  • Morning Bell: A False Truce in Obama's War on Business

In fiscal year 2010, the first full fiscal year under the Obama Administration, the federal government issued 43 major new regulations. According to the Administration’s own estimates, the total cost of these rules was $28 billion. Only two of the new rules reduced measured regulatory costs, and then by only $1.5 billion. On net, the Obama Administration inflicted $26.5 billion in new regulatory costs on the economy last year, an all-time record. This was on top of the $1.75 trillion in existing regulatory costs already inflicted on the U.S. economy by the federal government. No wonder the business community, large and small, felt it was under attack.

But now that the President has been “shellacked” at the polls, and unemployment is over 9 percent for a post–World War II record 20th month in a row, the Obama Administration is desperate to convince the public that their war on business is over. Hence President Barack Obama’s Wall Street Journal op-ed yesterday announcing “a government-wide review of the rules already on the books to remove outdated regulations that stifle job creation and make our economy less competitive.” This is a nice sentiment. But even a cursory examination of the President’s actual order shows he is all talk and no action.

First of all, the President’s executive order doesn’t actually require federal agencies to identify harmful regulations during the next 120 days. It merely requires that they submit a “preliminary plan” for reviewing regulations sometime in the future. This is not an order to reduce a single regulation. It is an order to plan to plan to maybe someday reduce regulations! Second, the order exempts “independent” agencies like the Securities and Exchange Commission, the Federal Communications Commission, and the new Consumer Financial Protection Bureau. Finally, even if an existing rule is found that stifles job creation, it will take years to actually repeal it. Kauffman Foundation Vice President Robert Litan tells The New York Times: “It’s more of a talking point than a policy. Even if you find a rule you don’t like, and they probably will, then they’re going to have to go through rule-making and then it’s going to take a year or two or longer.”

There is a very simple way to tell if President Obama is serious about stopping job-killing government regulations: He can stop the torrent of new regulations his Administration is set to start producing this year.

The 2,319-page financial regulation bill requires 243 new formal rule-makings by 11 different federal agencies. The 2,700-page Obamacare bill contains more than 1,000 instances where Congress instructed Health and Human Services (HHS) Secretary Kathleen Sebelius to regulate the health care industry. And, in the ultimate example of power-hungry federal regulators providing “solutions” where no problem currently exists, for the first time in the history of the Internet, the federal government will begin to regulate service providers with “net neutrality” regulations.

The American people are not powerless against President Obama’s expansionist administrative state. The new conservative Congress has a number of weapons at their disposal to slow government’s regulatory rise. Congress can withhold funding from the Environmental Protection Agency for writing global warming regulations. The Congressional Review Act allows Congress to review and overrule regulations issued by government agencies. And today, the House of Representatives will take a big first step in rolling back HHS’s czar-like power over one-sixth of our economy when they vote to repeal Obamacare.

President Obama may be signaling that he plans to slow the federal government’s regulatory explosion, but America’s job creators should not believe him for a second.

This equals obfuscation – the only thing the federal government does well.

However, if the Tea Party Republicans are successfull in reducing federal regulations that save businesses money, Obama just made it easy for him to take credit. This guy is an artist! We need to stay ahead of this.

    3. Doouble Ace says:

This should surprise no one. How do you know when Obama is lying? His lips are moving.

    4. toledofan says:

We can only hope the Republicans will do what they said. The EPA should be dismantled and it should be rebuilt along with the Department of Education, the IRS and several other Departments that have gotten to big for their britches. It seems to me, that, the only way to make any signifigant changes is for Congress to enact an immediate 10-15% cut in all departments and they should hire an outside firm to follow up to make sure it happens. They should cut every budget by the same amount and then start to work on all the waste and fraud in the system. Obama isn't going to try and save a dime because all he and his fellow Democrats know how to do is spend. There are no new ideas, just more pay off and buying votes. How can anyone believe anything that this President says; the actions never match the words.

    5. RUTH WEDGEFIELD SC says:

    6. William Downey, Worc says:

The Obama Administration is a master of sleight of hand and masters of using language to disguise their true intentions.

Examine the recent action by the EPA revoking the permit for Spruce Mine number 1 in West Virginia. This mine operated by Arch Coal, was permitted 4 years ago and with $250 million invested was already in operation. At full capacity the mine would have provided 215 mining jobs and 300 support services jobs.

This is an example of how the administration intends to govern for the remainder of its term. Using the regulatory agencies to bludgeon energy and minerals development into bankruptcy, as promised in the presidents campaign and when the House went Republican.

This is not only a war on business but a war on energy security and employment.

    7. Barb USA says:

Sorry folks but anything this person says now cannot be believed. He has shown us who he is and what he wants to do. If he veers from his previous path it's only because he's looking at 2012. I totally agree with Heritage…DON'T BELIEVE ANYTHING THIS ADMINISTRATION SAYS.

    9. enbeuu, SoCA says:

These illusory "gifts" won't be translated into our economy as the accountants will know this and have costed these out; who do they think they're folling?

    10. Lloyd Scallan (New O says:

Obama latest ploy to "review rules" is another way to find more and creative ways to add regulation to control businesses. How long will it take before people of this nation realize Obama cannot be trusted. He has and will continue to lie and deceive the American people to get his socialist agenda shoved down our throats. Some even in the conservative media are fooled by his false face like O'Reilly. An example, his Arizona speech. Some actually believe he was sincere. The only part of the Arizona speech that was honest was when he claimed that his mere presence at the bedside of Giffords cause her to open her eyes, once again proving he is the great healer and Messiah. This guy cannot be

      trusted!

    11. Joyce Daniel Grants says:

Remind the Newly Elected Represenitives that we the People are Praying for God's Wisdom to guide them.

My observation is that the Democrats ( Pres.Obama) are pretending to moderate in order to fool the Republicans. The "R" always fall for it and soften their stance.

      Watch and Pray!

    12. Bob Godwin, Jarretts says:

So very accurate! He has not intention of letting up. Otherwise it would derail his nanny state objectives.

    14. James - Longdrycreek says:

Idenity the regulations and vote for legislation to repeal the regs. Increase the O and Dem stakes today.

The House will vote to repeal the Obamacare program. The Senate Dems will not consider it. Give them this deal.

Introduce Legislation in the House to make Obamacare be manditory for the Executive and Legislative members, the entire bureaucy [including Dr. Berwick, who has a fabulous health care package from his previous job], the legislative staffs, and the government run motors workers: The UAW GM and Chrysler

      operations state side.

Send that up to the Senate with fanfare and let's see if Harry and the Dems block that. And if Obama puts a veto stamp on the comprehensive covered for all, let him wear the horse collar.

And, of course, close the Office of the Attending Physican in the Capitol, except for citizens [not MC or Senators and the hanger on who are aides].

      One size fits all.

This is a high stakes poker game, and the House has chips to throw on the table and call.

    15. Richard Wakeman, Lin says:

I would like to know who wrote the Health care reform bill. Does anyone know?

    16. Tom Berquist, Pennsy says:

I am glad to see someone understands that Obama is not going to change regulations he has put in place over the past two years. His agenda is to destroy the economy and with the health care trash and financial reform bill he now has the main structure in place to accomplish that task. The nerve center for the financial reform bill is housed in the FED. That means congress can not get at it or defund it. He has sent out the EPA to shut down domestic energy and the FCC to shut down freedom of speech. Wake up folks…this man will govern via fiat, from the white house, with directives and executive orders. I think the correct term is DICTATOR.

    17. Harry Schell says:

This is more weasal-wording from Obama. As if people like Lisa Jackson or Ray LaHood could find anything wrong with any rule they have launched, or that an ideologue like Obama can U-turn on his lifelong history.

Farce, but some are lapping it up.

    18. Harley Spoon, Austin says:

Obama has never been at war with business…In fact, he has been a true friend to business, especially small business. The real enemy of business has been the global corporatists who controlled the Bush administration and oversaw a purposeful redistribution of wealth from the working poor and middle class–the vital consumer base–to the oligarchs, plutarchs and global corporatists. They have crippled the consumer base via fiscal and monetary policies favorable only to the moguls. Those same globalists and that same Bush administration saw fit to do more harm to small, domestic business in the US than all the so-called "liberals" ever have done as they allowed the globalist monopolist forces to run rough-shod over small and developing business in the US. The Chamber of Commerce, the stealth creator of NFIB, has never been a friend of small business in the US. It is as if they and their Republican have never read a word of Adam Smith's WEALTH OF NATIONS. Who actually deregulated trucking, airlines, business and rails? Why Jimmy Carter, of course! Who actually deregulated insurance, communications, banking and energy? Why, Jimmy Carter, not Ronald Reagan, of course! Who actually imposed the federal government's break-up of AT&T? Why, Ronald Reagan, of course! You people really don't know what you are talking about when you throw that malarkey around about Dems being against business….You have made up the lies and believed them…You continue to drink the tea you poisoned! The facts are that the Dems have only been against the global monopolists, not honest, fair trading entrepreneurs. The real enemy of business in the US are the corporate fascists, the rulers of the CofC, the Heritage Foundation and the duped Teapublican Party!!!!!!

    19. Scott Carver says:

just another "This is what needs to be done, but…….we're not the ones who are going to do it. Instead, we'll make a plan so somebody else can do it in the future, if they want to." Obama passing the buck again.

Please, somebody tell me that there's a way to get rid of this idiot before 2012. He's destroying this country, and everything it use to stand for. There has to be a non-violent way of removing him from power.

    20. Dennis Georgia says:

Like most things obama says it is all smoke and mirrows, the republicans had better get a set and stand up to this bunch of socialist. We the American people are fed up, and election is coming again. If needed we need to be prepared to put a new bunch in and make them understand they work for us, not themselves.

In 1992, I pulled from http://www.gov.com, doument "7277" which is the plans for creating the global government. Those who read this document that was written in 1961, will gain insight as to why the bizar actions of our governmer are happening at this time.

We will understand why Obama was allowed to hide all documents as to his birth and other personal records that would qualify him to be our President.

I have copies of the origional documents from the Gov. site.

    22. Gary Hager, Sherwood says:

I believe you are so right. Obama is too busy with the progressive agenda. On reducing regulation, you have already indicated all of the pending regulation required to implement ObamaCare and financial reform. His agencies (EPA, SEC, FCC and others) are also busy writing new regulations without the consent of Congress.

Obama is not to be trusted. I truly believe he is a Marxist in "sheep's clothing".

    23. Leith Wood Richmond says:

What a sad state of affairs our country is in under an unbelievable president. To maintain some serenity and sanity, we have tuned him out. Out in 2012!

Lee – please be more specific. I looked at the site and could not find a document supporting your findings. Thanks

    25. Ben C. Ann Arbor, MI says:

Ah Ken Jarvis – life is so simple. Tax "them" to raise money. It is always "third person" for Democrats. The companies receiving the advertizing dollars pay tax on it. The people generating the advertizing pay income tax etc. So in a nut shell your proposal is to increase the cost of doing business which in turn will add to your and my cost of living. After all, it is the consumer that ultimately bears the burden of taxation. And it is for this reason I have become politically active – "Taxed Enough Already."

    26. Blair Franconia, NH says:

Obama probably had a ghost writer do it and he probably put his name on it. I don't

know. However, there's a saying in Texas: "All hat and no cattle."

    27. Doug Whaley, Lake Ha says:

Obama's war on business is just one part of a much larger problem for the U.S.

China now finds itself in the same position the U.S. was during the 1980s and 90s with regards to the Soviet Union. Only now we are taking the place of the Soviet Union running out of money and the will to correct the situation just as the Soviet Union did back then.

Hillary blusters about human relations, Geitner blusters about their proping up their currency, Gates blusters about their military being not nearly as strong as ours even when they are rolling out the equivilent of our F22. Obama just blusters. In the meantime China runs all over us and is going to do exactly what Reagan did to the Soviet Union only this time it is the U.S. who is on the receiving end.

Remember how in just a few short years the Soviet Union went from being much stronger than us to losing just about every advantage they had over us. It won't take that long for China to gain the upper hand with the U.S. because the present government of the U.S. lacks in understanding what is happening to it more importantly doesn't have the will to do anything about it. The really ironic thing about this is that we are enabling them to do it because we are so weak willed and can't even stop ourselves from spending the country into oblivion thus enabling China to virtually take over without firing a shot.

There will be some in the U.S. that will never accept the fact that militarily we will be weaker than China so China will have to fight a little war with us to prove it just as we had to fight the first gulf war to prove to the Russian generals and other hawks in the government of Russia that they had no chance of attacking anywhere without being badly abused. Think about what happened in the gulf war, the air force first turned Iraq into a smoking mess showing off our superiour air power. Then we blew their tanks to junk because we had a little superiority in our sighting device vs. the Russian tanks the Iraqis used. Then we showed how we could virtually overwhelm then and finally as they limped back from Kuwait we destroyed a large portion of the Republican Guard. I'm sure this was done to make sure the hawks over there got the message not to make a move. This is exactly what China will do as well. It could be in Korea, it could be Taiwan or it might be they just blow our Pacific fleet our of the ocean but you can bet it will be done.

    28. Ken Ferguson, Venita says:

The E.P.A. is an enemy of the State. I do beleive we need a department like the e.p.a. but not controlled by the U.S. Goverment but by State Goverment, I have more control of my State Gov; and very little control of the Federal Gov; Just for fun let's enclude the B.L.M. & Federal Reserve.

    30. ,Jack Cannon says:

Right from the start, Obama's calling card is to make a statement of(put in your own issue,) and then take it away or neutralize it in a later paragragh. A simple and current example: We're going to eliminate rules that are tough on business and then later,…. and we want to make sure its enviromentally friendly. One hand he acts like he's changing and with the other hand, he takes it away.

      .

    31. Hermes c Liberty New says:

Somebody is still talking about this necessity to wake up. Yes and understand that all wars are just against the American People. Obama may act mostly against his own will, hence the contradictions in his sayings. Vigilance and standing, as you guys at Heritage, thanks, is one of the main weapons with which continue to fight back to Repeal Obamacare First, this economical war on businesses second, and all the other wars. Remember one thing: They all have one single common denominator: Big Spending. As if somebody is working hard to eats-up the Bull, have you noticed that America's map is like a beast's hide? Funny? Not so for who meditate about it; he will ensleash tremendous not that well hidden truths.

    32. Jeanne Stotler,Woodb says:

I for one would like to see Congress hire an independent investegator to examine all papers, hospital ones etc, to make sure this man is "Legally" in the oval office. If he is a fraud, like I believe, than ALL actions done by this administration are Null and Void. After this is proven, he could be jailed along with his Chicago Mob and all those intent on overthrowing our goverment, which is what he is doing.

    33. Scott, Taylors, S.C. says:

To "Wakeman'' I sincerely believe that all the ex-lawyers in Congress do exactly what they did in their law practices. They tell their "para-legals" what the goal is and let them research, develope & document the whole legislation. Our beloved representatives are nothing more than high priced orators. That, in my opinion, is why a 2000 page bill can be erected in short order and the Congress can't tell you what the content is. I think its time to regulate these "aides" and force our elected officials to do their jobs. I wonder how many aides were used by our Founders to write the Constitution?

    34. bill greenville sc says:

let me get this right he would like to make it better for companies to employ folks here after he ran out all the oil rigs has the EPA trying to close most refineries and other plants and is working as hard as he can to require all jobs to be union jobs and kill all coal and other fossil mining Yes I think he is on the right track and the country is going to hell on his directions and the senate is not willing to talk about healthcare and the dem congress is upset over the time wasted on a healthcare reform vote I pray I can sell then ice water but I do not think I will be anyplace near the boneheads Obama gobel warming is acoming and you will see it soon

    35. Bruce J. Kolinski says:

Put away food, water and necessities. We have to discuss this mess, but must also realize that the damage already done will require decades for a group of intelligent, dedicated, very serious people to fix. There is no quick fix. The coming pain is going to make The Great Depression look like a party.

Anybody see any "serious" people in Washington D.C.? I sure don't.

Sorry about the negativity, but put food away anyway.

    36. June says:

To Ruth in SC-I think all of US are fully awake now! We won't be fooled any longer by the current criminally, corrupt administration! Don't know about you, but I'm madder than "HEdoubletoothpicks" and absolutely won't take it anymore!

I am continually amazed at anyone who believes Obama has changed his opinion of the free-market system. While he may temper his rhetoric he remains committed to a distribution of wealth philosophy. Keep following life-long politicians (Republican & Democrat) and enjoy your slide into a social welfare system.
