  • Morning Bell: California Cap and Trade Tripped Up By Pollution Rhetoric

    The economic harms of carbon cap-and-trade policies are so well established that even a state as reliably leftist as California has never been able to pass a plan through their legislature. Instead, environmentalists in the Golden State have relied on the California Air Resources Board (CARB), whose appointed governing board is democratically unaccountable, to develop and impose carbon regulations by bureaucratic fiat. And this past December, much to the delight of many environmentalists, CARB passed the first carbon cap-and-trade scheme in the United States. Everything looked ready to go … until a San Francisco Superior Court judge issued a ruling, just made public last week, that, if made final, would stop CARB from implementing its plan. The plaintiffs in the suit? The Center on Race, Poverty, and the Environment.

    So why is a group called the Center on Race, Poverty, and the Environment suing to stop carbon cap and trade? The New York Times reports: “Poor communities, particularly in Southern California, have been leery of market-based systems of pollution control, believing that industries nearby would be able to pay for extra pollution allowances and continue to send dangerous chemicals into their neighborhoods.” And what is this “dangerous” pollutant the Center on Race, Poverty and the Environment says will be pumped into their neighborhoods? Carbon dioxide. The same chemical compound that you and I are exhaling right now.

    The Times goes on to report that “no one maintains that carbon dioxide is a hazardous pollutant dangerous to local communities.” Oh, but they have. The Obama Administration’s own Environmental Protection Agency (EPA) has found that carbon dioxide is a dangerous pollutant that poses a “danger to public health and welfare.” As a result EPA Administrator Lisa Jackson is moving ahead with plans to regulate carbon as a “pollutant” under authority granted her by the Clean Air Act.

    Of course, the Clean Air Act was never meant to give the EPA the power to regulate a substance as ubiquitous as carbon dioxide. This quickly becomes obvious when looking at the levels of “pollution” that the Clean Air Act would mandate the EPA to regulate. When it was passed, the Clean Air Act mandated that the EPA must regulate sources of real pollutants (like acrylic acid, chlorine, and benzene) that emitted 100 or 250 tons or more of a pollutant per year. Only truly industrial-sized outfits came under these regulations. But carbon dioxide is much more common. The 100-ton limit will ensnare schools, farms, restaurants, hospitals, apartment complexes, churches, and anything with a motor—from motor vehicles to lawnmowers, jet skis, and leaf blowers. If you own any of these items or eat, sleep, learn, or pray in any of these establishments, you are about to become very familiar with EPA regulators.

    The Obama EPA believes they can unilaterally rewrite the Clean Air Act’s pollution thresholds to minimize the economic pain their rules will create. This is the same Obama Administration that thinks Obamacare is constitutional. The Obama EPA will get sued over their carbon regulations, and they will lose. But that does not mean that Congress should sit idly by while the Obama EPA wreaks havoc on our tentatively recovering economy. They have authority under the Congressional Review Act to stop Lisa Jackson in her tracks.

    California will undoubtedly find a way around the Center on Race, Poverty and the Environment lawsuit against cap and trade. CARB’s job-killing regulations will eventually go into effect, shooting California’s already above-the-national-average unemployment even higher. But it is not too late for the rest of the nation. The Obama EPA can be stopped.

I am an older Dad and to provide for my family and child I need to carry conventional insurance for them but because I am dropped from their health care plan due to my age I must purchase additional insurnace to cover me.

      The ongoing CO2 farce is sickening. The fact it that there are two other things that affect any planetary warming on levels that are orders of magnitude greater than something like CO2: the Sun and water vapor. Those and the fact that it has been proven that CO2 FOLLOWS warming and does not cause it.

      What I have said before and will reiterate this question: If the EPA is going to outlaw CO2, what about the CO2 used in medical applications and surgeries? What about food freezing operations (it is a better choice than nitrogen or ammonia and far faster than most mechanical freezing operations)? What about fire control systems? What about inerting operations? What about a certain pH controlling application in wastewater streams? What about cryogrinding and deflashing? What about plant growth? What about beer, sparkling water, club soda, sparking wines and ciders, etc? What about hollywood's low lying movie "fogs" ? What about the thousands of folks who work in the gases business of SELLING CO2 – is the EPA going to make them criminals?

      There is no difference here from declaring water as dangerous, because one can drown in it. The entire CO2 debacle is senseless. Pretty soon, some jerk enviro-weenie will declare that our exhalations are bad…..oh wait, I believe a few have already committed to that and endorse the reduction or destruction of Mankind. Would that they should lead the way.

      Here are the facts about CO2: The percentage of CO2 in the atmosphere is less than .04% For simplicity call it .04%. To make this understandable, if you were to fill a stadium with 100,000 people CO2 would be represented by 40 people. Thats how little CO2 is in the air. If you were to ask a proponent of reducing this dangerous gas in the air by 50% my guess is that they would agree. If this were to happen All thats right ALL living things on the surface of the planet would die. All surface life depends on only one process for survival. That is photosynthisis, the conversion of sunlight, CO2 and to nitrogen to a lesser degree into oxygen and :food: for plant life. Without plant life ALL living things[with a few rare anerobes excepted] would ceast to survive.

      Actually, there already is a Cap & Trade scheme up and running in 10 Northeast states. It's called the Regional Greenhouse Gas Initiative (RGGI) and has been in operation for over 2 years now.

      For the LAST time Ken J. I have a family. In order to cover them with insurance and maintain what I had before I turned 65 (basic health care with a $500 deductible) I maintained my policy. My costs went up BECAUSE I (not my family) am now on Medicare A&B plus a cheap supplimental. Not even close to the Cadillac plans enjoyed by unions. Insurance companies do not cover people on Medicare – at least in Michigan. As I see it, I am penalized for being a dad and sixty-five. If I had a choice I would decline Medicare and save $2600.00 a year. No choice.

      It is for this reason and others I have little faith in our government. Simply follow the money and the true motives become obvious. This applie to crony capitalism as well.

      And finally, when Al Gore is able to regulate solar flairs then I will subscribe to his premise of "global warming."

      We are enter a solar activity cycle which combines 100 year and 11 year cycles which will have profound effects on the climate but there is nothing we can do about them.       California is without a doubt the Poster Child example of what happens when ever diminishing returns in educational results are accepted.       Nothing could illustrate this better than what is going on vis a vis our government and Carbon Dioxide:

      1. Carbon Dioxide aka CO2 is one of only two primary gases exhaled from the flora and fauna of the entire planet.

      2. The other gas is Oxygen aka O2

      3. These two gases make up the the two components of the Carbon Cycle.

      4. The Carbon Cycle is the very basis of life on this planet. A quick explanation: CO2 is 'inhaled by plants (flora) the plant processes the CO2 and the plant exhales O2, man and all animal life (fauna) 'inhales' O2 and uses is chemically throughout our bodies and when done with it exhales it as CO2.

      It should be obvious that our tinkering around with the CO2 component of this cycle is really, really playing God. It is arrogant beyond belief, at the same time it is ignorance on steroids,

      Cap and Trade started out as a get rich scheme (read: Hoax, Scam) set up by Al Gore for the immense enrichment of he and his friends mostly at the American Taxpayer's expense. The underlying premise of runaway Global temperatures due to rising levels of "Man Made" CO2 in our atmosphere has been shown to completely false, even to the point of key scientists admitting to falsification of data to produce their desired results (and attendant grants)

      Putting Governor Moonbeam back at the Helm of State just makes the situation all the worst for poor, dumbed down California. We're their next door neighbor and I can hardly wait to see how our enlightened elite manage to get their slice of this pie.

      Come on guys, look on the bright side, Obama can now employ 50,000 new government employees to follow us around with a meter to see how much we emit. You know how they have people to fondle you at airports? well now they can check you out at church or school or the grocery stores, or at the mall. I do wonder how they would measure methane gas from those who expel an abundance of "gas". I wonder if that would get you hazard pay, or more paid days off for stress related jobs. When we have all had enough, we will wake up and smell the coffee, maybe it would be a welcome change for the paid sniffers.       Where are the EPA's priorities? It must first regulate and let us hope eliminate a more terrifying scourge from our country. This unregulated substance kills many people, including many children, and causes billions of dollars in property damage every year worldwide. It is present in our soil, our rivers and our oceans. Its chemical properties create instability in our ice caps. In gaseous form it becomes trapped in the atmosphere, causing the Earth to retain heat. In its gaseous form, it can also cause severe burns, including to children, every year.       CARB, California Air Resources Board is a totally corrupt state agency with over 1,000 very highly paid employees. Their lead scientist, a one Hein Tranh released a comprehensive report which a group of Berkeley scientists determined was exaggerating pollution levels by 300 percent. As a result CARB had to back way off concerning some rulings regarding Diesel Engines. Shortly thereafter it was discovered that Mr Tranh,s doctorate was totally fraudulent and was issued by a New York diploma mill. Tranh was demoted and his salary reduced from 120,000 down to 80,000 dollars. Why is Tranh still being paid when he should be in jail? Got to tell you a lot about CARB which is the darling of the enviro whackos. This agency gave us MTBE, they should be abolished without further ado. They have cost us billions and the bill will mount if they succeed with their wild Cap and Trade scheme! You will indeed see a mass exodus from California if this plan is not dumped! AB 32 must be repealed if we are to avoid total financial collapse.

      Ken J. I am 75 and on all the social hand outs but have a son in college which my previous company insurance would have allowed me to have him on my policy for and additional $51 dollars/month. I can't add him to medicare or medicade so its $187/month high deduction basic policy with a low cap. My company also dropped me from both health and term life when I reached 65. Had to pay for him as he grew up. And my son's insurance goes up to $212/month the 1st of March. Can you guess the reason? We need the Fed EPA to be run by a board composed of State EPA directors instead of the Executive branch of the Federal Government.

      Ridiculous, how dumb do they think we are to tell us that CO2 is a "Pollutant" in true definition of the word when the biggest contributor of Carbon Dioxide is natural and not man made. How are they going to force a cap and trade system on dying trees, animals and plants?

      As has been aluded to by several of the previous intelligent commentors, I, in my ancient outmoded public education was taught that in our natural life system all animals inhaled oxygen, exhaled carbon dioxide, which in turn was absorbed by plants that by photosynthesis used the carbon molecules for growth emitting the oxygen molecules for reuse by animals. Did the EPA, Gore, or the POTUS in their infinite wisdom cancel this? I certainly hope not, because I was planning on replanting some trees this spring and planting a garden to supplement our toxin-laden diet. If anyone out there knows for sure please comment.       I don't like cap and trade as a means to limit production of energy; but I do like it if it could be used as a currency,an exchange or a trade. The value of the dollar is decreasing. but energy's value is increasing.
