  • Morning Bell: Is the Obama DOJ Committed to Race Neutral Law Enforcement?

    On May 14, 2010, Department of Justice Civil Rights Division Assistant Attorney General Thomas E. Perez testified before the U.S. Commission on Civil Rights about the DOJ’s decision to completely drop charges against the New Black Panther Party and two of its members for alleged voter intimidation in violation of the 1964 Voting Rights Act. Perez was also questioned about the department’s decision to seek only narrow injunctive relief against a third defendant who wielded a billy club at the polls on Election Day 2008. After his prepared remarks, Commissioner Todd Gaziano (who is also the Director of the Center for Legal & Judicial Studies at The Heritage Foundation) asked Perez: “Do you agree that the voting rights laws should always be enforced in a race-neutral manner?” Perez responded: “Yes, sir.”

    Gaziano then asked: “It would be a problem for the Civil Rights Division if any political appointee or supervising attorney expressed the view that the voting rights laws should never be enforced against blacks or other racial minorities?” Perez eventually replied: “That is not our practice. We look at facts and the law.” Finally, Gaziano pursued: “Let me ask my final question. If we uncovered strong evidence that a current supervising attorney or political appointee senior in your Division made statements that this administration will never bring a voting rights case or, to this effect, will never bring a voting rights case against blacks or other minorities, I hope that you will seriously investigate. And I hope you agree that it would be highly relevant to this investigation and that we should have access to the witnesses to such a statement.” Perez assured the Commission under oath: “If you have such a statement, bring such a statement to our attention.”

    The Commission has since twice produced evidence that both supervising appointees and political appointees at the Justice Department have made clear statements that it is the policy of the Obama Justice Department not to enforce our nation’s laws in a race-neutral manner. First, on July 6, former Justice Department attorney Christian Adams confirmed that Deputy Assistant Attorney General Julie Fernandes told DOJ attorneys that under the Obama administration, the DOJ will never bring any cases against blacks or other national minorities under the Voting Rights Act. But the media ignored Adams’ testimony after the Obama administration and their leftists allies attacked him as a President George W. Bush era hire.

    But then last Friday, a second DOJ attorney, former American Civil Liberties Union attorney Christopher Coates, testified before the Commission. He not only confirmed that Fernandes ordered DOJ attorneys only to enforce “traditional types of [voter intimidation] cases that would provide political equality for racial and minority language voters” but also informed DOJ attorneys that it was the policy of the Obama administration not to enforce anti-voter fraud laws since Obama “was not interested in that type of issue, but instead interested in issues that pertained to voter access.” And that is not all. Coates further testified that Loretta King (appointed Acting Assistant Attorney General of the Civil Rights Division by President Obama) specifically instructed him “not to ask any other applicants whether they would be willing to, in effect, race-neutrally enforce the VRA.” Coates explained that King was offended by Coates’ question “because she does not support equal enforcement of the Voting Rights Act.”

    The Obama administration’s reaction to Coates’ testimony was completely unsurprising: they blamed Bush. Justice Department spokeswoman Tracy Schmaler told The Washington Post: “The politicization that occurred in the Civil Rights Division in the previous administration has been well documented by the inspector general, and it was a disgrace to the great history of the division. We have changed that. We have reinvigorated the Civil Rights Division.” Schmaler even had the gall to characterize Coates’ testimony as “thin on facts and evidence and thick on rhetoric,” which is the height of audacity since Coates explained to the Commission, in question after question, that he could not disclose more details on orders from the Obama DOJ.

    If true, Coates’ testimony will destroy public confidence in the legitimacy of the Obama Justice Department. To date, the Justice Department has never challenged the veracity of Coates’ claims about the specific statements made by King and Fernandes, or what everyone understood them to mean. If the testimony is true, both King and Fernandes should resign or be fired. At the very least the Obama DOJ should confirm or deny the statements. So far they have been completely unwilling to do so. However, Glenn Fine, the Justice Department’s inspector general, has begun his own investigation into the issue and both Democrats and Republicans in Congress have also promised inquiries. Sooner or later, the American people will discover the truth.

      It's about time. Mostly it's blacks complaining about discrimiantion when in fact it's people of European descent being discriminated against and minorities, but mostly blacks, benefitting from it. I think that the EEOC should be investigated as well.

They are down at the level of the witch doctor, warlord nations we see festering in the third world. Take back congress this November and clip these idiots wings and vote the survivors out, preferably with a good coat of tar and feathers in 2012.       I do not understand what the problem is, those that obama has appointed to most positions have all been caught with their fingers in the cookie jar.       It should come as no surprise that Eric Holder, appointed Attorney General by President Obama, conducts business in his DOJ in such a shoddy, biased manner.

      This is the same Mr Holder who has called US citizens "cowards", has sued Arizona, a soverign state, over it's immigration law and sided with a foreign nation, Mexico, instead; dismissed the New Black Panther voting intimidation case, even though we have visual documentation of it happening; and his involvement in the notorious President Clinton/ Marc Rich pardon case.

      Of course, no one in this administration will admit to anything that might be the least bit unethical. The only way Americans will be able to get an honest answer to this DOJ scandal is to regain a majority in Congress. The sooner, the better.

      it any wonder that the title of the second volume of his autobiography was called THE

      AUDACITY OF HOPE? Where did Obama get the title of that book? Golly, gee wilikers, wasn't it from a sermon by Jeremiah Wright? Reverend Wright was the pastor of the Trinity United Church of Christ. He preached black liberation theology.

      Where does that come from? Communism. Liberation theology was a problem in Latin America in the 1980s. Pope Benedict XVI denounced liberation theology back

      then. That's why Obama's so angry.

      Ever since Presiden Obama has taken office. The race relations have gotten worse in this country. I thing this is Obama's plan as a way to continue to divide us even more. I no longer trust our government, no matter who's part is incharge.

      I was raised to not see color in a person. Throughout my life I have always supported everyones rights. Today I believe that the Obama and his people are showing white America what it was like being black in this country. It is shameful that black people were treated poorly, now it is being reversed.

      When I was in the Army I served with many great American hero's. Some where white some where black. We all consider ourselves as brothers.

      In an article this week in the Russian newspapers a reporter showed that Obama was a citizen of the United Kingdom, Indonesia and Kenya. How does that make him legally eligble to be presidet?

      Holder, speaking for Obama called the American people "cowards" on race. We see that it is Holder that is a coward. He and Obama set the policy and then they allow others to take the heat generated from their policies. Holder cannot come out and announce their policies. They will wait till after Nov 2nd to announce the NY city trial for KSM – that is cowardice. They pick and chose what laws, written by congress and signed into law by a president, to enforce. And Bush fired a few attorneys with the following uproar and congressional hearings, a couple of years after Hillary fired 98 attorneys. And to Ken; Angle's campaign can read your attitude in your comments and know where you are coming from. And I can tell you where to go, but then my comments surely would be deleted from this dignified forum. .

      This jaundiced view held by the U.S. Dept. of Injustice has little to do with race or discrimination. Again we see minorities being conveniently used as brutal clubs by Progressives to destroy free speech and ultimately our Constitution.

      The DoJ, like much of governance in America today, is still committed to Obama and not to prison sentences even after mutiple abuses of office and legal/political power. Obamacare is the flagship of their destruction but it is their secrete deals and election fraud and manipulation that will bring them down.

      If petitioning this government is made to fail, these people will truly see a transformation to behold and the world will see the strongest message for liberty since WWII..

      And Eric Holder says Americans are too cowardly to have an open discussion about race. When J. Christian Adams testified under oath before the Commission on Civil Rights, to explain why he resigned from the Civil Rights Division of the DOJ, he said it was because of the directive issued by Ms. Julie Fernandes, Asst.Deputy Attorney General at DOJ, advising staff attorneys not to investigate or prosecute claims of blaccccck-on-white voter intimidation. He testified before the Commission that his former direct boss was aware of the directive issued by Ms. Fernandes. When the Commission wanted to subpoena Ms. Fernandes and Mr. Adam's former direct boss at DOJ, such subpoenas had to be approved by the DOJ. Of course the request for subpoenas was denied by DOJ. The DOJ then condemned Mr. Adams as a conservative with a political agenda, seeking to discredit the DOJ.

      Now another DOJ attorney, formerly an ACLU attorney, Mr. Christian Coates, comes forward to testifiy before the Commission on Civil Rights and supports the testimony of Mr. Adams as it relates to Ms. Fernandes directive to staff attorneys at DOJ. He further reveals that Fernandes also informed DOJ attorneys that it was the policy of the Obama administration not to enforce anti-voter fraud laws, as this was not a priority of President Obama. This of course is on the heels of charges of voter registration fraud brought by various states against ACORN, who actively campaigned for Obama. When pressed for details, Mr. Coates testified that he was under orders from Obama's DOJ not to reveal those details.

      Who's the coward that doesn't want to have an open dialogue about race now, Mr. Holder?

      And Mr. Obama, who always has so much to say, why haven't you commented upon Mr. Holder's refusal to approve the Civil Rights Commission's request to subpoena Ms. Fernandes? Why have you allowed Mr. Holder to issue orders limiting Mr. Coates testimony before the Commission? Why haven't you fired Eric Holder? Is it because he is doing exactly what you have told him to do?

      No, we can’t count on this anti-American POTUS or his DOJ for justice!! Of course, if a few tea party members ahd committed this kind of lawless act, they’d have had the book thrown at them, and would probably still be in jail now. Of course, I’d never advocate that they do so. But, if my memory is correct, I think Rush Limbaugh made a suggestion to Clinton voters in 1996. Likewise, we should offer friendly advice to diehard liberal demoncrats – that their date to get to the polls is Wednesday, 11/3/2010!!!!!

      The Department of Justice is the Department of Injustice under this administration. They drop proven voter intimidation against the Black Panthers but sue Arizona for enforcing Federal Law. This is no suprise as the Obama administration has trampled laws, standard procedures and the Constitution at will.

      Obama has filled (and created new positions) with people that think like him and will blindly follow whatever direction he choses. We must get this mad-man out of absolute control of our country! Hopefully voters will at least, create balance in the House and Senate come November.
