  • VIDEO: Obama 'Manifestly Wrong' on U.S. Constitution, Says Sen. Mike Lee

Few lawmakers have expressed as much outrage over President Obama’s unconstitutional “recess” appointments as Sen. Mike Lee (R-UT). He was among the first to warn about the consequences of the president’s unilateral action on Jan. 4.

More than a month later, a new director is running the Consumer Financial Protection Bureau and three members of National Labor Relations Board are conducting business—all in blatant violation of the U.S. Constitution, Lee said in an interview with Heritage following a speech Monday.

“He’s reading the Constitution in a way that’s manifestly wrong,” Lee explained. “It’s contrary to the text. It’s contrary to tradition and practice, and it’s contrary to logic.”

Lee said the Constitution gives the president the ability to make recess appointments—but in this case the Senate wasn’t in recess. Just days before Obama made the appointments, for example, the Senate held a pro-forma session to pass the payroll tax cut extension.

“The president’s analysis doesn’t work,” Lee said. “It collapses under its own logic.”

In addition to his Heritage speech, Lee has testified before the House Oversight and Government Reform Committee and vowed to take other actions to oppose the appointments. And while it’s unclear if any of the individuals would be removed from office, Lee said he’ll continue to fight against executive branch overreach regardless of who is serving in the White House.

“This is not a partisan issue for me. I would be equally outraged if this were a Republican president doing this same thing,” Lee said. “Once this gains some momentum, this practice could be very destructive to the Senate’s prerogative of advice and consent. This is a power that doesn’t belong to the president. It belongs to the people of the United States of America.”

The interview runs about 5 minutes. Hosted by Rob Bluey and produced by Brandon Stewart. For more videos from Heritage, subscribe to our YouTube channel.

Where the hell is Mitch McConnell on this issue?

Where the hell is John Boehner?

These feckless GOP "leaders" need to be replaced with the likes of DeMint or Lee in the Senate and Bachmann/West in the House.

      Enough is enough, you cowards!

    2. Laura says:

Too much is being overrun in the government. We cannot let the Constitution be chipped away at like this or we will not have a strong document to protect the American people. This is an assault on our country. Please stand up to these things. The people are behind you, but we can do very little. You are our voice and we are counting on you!

    3. JBinGB says:

The United States of COWARDS!!! Starting in CONGRESS! obama should have had charges brought up against him by now. But, we have the "good ole boy" mentality going on and they don't want to make waves that could cost them there cushy jobs. To hell with their "oath."

    5. Lloyd Scallan says:

Most of us recognize that Obama has become a dictator, but no one is doing anything to stop him. Republicans, such as Lee do nothing but talk. Every time Obama does anything that is in direct conflect with the Constitution, the Repbs run for the cameras to state their objections, but that all. directorblue ask
"where the hell is McConnell and Boehner?" They're making behind the door deals with Dems to save their jobs. We hoped the Tea Party would save us. But they have been so maligned by the media, the Dems and the established Repbs, only a seperate third political party, made up of true conservatives (not more Mitts), can save this nation.

    6. Vincent Licitra says:

We have an election coming up and all you need to do is voice your opinion to those who would listen and then go to the voting booth. Do not let the false news clips and advertising change your perceptions. Good luck Americans and God Bless America.
