed to get there. First, there is only the concealment of documents right now; there would need to be evidence of actions taken in furtherance of the cirme. Then we would have to ask, were Holder and Obama aware of any common plan to use these weapons to murder US Citizens or anyone within US Borders? Was it forseeable that weapons used to track the extent of cartel operations (arguably a legitimate purpose) could be used in such a crime. Then we get to immunity of law enforcement officials acting in the course of duty. Then we get to executive immunity from prosecution. While I agree that any action to place Assault Weapons into the hands of Dangerous Criminials would result in Forseeable Murder, it would be one heck of a trial and the US Taxpayer would foot both sides of an 8-9 figure leagal bill. Remember this is the president who is raising $1Billion for re-election; surely, he would spend 1-10% of that to clear this legal issue from his campaign trail.

I am not surprised democrats stonewall the investigation but they should be ashamed of themselves. If wishes could come true, Holder will eventually be tried for perjury and Obama will be unelected in disgrace. I understand the ethics of the tiniest cog in the wheel is of no interest to anyone else but if I were president I swear I would insist on full disclosure even if I were led out of office in disgrace.       On July 14, 2010 after ATF headquarters in Washington D.C. received an update on Fast and Furious, ATF Field Ops Assistant Director Mark Chait emailed Bill Newell, ATF's Phoenix Special Agent in Charge of Fast and Furious:

      "Bill – can you see if these guns were all purchased from the same (licensed gun dealer) and at one time. We are looking at anecdotal cases to support a demand letter on long gun multiple sales. Thanks."

      There is an explanation for this; one that I have heard before, but I didn't think even Obama would be that brazen. Although he has been fairly quiet on the subject, Obama's antipathy toward the Second Amendment in general, and private firearms ownership in particular is well documented from his time as a Senator. I have heard the speculation that part of the reason for "Fast and Furious" was to manufacture firearms crimes in order to gin up support for forthcoming restrictive gun control Obama is known to favor. I would not put this past this administration, given their propensity for lying and obfuscation. In fact, I think it is a major factor in this ongoing political farce. The BATFE has a history of trampling people's rights and ignoring the law, and is always far worse when given free rein by Democrats such as Obama, Clinton, and don't forget Carter. Most all of their abuses have happened during Democratic anti-gun pograms.

In this case part of Obama's Base are the "Rabid Dog Anti-Gun Marxist Loving Crazed Sarah Brady Types" who insist on the total Ban of any Firearms in the US despite the Second Amendment and the US Supreme Court Opinions which clearly state that the Right to Keep and Bear Arms is an Individual Right.         HF cannot step out and accuse the administration of setting up "fast and furious" for the purpose of forcing more gun control restrictions on the American public without evidence to back up the assertion. Unlike the MSM, HF wants to back up their accusations with proof that it was done for your stated purpose.
        You and I are not burdened with that ethic, for the most part. We can look at the situation and using our common sense and connecting the dots see the goals of this operation by the administration. Pure and simple, more gun control.
        My idea is that the administration would love to take our guns away so they can take over the country without worrying about the citizens forcibly resisting. That's what Marxist/Socialist/Communists want when trying to take control of a nation, A compliant populace with no means of resisting. Strict gun control would lessen the threat of a citizen resistance to complete takeover.

      I think that fast and furious is probably the tip of the iceberg and as time goes on and the media, finally, starts to dig deeper, I'm sure there will be all sorts of corruption uncovered. It's too bad that the mainstream media invested their entire fortunes to protect this guy, I just wonder how many would do it, again, if they knew how inept Obama really was. It's, also, sad that so many were sucked into the notion that Obama was the savior, the guy who would finally bring everything together, and he turned out to be so far over his head he couldn't see the forest from the trees.

      There are some other very serious considerations regarding this case that have not been addressed nor resolved satisfactorily. In addition to the Fast and Furious aspects of Border Patrol Agent Brian Terry's death, some other purported details are quite troubling and have not been discussed. Some time ago on the Glenn Beck Show, a Retired Border Agent who is the President of the Retired Border Agents Association was commenting on the details surrounding Agent Terry's death. He was articulate and presented his facts well and in an objective manner. He was not distracted emotionally regarding the incident and his veracity in my opinion was not in question. This former Agent stated unequivocally that the Medical Choppers called in to remove Agent Terry and get him to adequate Medical Facilities for treatment could not land due to certain Federal Environmental Restrictions in the immediate area and that Agent Terry had to be transferred overland and partially involving horseback methods, which in the final analysis added four hours to the ordeal. I have tried to motivate several Conservative Websites with Investigative resources greater than mine to determine if this is credible information and would likewise request that of you. If this is even close to the eventual truth, the often used term," The Terry Family deserves better" becomes even more salient in this Administrations utter failings regarding transparency of this debacle. Would appreciate anything you can do to shed any light on the aforementioned information.

      "Fast & Furious" reminds me of the Watergate scandal that eventually toppled Nixon, who also tried to invoke "Executive Privilege" to cover it up, just like Obama is trying to do now. It's pretty plain to me that the Obama Administration wanted "Fast & Furious" to eventually cause gun crimes & death to US citizens & then use those events to push for more gun control laws. The problem: the Obama Administration got caught in the act of sending those guns to Mexico illegally. I have no doubt: both Holder & Obama pushed this program forward secretly & they never expected their secrets to be exposed. But exposed it was by some government agents involved who opposed this program. This whole thing is one more "count" that can be made on a long list of "counts" for which Obama should be impeached!

      Contrary to what most people seem to think the hearings aren't about gun walking, and letting Mexican criminals get guns….project gun runner was started in 2006, Congress approved and knew about it. So its not like Eric Holder (or someone in the justice department went rouge and started secretly selling guns in some shadowy sting operation) Nixon was covering up a crime, Eric Holder at worse is bad at his job… politically maybe a poor reflection on Obama, legally isn't a crime.

They don't!       As a retired peace officer I took great interest in Fast and Furious and have followed the information on it as it has become available. I have watched every committee hearing on this issue.

      The current adminstration keeps bringing up a former gun walking operation known as Wide Receiver, which was authorized under the Bush administration. However, there are MASSIVE glaring differences between Wide Receiver and Fast and Furious.

      1. Wide Receiver was a JOINT effort between the US and Mexican governments. However the Mexican government was never even informed about the existence of Fast and Furious.
      2. Wide Receiver involved a few hundred weapons which were tracked utilizing RFID tracking devices and not a single weapon was lost, whereas Fast and Furious involved thousands of weapons and no attempt was made to track them resulting in HUNDREDS OF LOST HIGH POWERED WEAPONS.
      3. Nobody lost their life as a result of Wide Receiver, whereas Fast and Furious resulted in the MURDERS of more than 300 Mexican citizens and 2 US Federal agents.
      4. Wide Receiver was a genuine effort by the governments of the US and Mexico to track the weapons to the cartels to get intelligence on their operations. Fast and Furious was little more than a smoke screen used by the current administration in an effort to promote it's political agenda of depriving US citizens of their Second Amendment rights.
      5. Wide Receiver was a legally authorized operation where accountability was accepted by the Bush administration and handled appropriately through international channels with Mexico. Fast and Furious was an ILLEGAL operation that was TREASONOUS and violated the territorial sovereignty of Mexico as well as US federal law and international laws/treaties. As soon as Fast and Furious came to light, according to the Obama administration, it was 'not authorized by either DOJ or the White House, therefore there is no accountability.

      Fast and Furious violated US Federal Laws as well as international laws and treaties from it's inception in 2009 with the current administration. Obama has stated publicly that neither he nor Holder authorized Fast and Furious and that he personally did not know anything about it, yet in order to exert executive privilege the operation would have had to have been 'derived from executive Constitutional authority' according to the SCOTUS decision in Nixon. In other words, it had to be a LEGAL operation in order for executive privilege to be exerted. The bottom line here is that even assuming that everything Obama says is true, which is beyond incomprehensible, not only does it show GROSS INCOMPETENCE, CRIMINAL NEGLIGENCE and MALFEASANCE, it also shows that the current administration is willing to try to sweep it under the rug and hide their ineptitude through an invalid exertion of executive privilege. Obama is admitting culpability by attempting to exert executive privilege.

      On top of all this, it should be noted that more than $50 MILLION of our taxpayer dollars was used to fund this operation under the 'stimulus package' as one of Obama's 'shovel ready jobs'. So even assuming you can buy into all the rest of their claims of not knowing anything about it, can you honestly believe that Holder and Obama didn't know where $50 MILLION of the DOJ budget was going and what it was being used for? When I worked for the department I had to file reports on every penny spent and what that money was used for, even if it was 50 cents to inflate a tire with low pressure at a garage.

      The motto of Truman was 'THE BUCK STOPS HERE', compared to the current administrtion's motto of 'PASS THE BUCK'. This is deplorable state of affairs and a disgrace to our nation.

      Anyone involved in the authorization of Fast and Furious, including Holder and Obama, should be tried for TREASON and as accessories to the MURDERS of more than 300 Mexican citizens and 2 US Federal agents.

      Rory Cooper's article is misleading to me. How can the rifle be untraceable if we knew it was the one that was used in the drug smuggler attack? I hope he means that the rifle used in the attack was traceable as one from the Fast and Furious program but that the specific rifle may not have killed B. Tracy. From all the stonewalling being done by the AG and the POTUS, there is a smoking gun that may implicate both the AG and the POTUS.       I find it difficult to believe that low to mid-level law enforcement in conjunction with advisory legal and prosecutorial personnel would engage in an operation involving 1. high probability of being mostly foreign nationals representing foreign "organized crime" violating laws(illegal purchases, money laundering,etc) within the U.S. and 2. most of the "operation" being designed to occur in a foreign country without high level involvement. This supposedly was done by personnel fairly well experienced in foreigner arrests and border procedures of international law as well as ongoing case law development. Yet, we are to believe they failed to notify a "representative", ambassador, embassy of the foreign country or anyone in the U.S. State Dept. or any top level administrator of the executive branch of such an operation. It is my understanding even accidental entry by an armed U.S. agent requires such minimal notification as is arrest and charging of a foreign national. Thus, an in-depth inquiry as to who, what, why is logical and depending on level of notification-may in effect indicate a foreign policy toward such foreign government threatening its destabilisation.
