  • Morning Bell: California Cap and Trade Tripped Up By Pollution Rhetoric

The economic harms of carbon cap-and-trade policies are so well established that even a state as reliably leftist as California has never been able to pass a plan through their legislature. Instead, environmentalists in the Golden State have relied on the California Air Resources Board (CARB), whose appointed governing board is democratically unaccountable, to develop and impose carbon regulations by bureaucratic fiat. And this past December, much to the delight of many environmentalists, CARB passed the first carbon cap-and-trade scheme in the United States. Everything looked ready to go … until a San Francisco Superior Court judge issued a ruling, just made public last week, that, if made final, would stop CARB from implementing its plan. The plaintiffs in the suit? The Center on Race, Poverty, and the Environment.

So why is a group called the Center on Race, Poverty, and the Environment suing to stop carbon cap and trade? The New York Times reports: “Poor communities, particularly in Southern California, have been leery of market-based systems of pollution control, believing that industries nearby would be able to pay for extra pollution allowances and continue to send dangerous chemicals into their neighborhoods.” And what is this “dangerous” pollutant the Center on Race, Poverty and the Environment says will be pumped into their neighborhoods? Carbon dioxide. The same chemical compound that you and I are exhaling right now.

The Times goes on to report that “no one maintains that carbon dioxide is a hazardous pollutant dangerous to local communities.” Oh, but they have. The Obama Administration’s own Environmental Protection Agency (EPA) has found that carbon dioxide is a dangerous pollutant that poses a “danger to public health and welfare.” As a result EPA Administrator Lisa Jackson is moving ahead with plans to regulate carbon as a “pollutant” under authority granted her by the Clean Air Act.

Of course, the Clean Air Act was never meant to give the EPA the power to regulate a substance as ubiquitous as carbon dioxide. This quickly becomes obvious when looking at the levels of “pollution” that the Clean Air Act would mandate the EPA to regulate. When it was passed, the Clean Air Act mandated that the EPA must regulate sources of real pollutants (like acrylic acid, chlorine, and benzene) that emitted 100 or 250 tons or more of a pollutant per year. Only truly industrial-sized outfits came under these regulations. But carbon dioxide is much more common. The 100-ton limit will ensnare schools, farms, restaurants, hospitals, apartment complexes, churches, and anything with a motor—from motor vehicles to lawnmowers, jet skis, and leaf blowers. If you own any of these items or eat, sleep, learn, or pray in any of these establishments, you are about to become very familiar with EPA regulators.

The Obama EPA believes they can unilaterally rewrite the Clean Air Act’s pollution thresholds to minimize the economic pain their rules will create. This is the same Obama Administration that thinks Obamacare is constitutional. The Obama EPA will get sued over their carbon regulations, and they will lose. But that does not mean that Congress should sit idly by while the Obama EPA wreaks havoc on our tentatively recovering economy. They have authority under the Congressional Review Act to stop Lisa Jackson in her tracks.

California will undoubtedly find a way around the Center on Race, Poverty and the Environment lawsuit against cap and trade. CARB’s job-killing regulations will eventually go into effect, shooting California’s already above-the-national-average unemployment even higher. But it is not too late for the rest of the nation. The Obama EPA can be stopped.

What do YOU pay for HCare NOW?

      What jobs will it kill?

The GOP – says that – but NEVER gives any examples.

Example are good it helps the readers understand,

otherwise it is just MORE GOP DOOM AND GLOOM.

he’s a business man. He writes pay roll, every week, which also paysy into the social security system, that’s supporting you.

      The last stats I read about NV;

It has one of the highest unemployment rate ~17% in the nation, one of the highest illegal immirgrate populations in the United States. It also has one of the most violent crimes rates in the nation,no surprise there.

      But whose talking in NV.

      It’s an open border state.

Harry Reid and the highly financed Chamber of Commerce has been hidding the facts for years to get all those tourism dollars.

So Ken, either change your oxygen bottle and read something besides People Magazine and get your fact straights.

Any one with a knowledge of third grade math can figure- out that IF, Socalized medicine is passed here in America, allowing all persons, including millions of non-citizens free health care passed on to all of us that work…rationing will be the first reaction and certainly hospitals will close .

If you mistakie my facts just look West, and download the budget for L.A. County, in your sister State, CA, also an open border state. You can smell the fear.

In just baby border births, the deficit is $500, million .But don’t stop there…the school system ,in the state of chaos, police and fire depts slated to be cut …

Yes Ken, you can smell the fear because even Harry Reid and Nancy Pelosi can’t stop this run away train reck. Have a nice day!

*** Carol – Wow that was a Lot.

NV does have a illegals living here,

a lot came over from AZ after they passed that

      Check 'em law.

That is a GOOD law – wish we had it in NV.

      ObamaCare DOES NOT COVER ILLEGALS.

The GOP have been in Control for a month -

One big difference in BHO and RWR is that RWR was not arogant, he listened to the people and was one of us. He worked as a young boy and even as POTUS he would go to his ranch and cut wood. BHO has never gotten his hands irty and looks down on the common man as a neccessary evil, he is a traitor to what my ancestors came here and fought for. His snubbing of the Memorial day cer. at Arlington show that. I am a proud member of the Mayflower society and former CAR, in every war from King Phillip’s war through Veit Nam a member of my family fought including the Drummer Boy at Shiloh. K.Jarvis, if you don’t LOVE this country there are planes and ships leaving everyday, we need true patriots like those of 1776.

      *** Jeanne – Interesting,

      but – "cut wood"?

Here is what I KNOW – Obama is working to help the common man.

Regan said – "Govt is the Problem"

Nowadays the GOP is the Problem.

    2. DB, NJ says:

Congress must reel in the EPA and soon. The EPA needs a trip to the wood shed and a reminder of who the legislative body is.

    3. George (Oldguy), Wes says:

The EPA grows, steadily gaining control of our lives and freedoms while our President goes on battling our States, ignoring court orders and preventing us from developing our natural energy resources.

The Congress, supposedly our Legislative Branch, allows them to go on legislating by dictate.

How do you think the economy would fare without the unconstitutional oversight of the EPA?

    4. Monica, Slatington P says:

Maybe we should just all cut down on our breathing.

    5. Robert, North Richla says:

Who is going to stop the Obama EPA? John Boehner? Mitch McConnell?

They do not even possess the brass necessary to cut spending, so you better find someone else to stop the EPA.

    6. Wendy, USA says:

ARE THERE NO SANE PEOPLE LEFT ON THIS PLANET??? Well, if the ecoterroristprogressives have their way, there won't be!!!! CO2 IS NOT A POLLUTANT!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    7. Joan, Dallas, Texas says:

This is excactly what the Obama administration wants to do…concealed in false promises and lies, Obama and his democrats forge on with their job killing agenda. By driving businesses towards destruction and more layoffs, driving up the cost of oil, gas, electricity, and food, America will be just where Obama intends us to be. Out of work, out of money, and out of luck. This will force all of us to become dependent on government, and government will grow expotentially. It's the end of America as we know it.

    8. Bernard P. Giroux, S says:

The most dangerous people in America today are radical environmentalists. It is time to dismantle the organizations and departments which can make rules that are not subject to public scrutiny and control, but, in effect rule the constituency by fiat. In addition to budget cuts, the Congress and state governments need to begin dismantling the branches that are not under immediate supervision and control of the legislators. Without this, budget cuts are just a band-aid, and when the public feels good about itself again, which it may never do, it has too short a memory to avoid getting slammed by special interest groups who control these government agencies. The time to put a stop to this type of government is now, not later. .

    9. Richard H. Irish, Ed says:

      Step Number One:

Remove and indict Obama! The man's (claimed) father NOT being a U.S. citizen precludes Obama from being Constitutionally eligible to be President.

No Obama, no appointees, no problem in undoing what this horrible Marxist hoax has wrought!

    10. Ruth Hartje, Tulsa, says:

Is the Heritage Foundation talking to our new Republican legislators about stopping the EPA from regulating carbon?

What action is being taken as we speak? Are they planning on utilizing the Congressional Review Act to put a stop to this nonsense…that only equates to much higher energy bills by an unelected bureaocracy?

    11. ThomNJ says:

The ongoing CO2 farce is sickening. The fact it that there are two other things that affect any planetary warming on levels that are orders of magnitude greater than something like CO2: the Sun and water vapor. Those and the fact that it has been proven that CO2 FOLLOWS warming and does not cause it.

What I have said before and will reiterate this question: If the EPA is going to outlaw CO2, what about the CO2 used in medical applications and surgeries? What about food freezing operations (it is a better choice than nitrogen or ammonia and far faster than most mechanical freezing operations)? What about fire control systems? What about inerting operations? What about a certain pH controlling application in wastewater streams? What about cryogrinding and deflashing? What about plant growth? What about beer, sparkling water, club soda, sparking wines and ciders, etc? What about hollywood's low lying movie "fogs" ? What about the thousands of folks who work in the gases business of SELLING CO2 – is the EPA going to make them criminals?

There is no difference here from declaring water as dangerous, because one can drown in it. The entire CO2 debacle is senseless. Pretty soon, some jerk enviro-weenie will declare that our exhalations are bad…..oh wait, I believe a few have already committed to that and endorse the reduction or destruction of Mankind. Would that they should lead the way.

    12. R Holland, Chandler, says:

      California gets what California deserves.

    13. Phyllis Bickham, Tex says:

So,,,in other words we should all stop breathing. What a bunch of idiots we have trying to run our private lives. ENOUGH IS ENOUGH!!!!!!!!!!!!

    14. B. Eric, Syosset N.Y says:

Here are the facts about CO2: The percentage of CO2 in the atmosphere is less than .04% For simplicity call it .04%. To make this understandable, if you were to fill a stadium with 100,000 people CO2 would be represented by 40 people. Thats how little CO2 is in the air. If you were to ask a proponent of reducing this dangerous gas in the air by 50% my guess is that they would agree. If this were to happen All thats right ALL living things on the surface of the planet would die. All surface life depends on only one process for survival. That is photosynthisis, the conversion of sunlight, CO2 and to nitrogen to a lesser degree into oxygen and :food: for plant life. Without plant life ALL living things[with a few rare anerobes excepted] would ceast to survive.

    15. Bruce J. Kolinski says:

One day, much too late, we will realize that under the pathetic veil of political correctness we allowed ignorant, brainwashed Marxists to destroy our society with irrational nonsense like the concept of toxic carbon dioxide.

Our Federal government has become Public Enemy No. 1. Our de-educational system and its systemically dumbed down universities have now risen to become Public Enemy No. 2.

The United States is in serious trouble, but at least Green Bay won the Super Bowl. How cool is that?

    16. MikeGSP says:

"And this past December, much to the delight of many environmentalists, CARB passed the first carbon cap-and-trade scheme in the United States."

Actually, there already is a Cap & Trade scheme up and running in 10 Northeast states. It's called the Regional Greenhouse Gas Initiative (RGGI) and has been in operation for over 2 years now.

Read more here: http://www.NoNJCapAndTrade.com or at New Jersey Watchdog.

    17. KC - New Mexico says:

Stupid politicians! Have they ever conducted their own research or reached out to the scientific community? May be doing this once in awhile would keep them from looking so dumb! This seems to be the ongoing problem today with the elected politicians. Start now by looking forward to 2012 elections and bringing is some intelligent and capable leaders to run this country and the states.

    18. Dennis Georgia says:

The epa is totally out of controll with the obama crowd never restricting them to any accountable. The the epa are making regulations based on their feelings, not on law or common since. We as citizens must take action with our senators and representatives to stop this BS. I do think before long they will want to put a tax on each breath and monitor each time we pass gas, as I am sure they will find something that is bad for public health.

    19. Joe, Orlando says:

I have something that can convert that nasty CO2 into some thing less hazardous with out the necessary regulation – its called a plant, tree, vegetation, grass or, G-d forbid, a bush. Please vist your local nursery.

    20. Dougla A Giese , Osa says:

How much CO2 should a human be allowed to exhale?

    21. Adam NC says:

"The danger to America is not Barack Obama but a citizenry capable of entrusting a man like him with

the Presidency. It will be far easier to limit and undo the follies of an Obama presidency than to

restore the necessary common sense and good judgment to a depraved electorate willing to have such a

man for their president. The problem is much deeper and far more serious than Mr. Obama, who is a mere

symptom of what ails America. Blaming the prince of the fools should not blind anyone to the vast

confederacy of fools that made him their prince. The Republic can survive a Barack Obama, who is,

after all, merely a fool. It is less likely to survive a multitude of fools such as those who made him

      their president."

    22. Adam NC says:

This whole thing is about "control" of YOUR life and wealth. Its a shame that our young people have been propagandised to the point of permanent stupidity by the progressive leftist marxists.

C02 is everywhere, has been since the beginning of the planet. C02 is only poisonous if you use it to displace oxygen. Thats why its used in fire extinguishers.

Without C02 our lives would end because there would be no plant growth and no food. Its time to smack the libs around with the truth and get them back into reality.

    23. Suzanne, Florida says:

Idiocy is running loose in this country now. Like Adam NC I still marvel that someone with no experience in any field could CON so many fellow citizens. I ran across a blurb by John Heilemann, author of "Game Change,"To paraphrase, he says that for almost the first two years post election the nation was run by three or four people of his inner circle! He goes on to say that the President chose a pretty good cabinet but they might as well have been in the witness protection program as for the above mentioned first two years, the cabinet majority never received a single call from the WH. Too further his remarks he mentioned Valerie Jarrett who pointed out that not only had he never managed any operation, he'd never had a nine-to-five job in his life.

Now we are lead to believe that his wisdom & experience will pull us through the current & future problems facing our nation. PRAY

    24. Henry ,Illinois says:

I wonder if this so-called epa "administrator" lisa jackson is going to fine/regulate the hazardous substance (carbon dioxide) that she herself exhales each and every day? All of this has nothing to do with what they ( environmental whacos ) claim, but everything to do with money that the restrictions will generate for the select "inn" group and you all know who they are,one of them even got the Nobel prize for the scam that he perpetrated regarding same.

    25. and2therepublic, ill says:

Yesterday morning I observed a small flock of bluebirds in my front yard, which I thought strange as we had a blizzard not many days ago. If I had read this essay prior to my observations I could have eliminated those miserable co2 emiting creatures from the face of the earth. I mean for heaven's sake they were trying to kill me with all that exhaling they were doing in my midst! And a few days prior to this 'incident' I observed a bald eagle spewing co2 all throughout my neighborhood, I probably should have removed him too!

    26. Blair Franconia, NH says:

      What's cap and trade?

    27. Ben C. Ann Arbor, MI says:

For the LAST time Ken J. I have a family. In order to cover them with insurance and maintain what I had before I turned 65 (basic health care with a $500 deductible) I maintained my policy. My costs went up BECAUSE I (not my family) am now on Medicare A&B plus a cheap supplimental. Not even close to the Cadillac plans enjoyed by unions. Insurance companies do not cover people on Medicare – at least in Michigan. As I see it, I am penalized for being a dad and sixty-five. If I had a choice I would decline Medicare and save $2600.00 a year. No choice.

It is for this reason and others I have little faith in our government. Simply follow the money and the true motives become obvious. This applie to crony capitalism as well.

And finally, when Al Gore is able to regulate solar flairs then I will subscribe to his premise of "global warming."

    28. Lee McDermid says:

    29. Dexter60, San Franci says:

At the center of the miasma that is central governance in America, as well as California, is the EPA and its kindred — we have let enough scum rise to the top, it is time to hit the handle and flush them away.

They are at best the mosts useless drug on the market.

They can joint the army it will take to collect the taxes that are being used against us for 24 cents an hour and trying to avoid a Purple Heart.

    30. wally, Zion IL says:

Ask any scientist which has more effect on the climate, sun, water vapor, or CO2, they will all say #1 sun, #2 water vapor and a far distant # 3 CO2.

We are enter a solar activity cycle which combines 100 year and 11 year cycles which will have profound effects on the climate but there is nothing we can do about them. Enviromentalists all want us to develope hydorgen fuel which will increase the #2 climate problem, water vapor, yet the only thing we hear about is CO2.

I wonder if there could be a relationship between the outcry and the deep pockets that the lawyers can see to take advantage of?

    31. Philip Vogel, Phoeni says:

Time for the Congress, specifically the House, to pull the plug on the EPA. Abolish the EPA, or at the very least, reduce it's operating budget to $0.00. The EPA is an oppressive government organization that forges ahead with it's socialist agenda despite court rulings and Congressional oversight and recommendations. Time to un-plug the EPA.

    32. David Peacock says:

Let us all hope Caaaalifornia can shut it down; the stupidity of declaring CO2 a poisonous green house gas is laughable; guess obumbler did not take any Biology classes in college.

    33. Sandra Lampkin, Texa says:

EPA has overstepped its authority and Congress needs to step in. No agency should have the authority to impose laws and regulations that have not been authorized by Congress. Current practice leaves the American citizens subject to the whims of a few zealots.

    34. Lee-White Tanks AZ says:

California is without a doubt the Poster Child example of what happens when ever diminishing returns in educational results are accepted. In their case, as in many, Sat scores have decreased, job performance has suffered, and very importantly the ballot box has reflected a terrible loss in the body politic's ability to separated good people from con artists.

Nothing could illustrate this better than what is going on vis a vis our government and Carbon Dioxide:

      1. Carbon Dioxide aka CO2 is one of only two primary gases exhaled from the flora and fauna of the entire planet.

      2. The other gas is Oxygen aka O2

      3. These two gases make up the the two components of the Carbon Cycle.

      4. The Carbon Cycle is the very basis of life on this planet. A quick explanation: CO2 is 'inhaled by plants (flora) the plant processes the CO2 and the plant exhales O2, man and all animal life (fauna) 'inhales' O2 and uses is chemically throughout our bodies and when done with it exhales it as CO2.

It should be obvious that our tinkering around with the CO2 component of this cycle is really, really playing God. It is arrogant beyond belief, at the same time it is ignorance on steroids,

Cap and Trade started out as a get rich scheme (read: Hoax, Scam) set up by Al Gore for the immense enrichment of he and his friends mostly at the American Taxpayer's expense. The underlying premise of runaway Global temperatures due to rising levels of "Man Made" CO2 in our atmosphere has been shown to completely false, even to the point of key scientists admitting to falsification of data to produce their desired results (and attendant grants)

Putting Governor Moonbeam back at the Helm of State just makes the situation all the worst for poor, dumbed down California. We're their next door neighbor and I can hardly wait to see how our enlightened elite manage to get their slice of this pie.

What independent sourced evidence is there to mandate this ridiculousness? The government is allowing the EPA to paranoid the masses! And the supposed vulnerable ones, FEAR MONGERING!

    37. RUTH SC says:

Come on guys, look on the bright side, Obama can now employ 50,000 new government employees to follow us around with a meter to see how much we emit. You know how they have people to fondle you at airports? well now they can check you out at church or school or the grocery stores, or at the mall. I do wonder how they would measure methane gas from those who expel an abundance of "gas". I wonder if that would get you hazard pay, or more paid days off for stress related jobs. When we have all had enough, we will wake up and smell the coffee, maybe it would be a welcome change for the paid sniffers. You gotta take this lightly or you would need those guys in the white coats to come and take us away. Ha Ha- they are coming to take us away, Or maybe we need calgon to take us away, that might be a little more pleasant. By the way do smokers emit different gasses than non smokers? God bless you all trying to sort this mess out.

    38. James B says:

Where are the EPA's priorities? It must first regulate and let us hope eliminate a more terrifying scourge from our country. This unregulated substance kills many people, including many children, and causes billions of dollars in property damage every year worldwide. It is present in our soil, our rivers and our oceans. Its chemical properties create instability in our ice caps. In gaseous form it becomes trapped in the atmosphere, causing the Earth to retain heat. In its gaseous form, it can also cause severe burns, including to children, every year. This horrifying substance must be heavily regulated by the EPA to make us safe before any attention is paid to the much less ghastly carbon dioxide.

    39. craig Sacramento says:

CARB, California Air Resources Board is a totally corrupt state agency with over 1,000 very highly paid employees. Their lead scientist, a one Hein Tranh released a comprehensive report which a group of Berkeley scientists determined was exaggerating pollution levels by 300 percent. As a result CARB had to back way off concerning some rulings regarding Diesel Engines. Shortly thereafter it was discovered that Mr Tranh,s doctorate was totally fraudulent and was issued by a New York diploma mill. Tranh was demoted and his salary reduced from 120,000 down to 80,000 dollars. Why is Tranh still being paid when he should be in jail? Got to tell you a lot about CARB which is the darling of the enviro whackos. This agency gave us MTBE, they should be abolished without further ado. They have cost us billions and the bill will mount if they succeed with their wild Cap and Trade scheme! You will indeed see a mass exodus from California if this plan is not dumped! AB 32 must be repealed if we are to avoid total financial collapse.

    40. Dave W. Provo. UT says:

Ken J. I am 75 and on all the social hand outs but have a son in college which my previous company insurance would have allowed me to have him on my policy for and additional $51 dollars/month. I can't add him to medicare or medicade so its $187/month high deduction basic policy with a low cap. My company also dropped me from both health and term life when I reached 65. Had to pay for him as he grew up. And my son's insurance goes up to $212/month the 1st of March. Can you guess the reason? We need the Fed EPA to be run by a board composed of State EPA directors instead of the Executive branch of the Federal Government.

    41. BMB7872 says:

Ridiculous, how dumb do they think we are to tell us that CO2 is a "Pollutant" in true definition of the word when the biggest contributor of Carbon Dioxide is natural and not man made. How are they going to force a cap and trade system on dying trees, animals and plants?

I read if every American planted 1 tree it would reduce CO2 emmission by 5% of the total we as humans create. How about some common sense approaches and strategies?

    42. Nancy, Georgia says:

Please, people, let's leave Ken out of the discussion?

    43. Denver, Oklahoma says:

As has been aluded to by several of the previous intelligent commentors, I, in my ancient outmoded public education was taught that in our natural life system all animals inhaled oxygen, exhaled carbon dioxide, which in turn was absorbed by plants that by photosynthesis used the carbon molecules for growth emitting the oxygen molecules for reuse by animals. Did the EPA, Gore, or the POTUS in their infinite wisdom cancel this? I certainly hope not, because I was planning on replanting some trees this spring and planting a garden to supplement our toxin-laden diet. If anyone out there knows for sure please comment. I sure hope this still works, otherwise?? Just think about all the volcanoes, suboceanic vents and all the rotting vegetation… WE'RE DOOMED!!! but only by our own stupidity.

    44. isaac pentlin, york, says:

I don't like cap and trade as a means to limit production of energy; but I do like it if it could be used as a currency,an exchange or a trade. The value of the dollar is decreasing. but energy's value is increasing. Although the environmentalist are capping and choking America's energy's we still have enough to trade internationally. or the energy I don't use could be sold at the bank for cash. There is an idea here!

    45. Sandra Lee Smith, Ca says:

The only truly effective way to cut down the CO2 levels to what this bunch wants is to STOP lots of living creatures, which includes HUMANS, from BREATHING! See the UN's Agenda 21; that's EXACTLY the plan!
