  • Morning Bell: Big Government Strikes Back

    The 111th Congress, the most unpopular Congress in the recorded history of the United States, ended last week with a flurry of legislative activity that set a record for a lame duck Congress. Some in the media are eager to make the case that last week’s events portend a new era of bipartisan accomplishment, led by the White House, that will extend into the 112th Congress. They are half right.

    Last week’s events in Washington were a preview of lawmaking in 2011, but Congress was not where the real action was. While the media was distracted by the last breaths of a defeated leftist majority in Congress, it was the Federal Communications Commission (FCC), the Environmental Protection Agency (EPA), and the Department of Health and Human Services (HHS) that gave true picture of how the Obama Administration will advance their agenda in 2011.

    First on Tuesday, the HHS unveiled new price controls for the health insurance industry. Using new powers granted by Obamacare, HHS Secretary Kathleen Sebelius announced that starting next year, health insurance companies must receive permission from the Obama Administration before they can raise rates by more than 10 percent. The experts at HHS believe these price controls will help decrease rising health care costs. They are wrong. Price controls attack the symptoms of runaway costs, not the cause. As any Econ 101 student can tell you, they will cause only shortages, not better health care. This is only one of thousands of new powers Obamacare granted the HHS. Left unchecked, there are many new health care regulations to come.

    Later on Tuesday, the FCC released its “net neutrality” rules, which will allow the federal government to begin regulating the Internet. This despite opposition from Congress and a contrary federal court ruling. Dissenting FCC commissioner Robert McDowell described the unprecedented power grab last week: “Nothing is broken that needs fixing, however. The Internet has been open and freedom-enhancing since it was spun off from a government research project in the early 1990s. Its nature as a diffuse and dynamic global network of networks defies top-down authority. Ample laws to protect consumers already exist.” And just how competent are the Internet’s new rulers? Just before the FCC decision, visitors to the commission’s Web site couldn’t even access the 1,900 pages of documents pertaining to the net neutrality ruling. The very commission seeking to regulate the Internet saw its Web site go down due to “scheduled maintenance.”

    Then on Thursday the EPA announced that it will begin regulating power plants and oil refineries in an attempt to stop global warming. The new regulations will seek to cut greenhouse gas emissions by making it more expensive to turn fossil fuels into energy. But the Obama Administration did not stop there. Later in the day, Interior Secretary Ken Salazar announced that the Bureau of Land Management was issuing new rules that would make it harder to develop natural resources on government-owned land. Both of these measures will not only drive up the cost of electricity but will also make us more dependent on foreign sources of energy.

    The ability of the Obama Administration to step up their leftist agenda even after it was thoroughly “shellacked” at the polls is not an accident. It is the purposeful design of the Progressive movement, which has been working to undermine the Founders’ vision of our republic for over a century now. Thomas G. West, contributor to The Progressive Revolution in Politics and Political Science, explains:

    The Founders thought that laws should be made by a body of elected officials with roots in local communities. They should not be “experts,” but they should have “most wisdom to discern, and most virtue to pursue, the common good of the society” (Madison). The wisdom in question was the kind on display in The Federalist, which relentlessly dissected the political errors of the previous decade in terms accessible to any person of intelligence and common sense.

    The Progressives did not intend to abolish democracy, to be sure. They wanted the people’s will to be more efficiently translated into government policy. But what democracy meant for the Progressives is that the people would take power out of the hands of locally elected officials and political parties and place it instead into the hands of the central government, which would in turn establish administrative agencies run by neutral experts, scientifically trained, to translate the people’s inchoate will into concrete policies.

    This will be the fight of 2011: the unelected central planning “experts” of the Obama Administration versus the newly elected House of Representatives and state and local governments. The people are not powerless. Congress still has the power of the purse and can withhold funding for implementing Obamacare or writing global warming regulations. There is also the Congressional Review Act, which allows Congress to review and overrule regulations issued by government agencies. State and local governments can also thwart the federal administrative state by asserting their rights whenever possible. We can return power from Washington back to the people. Saying good-bye to the 111th Congress is a great first step.

      We are seeing the results of the Czar appointments. Anything that can not be done through the Constitutional method will be accomplished by departmmental regulations not necessarily approved by Congress. The only thing left to be dicided is whether our new "Conservative" elected Congressmen/women will deny funding. I would like to feel more positive about the answer to that question .

      The past election cycle caused me to put down on paper something that has bothered me for years. Something I’d like to see changed. Perhaps you’ll find something of interest to you and others who may have an interest in the matter.

      My letter [below] is on a subject that NO ONE IS TALKING ABOUT but I’ve been pushing on my own since the last election cycle. I’m using this letter in my personal campaign against the so called “Lame Duck Sessions”. I’ve sent it to all my DC “employees” [Senators & Congressman], local and state political “office holders”. I’ve also been attempting to get copies to as many of the popular talk show hosts and conservative websites that I can reach.

      So far I don’t seem to have sparked the interest of anyone. [Why?]

      A Letter to all Elected Officials: Local, State and Federal

      LAME DUCK SESSIONS? MORE LIKE LAME BRAINED!

      Here is something that has been in my “craw” for a long time – and NOBODY talks about it!!

      I have never understood WHY we as voters have put up with the concept of a “lame duck” politician, legislative body or session.

      There should be no such thing as a “lame duck” session of Congress or any governing Body.

      Why do we put up with a system that gives a group of losing politicians [of EITHER party] the power to ram any legislative agenda, popular or not, though and make it law of the land after losing an election? This is nuts.

      The losing party [or politician] has LOST and should have no more say so over anything.

      THEY NO LONGER REPRESENT THE PEOPLE.

      The following example may be a bit “extreme” but: “What if” those politicians who lost the election get together during a Lame Duck session and declare the past election illegal – pass the law and get it signed? Extreme? Unlikely? Perhaps, but I think you get my point.

      If memory from my Civics Classes at Baton Rouge High School [1952] is accurate; what is now called the “Lame Duck Session” originated during the time of the Constitutional Convention. The purpose of the delay between voting, election winners declared, swearing into office and the opening of the new Congressional Session was to allow the time necessary for communications and travel of that period. Obviously times have changed. Communications and travel have, shall we say, “improved” and I contend that “Lame Duck” sessions are not necessary and under certain circumstances may in fact be very dangerous.

      When an election is OVER the newly elected officials should move in and take over. Let’s have a month “recess” to make the change beginning the day after the elections. If the new official can’t do it in four weeks after running for the office for [insert time], maybe he/she is not ready for the office!

      The losing party [or politician] has LOST and should have no more say so over anything.

      THEY NO LONGER REPRESENT THE PEOPLE.

      Lame Duck? More like LAME BRAIN! The lame duck “SEASON” needs to come to a halt. Will it take some effort from the voters? Of course! The concept is deeply entrenched and simply “accepted” by us – the voters – but we who love our County and vote can change this. Can you support and vote for this change?

      The only things Congress understands is money and power. They obviously don't understand elections, or the people's voices. Well, we, the people, have the money. And we have the power.       Nixon first took us off the gold standard then gave us those wonderfully successful wage and price controls. "Trust me" Carter followed with Obama lite economic policies that gave us hyper inflation with interest rates running amok to the mid 20's while import goods inflated at a rate of 8% per month on big ticket items. At this point only God can save us for there isn't a human alive nor the understanding among our government, nor the will to do what will be necessary to right our ship of state.       The Founding Fathers pledged their lives, fortunes and sacred honor to give to their posterity liberty. The oath of office was put into the Constitution as a way to have honorable representation in government. We have voted in less than honorable people to represent us only to find they represent themselves and have no sacred honor,

      Laws need to be passed on the local level to punish the corrupt officials who violate their oath of office. While we cannot make the judgement that the Founding Fathers wanted the officilas to fear we can bring them to a speedy trial and offer up to the Final Judge those who are corrupt by hanging them.

      In that manner we would weed out the corruptable waiting in the wings for their turn at the spoils of everyone else's labor. That would bring back sacred honor to the halls of Congress.

      The new Congress must be stronger and even more relentless in imposing funding constraints beyond anything they currently imagine.       Obama should drop all pretext and draw his “czars” into a Central Committee. He’s loaded the government with unaccountable controllers that will become even more powerful.

      The best legal remedy is to have our new House of Representatives do what is outlined in this article then all of us must work toward the completion of the job we started in the 2010 election cycle.

      Even if you don’t like the Tea Party you should recognize its strength and use. It is the strongest and most influential groups of citizens willing to oversee the overseers until we get things squared away, kind of like the Minute Men who’ve been called to arms then stand down to remain a background threat to tyranny. Join up and let your voice be heard too. America needs you.

      you might also review the WSJ lead editorial this morning December 27, re. Agricultural Department efforts to regulate science. It seems to me an 'organic' farmer should provide his own buffer zone to protect against the sins of other farmers who use 'roundup ready seed' and raise other geneticly altered crops… rather than impose restrictions on neighboring farmers who have been ensconced in their activities and location for up to many decades. Organic farmers should neither impose upon neighbors 'wind direction' impact upon the purity of their 'organic' crops.

      I trust the US Congress does have the power to reveiw & approve (disapprove?) actions of agencies. Let's hope the new congress will be active in this arena!

      Re: Net Neutrality…Liberals/progressives simply cannot abide by conservative opinion or facts that do not fit with the themes they espouse. The internet allows the common people to talk among themselves and to highlight facts & events that never seem to see the light of day in the main stream media. As a result, the net must be "regulated" and made more "neutral."

      As a foretaste of things to come, Friday's WSJ had this nugget:

      Hungarian Media Law Draws Fire. "…a regulatory panel appointed by Parliament is empowered to monitor newspapers, TV, and other media and to impose fines on journalists and news outlets if they deem coverage to be unbalanced. The law will also tighten government regulation of the internet, requiring all bloggers to register with state authorities."

      I hope you all have read "1984".

      The 111th Congress is finally where it belongs, on the outside looking in. We must keep the heat turned up on our elected Congressmen/women lest they too become enamored with the positions to which they have been elected. I as well, am somewhat tentative with my adulations for the resounding thrashing that we sent to Washington, for we all know that flesh is flesh and some is much weaker than others. Will our newly elected reps cave to the unprecedented pressure that they will surely confront ? Maybe not, if, as I stated earlier "we keep the heat turned up". We must surely take the responsibility of reminding our representatives that we expect truth, honesty and a show of patiotic entegrity from each and every one of them and nothing less. Restoration of our very basic constitutional principals and a clear understanding of those principals is as much a priority as is the repeal of Obamacare, a freeze on discretionary spending, reading and debating a bill prior to passage, no backdoor politics and demanding that a clear review of all the czars be held up to the American voters with any and all legal actions persued against them.

      When the 112th Congress finally funds the Government for the remainder of the Fiscal Year, agencies such as the EPA, the FCC, and the BLM, should have their appropriations reduced to just the amount needed to cover the agency/commission/bureaue chief's salary, and nothing more.       In order to restore the Republic, the incoming Republican majority in Congress must adopt a guerrilla strategy and warfare. Hit the Left in the Administration and in Congress with a series of money wirthdrawal privileges and grill the chairs of FCC and TSA and EPA with hard and demanding questions.       It would be good to familiarize yourselves with Thomas Woods book: Nullification – How to Resist Federal Tyranny in the 21st Century. The people have the ultimate power (as Gingrich reminds us – "there are more of us than there are there of them". But that is meaningless unless the people know something to defend (and that includes many members of Congress that have been educated and dumbed down by the same public school system most of us attended). The States, their legislatures and representatives need to understand nullification for keeping the federal government, including the Supreme Court in check. There are many federal laws currently on the books that many states refuse to enforce such as making medical marijuna illegal or Check ID among others. Quite simply, states are sovereign being independent republics (every states charter has that requirement per the US Constitution) and need to assert the wishes of We The People. No more silly marches on D.C. as they could care less and more amused by the feckless efforts. However, a showdown with one or more states asserting any federal law(s) that unconstitutional and thereby refuse to enforce may effectuate change more quickly and more appropriate than waiting around through several election cycles that is basically proven to be musical chairs.

      Knowledge is power and there is no better substitute for knowing U.S. history, the principals of the U.S. Constitution and what others have done to thwart the expansion of the Federal Government – it is nothing new. Read the book, familiarize yourselves with the Kentucky and Virginia resolutions (Thomas Jefferson and James Madison – 1798) both of which little is known (unless you know history) and scrubbed from history books.

      Net "Neutrality" is just the tip of the iceberg at the FCC (Federal Communications CORPORATION). The internet is the flag they're waving for the general public to see. What most people are NOT seeing right now is a concerted effort to destroy Over-the-Air Television Broadcast aka Local TV Stations.

      After the last unfunded mandate of switching to HDTV – a move which necessitated broadcasters to invest several millions of dollars – each! – in equipment upgrades, to wit, a move from VHF to UHF to "make the VHF spectrum available for auction". Now, five years later; just when stations are starting to regain their monetary balance, FCC comes along and says there isn't enough spectrum for Broadband Internet and "You broadcasters are going to have give a chunk of the frequencies you operate on back to us. Oh, and we need you back on VHF or whats left of it! Not enough spectrum for all of you? Well, maybe you can 'double up' with another station – never mind the logistics…."

      This is obviously another concerted effort to further destroy free communications by pushing out independent broadcasters who may not tow the party line! Think Net Neutrality is bad? The day may well come when you turn on the TV for the morning news and every channel has the same person parroting the headlines from Pravda.

      OK, I understand what is happening: most of our current difficulties are coming from the czars and their rules. Why are these czars allowed at all? In many cases they are making changes and rulings that are diametrically opposed to rulings made by courts or already existing rules. I am dumbfounded.       The power of the newly elected 11 th congress is as yet untested. It will be conjfronhted by the power opf the Presidential veto and by the difficulty of obtaining passagew of bills in a Democratic majority Senate.       You western states: survey and auction off BLM land within your borders. Utah alone could generate billions doing just that since the FED controls 70% of the state.

      Eastern states: Do the same in national forests, sell off logging rights to timber companies.

      I understand the EPA started new regulations on ethynol content in gasoline from 10% to 15% without approval from congress. Maybe we should ask congress to eliminate or reduce these government offices. I don't understand how all those government offices can move actions with out congressional approval, ex HHS FCC etc.. Where are all the watch dogs who could prevent this. I know as long as these offices exist there will always be problems with regulations and people who want to push their views.I may not be the smartest person around, I'm the little guy and I know what I see. We the People and the those that are elected don't watch our back. The constitution does not make provisions for all of these government regulative offices, I wonder why???.       Please print quarterly the voting record of each member of Congress on the major pieces of legislation for that time period and disseminate that information to each member, the news media (newspapers,radio talk shows,etc.,etc). I receive that information through another source and find it invaluable when contacting my senators and the representative of the congressional district where I kive.
