  • Two House Hearings Scheduled on Illegal Non-Recess Appointments

    Two House committees have scheduled hearings on President Obama’s unconstitutional appointments of four federal officials earlier this month.

    On Tuesday, the financial services panel of the Oversight and Government Reform Committee will examine the role that Richard Cordray will play at the helm of the newly created Consumer Financial Protection Bureau.  The hearing will be streamed live at http://oversight.house.gov.

    Subcommittee chairman Patrick McHenry (R-N.C.) called Cordray’s appointment an “apparent contravention of constitutional requirements for a recess appointment” in a Jan. 4 statement. The panel, McHenry added, “is deeply interested in how you will implement and enforce the unparalleled powers of your new office.”

    Next month, the House Judiciary Committee will take a closer look at the more general constitutional issues that have dogged the non-recess appointments. Chairman Lamar Smith (R-TX) called the appointments “unprecedented and possibly unconstitutional” in a release announcing the hearing.

    “The Constitution gives the Senate the authority to determine the rules of its proceedings,” Smith explained. “The President cannot unilaterally decide to rush through ‘recess appointments’ while the Senate is not in recess.”

    The constitutional case against the appointments has been detailed by Heritage legal experts Ed Meese, a former U.S. Attorney General, and Todd Gaziano, who worked in the Justice Department’s Office of Legal Counsel in three different administrations.

    The Judiciary Committee has not yet said who will testify at its hearing.

      What happened to the vow he made? How much has this administration cost the American dollar in defense from the unconstitutional acts of this abusive administrative government authority? This administration continues to act in contempt of the people and the American peoples' constitution!

        Congress has slowly allowed Presidents, especially this one, to usurp their rightful authority. Hearings are a good start, but what leverage do they have now? The House frittered away their biggest bargaining chip last August with the debt-ceiling debate. You're correct…if he is to be stopped, we the people must do so in November.

      The Republicans let theis President get away with whatever he desires. Oh yes they stamp their little feet in feigned protest and they hold a meeting, but that is as far as it ever goes. Just like a pet or a spoiled child they soon learn that your little fit of protest never amounts to anymore than that and merely emboldens them to push the borders just a little bit further each time. Soon so have a little tyrant on your hands who is uncontrollable. Like a parent you have no one to blame but yourself. Unless you leash Obama in things are only going to get worse, and you may as well back up and go home. There are three equal branches of government. If you abidicate your roll in government you leave an out of controll freightline plunge blindly into the night until it self destructs. The Congress must take a stand now!

      I am truly concerned the Office of the President can recover from the actions taken by this President. He continues to 'push the envelope' in such a dangerous direction. I am concerned that there may come a point where he will take a larger step 'over the line'. I agree, Americans who are concerned about liberty must come together, be active, influence those who do not see these dangers, and remove Mr. Obama from Office.

      The House of Representatives should do to Obama what it did when President Andrew Johnson made appointments without the consent of the Senate, ignored legislation passed by Congress and then tried to demonize Congress through appeals to the populace. It did not appeal to the courts but impeached him, although the Senate missed convicting him by one vote. At least we can get our politicians on record for supporting the Constitution.

      If this is unconstitutional why are you studying the potential results??? I can't understand why you keep playing "politics" when you should be playing "illegal?" Somehow show us the people that you mean business and take him to court. Take him to court when he wakes up in the morning for what he is thinking about doing, take him to court before lunch and dinner. Take him to court before he takes his next vacation. I know there are attornies in your group.We have pissed enough of our tax dollars allready why not use some of it to stop this guy???? He will sue us at a drop of a hat and not ask questions!! Right???

      I don't just want Committees formed, or discussions, I want to see some action, like "Hell no, He has no authority to do that", therefore it is null and void. As long as no one stops a thief why should he give up robbing banks?? Hey, the money is good too……..(Vacations, parties, rock stars, private jet and we pay.

        The joke Charlie is on the people who support a Senate Leader that WILL NOT pass a budget for over 1000 days. Many of the days which the Democrat party enjoyed total control over the Federal Government. I guess the JOKE is on all of the gullible people that believed that Obama was going to be the one to unite all Americans. Like he does every time he attacks anyone that disagrees by referring to them as a greedy racist. Isn't it a JOKE how the only capitalism suppoted by the Democrats involes kickbacks or cronyism to the well connected within the Democratic Party. It's a JOKE that we have a leader that has NEVER made a payroll in his life, but he's quick to tell those of us that have made payrolls and employed Americans that he is smarter and knows how to grow an economy while the unemployment in this country continues to ballon to higher and higher numbers of Americans.           The constitution does not have a minimum time that the senate is in recess.
          Article Two section two
          "The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session."

      I agree with what many have already said – it's time to stop arguing and fight. We don't need a discussion of this sham appointment or a new "Department." Cut it off by not funding it and give Obama a legal battle for the history books!

      Of course the accusation will be "politics in an election year," but there will always be such opposition. Do the right thing and don't turn back!

      This should be a republican issue – this should be a constitutional issue that all Americans should be mad about… including democrats. Where is the integrity? Where is the outrage? Didn't he (Obama) pledge to uphold the constitution? Just another lie from Obama. He continues to amaze me… anti-american, anti-business, anti-growth, anti-truth, anti-constitution, etc.
