  • Mr. President, You're in Contempt

    Anyone who has ever watched Law & Order knows that someone is held in contempt of court when they egregiously disrespect the role of the court and the rule of law. Holding someone in contempt is a powerful sanction in a judge’s arsenal to redress an intentional disregard for the law and the courts.

    So it is no small matter when yesterday Federal District Court Judge Martin Feldman held the Obama Interior Department in contempt of court for dismissively ignoring his ruling to cease the job-killing drilling moratorium imposed by President Obama last year.

    Feldman wrote: “Such dismissive conduct, viewed in tandem with the reimposition of a second blanket and substantively identical moratorium and in light of the national importance of this case, provide this Court with clear and convincing evidence of the government’s contempt of this Court’s preliminary injunction order.”

    President Obama first ordered the halt of offshore drilling in response to the BP oil spill in April 2010. While some reasonable observers concluded that a temporary stoppage was necessary to assess the status of safe drilling operations in the Gulf, nearly nobody has supported the permanent moratorium the Obama administration has since enforced.

    Senator Mary Landrieu (D-LA) publicly testified against the administration’s needless moratorium, and even the president’s hand-picked drilling commission opposed it. Former EPA Chief and Commission Co-Chair William Reilly said: “If there’s a single point of consensus as we’ve been down here, it’s that the moratorium is doing very significant economic damage to this area.”

    In fact, Obama’s moratorium isn’t merely hurting a local economy, but the national economy of the United States. Gas prices are rising, jobs are being lost, service industries are suffering and the government is losing much-needed royalty revenue as a result of this capricious act.

    It was with this evidence of unnecessary economic calamity that the moratorium’s lawfulness was initially challenged in court. In June 2010, Judge Feldman ordered the administration to not enforce the moratorium, saying: “[Defendants] are hereby immediately prohibited from enforcing the Moratorium, entitled ‘Suspension of Outer Continental Shelf (OCS) Drilling of New Deepwater Wells,’ dated May 28, 2010…”

    The Obama administration’s response was to appeal the ruling and issue a second moratorium, nearly identical to the first, with the same outcome of unnecessarily impeding domestic oil drilling.

    As Judge Feldman said in yesterday’s ruling: “The second moratorium disabled precisely the same rigs and deepwater drilling rigs and activities in the Gulf of Mexico as did the first one.”

    The government’s appeal was also unsuccessful, with the 5th U.S. Circuit Court of Appeals rejecting a stay of the lower court’s decision, or as Appeals Court Judge Jerry E. Smith said: “We give deference, as you should, to what that court has done.”

    Since then, Interior Secretary Ken Salazar and President Obama announced they were “lifting” the second moratorium, but then proceeded to not change their behavior, issuing almost no new drilling permits and creating a “de facto” moratorium. While this showed contempt for the American economy and taxpayer, it also showed a serious contempt for the court’s rulings.

    Again, as Judge Feldman noted in his ruling: “The plaintiffs also stress that the government did not simply reimpose a blanket moratorium; rather, each step the government took following the Court’s imposition of a preliminary injunction showcases its defiance: the government failed to seek a remand; it continually reaffirmed its intention and resolve to restore the moratorium; it even notified operators that though a preliminary injunction had issued, they could quickly expect a new moratorium.”

    Defiantly ignoring binding judicial decisions seems to have become a matter of habit for this White House. This past week, after a second court ruled Obamacare unconstitutional in a case binding in at least the 26 states that are parties to the litigation, The Wall Street Journal quoted a senior official as saying that the Obama Administration has no intention of halting implementation of the law.

    As a former law professor, there is simply no excuse for President Obama’s open contempt for directly binding judicial rulings. Judge Feldman, in his original injunction said the Obama Administration “acted arbitrarily and capriciously in issuing the moratorium.” Our economy can’t suffer much more of the president’s arbitrary and capricious behavior, and neither can the courts.

      I agree that the Obama WH is displaying a contempt for the court. It is not rushing to issue more deep water drilling licenses – perhaps out of an excess of conservative instincts. More worrying, even than this behavior, is its concurrent issuance of signing statements – signing bills into law along with a letter that says they don't intent to enforce the law. This follows the path of George W. and is a creepy 1984 style of approach to the law. They are also trampling on individual rights under the Patriot Act.

      When this all is settled and the criminals are dragged to prison, we need to work hard removing the collected power from the federal government. They say we need to get government back to 2008, I say get government back to pre FDR.

      This is the FDR legacy failing in front of our faces and it is dragging the country with it. We do not want a "Republican" form of big government; they cannot do it any better than the Democrats can. We want the federal government to be the least important governing body dedicated to the tasks (as public servants) as agreed upon by the founders. Anything we have seen since the federal government became a crime syndicate, has not benefitted America. Rather, it has indebted us for generations to come.

      Incidentally this crime syndicate is covering 40% of their budget using debt, meaning that in FY11 (starting on October 1, 2010) on May7th, every paycheck a federal employee gets, every entitlement check a recipient gets, every military action, every contractor payout, every PIA advertisement on TV or radio, everything that has to do with the federal government is putting us into debt. This will go on until September 31, 2011 when we will do it all over again!

      What we need to do, for everything that body of self serving goons is doing, is it worth going into debt over? The newly elected republicans were easily folded into the fray. We are no closer to getting this syndicate under control then we were before the election.

      The President, Vice President and all Civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

      actually no, mr. president is not in contempt. he does not have the ability to comply. he sees a future close at hand without oil cars, as many around him cannot, thus in good faith, he cannot lift this moratorium. if you cannot see this, please step into the extinction line, and wait your turn. i'd lose a million jobs to not lose one planet.

      I cannot believe the nativity of people who buy into this garbage of global warming and Co2 in the atmosphere, didn't they take science in school. We need Co2 for trees and foilage, in exchange they put off O2 which we need. Co2 is not POISIN it is expeled everytime YOU exhale. 3rd grade science, you inhale O2 and exhale Co2, trees and foilage put off the O2 after the Co2 goes through them via leaves etc. Global warming made a lot of people rich, thisalso was taught in gradeschool, the world turns on it's axis and as it turns it varies in distance from the sun therefore there are years we have mild winters and very little snow or ice and some are moderate and some very snowy, the earth turning alters every aspect from the heavens. I believe we should not polute and we should conserve, recycle as we need the trees but let's stop making Gore, I found the internet, richer, he already had 2 or 3 houses,all huge a private jet and multiple SUV gas gusslers, they just don't want you to have the same.

      He will hold these permits till he leaves office. This is his way of not allowing any drilling. Those of you that think he is so great, just wait untill you see the results of his stupidy and those around him. Gas, heating oil, electricity, all the things we need and want will soar to the point where we can not afford them. We will suffer greatly. We talk about jobs and the bneed for jobs, what good will a job be if you acn not afford to get there, at $5.00 a gallon, no hope of a newer vehicle, how can you go to work. A tank of gas will take a day's salary before taxes, 4 tires will cost more than a week of work, I forgot they already do. All the climate sillys will be in the same boat, woder what they will cry about then???? We must stop this crap, vote in 2010 and remove the dems and obama, as well as tell the reps who they work for ___US.

      Have you noticed that in winter the electric (coal powered) cars need to be stored and recharged in heated (coal powered)garages so the battery will be able to start the darn thing. And because cold kills batteries you will only be able to cover half the distance the car boasts being able to cover. People would actually freeze to death if they got caught in snow. The battery has to run the heater too. I wouldn't have a coal powered car if I was a millionaire living in Hawaii. Besides they already told us that there is no global warming. It's a bunch of crap. How did the earth get out of the ice age? I believe the warm and cold cylces are natrual and not caused by us.

      I do not expect much to come from this. What I will say is folks who believe it is better to lose a million jobs to "save the planet" are a huge part of the problem in this nation along with the Obama administration. This planet is not going to be around forever. The Almighty GOD who created it has said as much through His Word & The Holy Bible. If GOD didn't want us to utilize the energy resources on this planet they wouldn't be here to start with. Everything GOD creates is good & fallible men do not have the ability to destroy this planet. I don't believe The Almighty GOD who is in control of the universe would give fallible men this ability, which would alter His will tremendously. We need to understand as a nation GOD is in control & there is nothing man can do to change this. President Obama & his administration are in contempt of court & should be held to the same standard as the rest of the citizens of this nation. The "We need to save the planet!" alarmists need to stop listening to money hungry charlatans like Algore & start listening to The Almighty GOD who knows all things & sees all things. This planet is not going anywhere until GOD brings the funal curtain down at His appointed hour. Any other speculation on the part of fallible men is simply foolishness.

      Ladies and gentlemen, Obama wanted to create history with his presidency. On that one item he has been a total success. There is no doubt in my mind that Obama will be remembered in the annals of history as the worst president in the 230+ year history of the United States of America. Time will wash away color bias, and true impacts and accomplishments will become the yardstick by which his presidency will be measured. Hopefully on that count he is not found to be the president that guided this once great country into extinction. The man is unprincipled, unethical, and incompetent to hold the office of president, and unfortunately we will all suffer for it..

      The Democratic Senate would never hold hearings or impeach, but the Republican House can certainly hold hearings and impeach. Clinton was impeached for lying under oath to a federal judge. Obama through his Interior Secretary lied to Judge Feldman when false documents in favor of this moratorium were submitted in federal court. Obama will apparently do whatever it illegally takes to advance his agenda. Will we the people do whatever it legally takes to advance our agenda?

      The President will continue to tell the masses he cares about them while he destroys their livelihoods in his pursuit of utopia. As soon as he turns off the heat in the Whitehouse and puts on a sweater hand-knitted by Michelle, takes cold showers after pickup basketball games, signs bills by the light of a candle, swims to Hawaii for vacation and takes a bike or 100% wind-generated electric car to all of his campaign stops, I'll change my ways. Until then Mr. President, let us pursue happiness as you do.

      I don't hear a word from the Congressional Reps. or senators from Louisiana. I don't hear a word from the governor of the state.

      If I were the governor of the state, I would issue permits to all those waiting to have the illegal moratorium to be lifted by a law-abiding American administration. Let the Obama adminstration send in whatever to enforce the illegal moratorium.

      I think that the judge should have fined Ken Salazar equivalent of 10% of the projected oil revenues from those rigs held up or shut down. If he doesn't pay the fine, he should be arrested using the federal marshalls and imprisoned.

      Just a ruling alone will not help. Just look at how the outlaw regime is ignoring the judge's decision on the health care law.

Perhaps the House Judiciary Committee should begin hearings on the matter. In fact, I think Obama is guilty of many other impeachable offenses. Affordable health care is important but not the way this plan is being imposed on us. The drilling issue is crucial to our economy.       This act of defiance, coupled with the two-year history of ignoring the will of the majority of Americans shows such a contempt that is only worthy of one thing- impeachment! If anyone else were to ignore the will of a court, they would be arrested and jailed. Mr. Obama continues to show a callous disregard for the rule of law and has since he was inaugurated. It is high time that he be impeached. Let it be so!

      His actions declare the idea that he really believes our planet is at risk and he is going to save the Earth by killing oil production by this nation…and then all the other nations are going to have a "come to Obama" moment and follow suit.

      Multiple Ice Ages – there has been evidence found by archaeologists that indicates the Earth has experienced multiple ice ages. Now it doesn't take a whole lot of brain calisthenics to come to the realization that if the cold comes and goes – so does the hot. There. That was easy, wasn't it? You have global cooling on one side of the ice age while on the other, you have global warming. It's a part of a natural cycle of climate. Get over it. Get on with your life. There is nothing you can do to change it. Obama still doesn't get it, though. He will have to be dragged out of power by the ears.

      Who's gonna do it? Talk is so cheap.

      The reason that America has survived so well since its inception is that it's all about the fun of a democracy where everyone is entitled to an opinion and to speak it.

      Let's face it! Dictatorships are anything but fun, and nobody wants one. In fact, civil wars have continuously been fought to escape them.

      Why?

      Dictatorships create prison walls, abeit invisible ones, where people are not free to speak, not free to do, and not free to think. Who needs them? They are all about securing power to manipulate money and its uses. That is not what our system of capitalism is all about, and that's why we continue to believe in democracy.

      Dictatorships, political or financial, are UNAMERICAN, have nothing to do with Mom and Apple Pie, but much to do with illegitimate power and commanding overbearing rooted in overreaching.

      America needs NO dictatorships and all laws we have are constructed to prevent them, ……….or used to be until the lawyers grab them and change them into their own vision of legal power for coercive purposes, rather than defending Constitutional law. But for those lawyers, America would still be free, and still be horrified by dictatorships.
