  • Obama's Backdoor Amnesty Follows A Pattern of Disrespect for Our Laws

President Barack Obama lets people break laws that he doesn’t like.  The latest example is his backdoor amnesty for thousands of illegal immigrants, as a still-fuzzy but insidious picture is emerging.

Obama shows a pattern of refusing to enforce laws (or refusing to permit states like Arizona to enforce them).  When he dislikes our laws, Obama forces change by dictate rather than seeking legal change through the political process.  Congress gets bypassed.

Those benefiting can claim a new category of legal immunity:  FBO’s–Favored By Obama.

Selective enforcement is being taken to new extremes.  Furor would follow any straightforward official announcement that Obama is forgiving thousands from deportation, so the new amnesty policy is coming to light gradually, memo by memo and place by place.

One new memo from Obama’s Director of Immigration and Customs Enforcement (ICE) declares ICE’s unwillingness to act on local arrests of illegals unless they are accused of serious offenses like felonies or DUI’s; a second memo announces that thousands of pending deportations will be dismissed because the defendants don’t face serious charges–if of course you don’t count immigration violations.

From Houston comes word that immigration lawyers have been “stunned” when they arrive in court only to learn that the government was dismissing their cases, part of a systematic review of thousands of pending deportation cases.  From Miami it’s reported that tens of thousands of cases are involved.  From Dallas we hear that even some with criminal records will have cases dismissed, that “defendants can have one misdemeanor conviction, but it cannot involve a DWI, family violence or a sex crime.”

Excusing an additional misdemeanor, in addition to violations of immigration law, makes a mockery of the legal process.

The Washington Post reports that unionized ICE employees are angry and voted “no confidence” in ICE Director John Morton, adding, “Immigration officers say the new measures limit their enforcement efforts. . . . Current and former ICE attorneys in New York, Houston and other offices say they are angry that they have been instructed to drop efforts to deport some immigrants.”

Obama’s team praises and excuses itself by claiming to deport more people in its first year than ever before.  But numbers can be gamed.  The period they brag about actually is a fiscal year that includes George W. Bush’s final months.  The Center for Investigative Reporting says this year’s deportation numbers are down by about 20% as Obama’s first full fiscal year nears its end.  However, they stress that they are focusing resources on removing illegals who committed additional offenses.  The system indeed is backlogged, but why resort to large-scale dismissal of cases rather than allocating more resources?

The respectable course would be an effort to change laws rather than a refusal to enforce them.  But Obama’s Justice Department, like ICE, has chosen paths of non-enforcement.

The infamous dismissal of voter intimidation charges against Black Panthers led to testimony that claimed the decree came down from an Obama Justice Department appointee, directing that no voting rights cases would be filed against black defendants accused of violating the rights of whites.

Then there was Attorney-General Eric Holder’s announcement that federal law against marijuana would not be fully enforced in states with so-called (and loophole-ridden) medical marijuana laws.  He ignored the Supreme Court ruling (Gonzales v. Raich, 2005) that those state laws were overridden by the federal prohibition.

Whether the issue is immigration, voting rights, drug laws, or anything else, there’s an even greater threat involved in the Administration’s approach.  Our very rule of law is threatened by the Obama edicts of not enforcing laws.  The proper course is to seek change of disliked laws through the political process–and to abide by the results of that process.

Backdoor amnesty is wrong.  And so is slamming the door on our system of laws.

The left's prospects with the upcoming November elections along with Obama's own in 2012 looks very bleak. For this reason Obama and company desperately need the amnesty votes as there aren't enough cemeteries to fill the gap.

    2. Common Sense Police, says:

What a bunch of garbage you've just spewed. Do you honestly think there is any difference between the 2 parties? Republicans and Democrats are the same thing, politicians. The only people who should be placed in a position of power are those who do not want the job, because they are the only ones not trying to use it to their advantage. As far as legalizing marijuana goes, I suppose you think throwing another trillion dollars down the drain might accomplish what the first trillion, and decades of a failed U.S. drug policy couldn't? How about helping unite the people of this corrupt nation rather than playing partisan politics for a change. Do yourself and the rest of us a favor, figure out how to fix things rather than trying to tear the country apart.

    3. West Texan says:

@Common Sense. Your comment does reflect the need to move the political center back to a constitutional one. James Madison essentially said all domestic power belonged exclusively to the individual states. The union has basically been functioning under illegitimate national governance. Legalizing wacky tobacco is a states' matter. Such is up to each state's respective voters. The problem with nationalizing social policy is any failure of same unfairly injures everyone. Much like is occurring with today's uninvited federal overreach. Texas doesn't feel the country's economic pain as bad because it never succumbed to the overinflated housing bubble. Not to mention we've always been individual and business friendly. Message to Obama and company, don't mess with Texas.

Thank You Sir,for an exceedingly accurate accounting of what is happening across America on all aspect of this issue.
It is the only article I have read recently on /breaking all Federal Laws/ on this issue/ that states it clearly.
You may not have a NARCO War of terror your own back yard, but clearly you do understand the /state of our union/ for all Border States .
You have given me hope for the first time becasue of your understanding on this issue/ and also having the true grit to write about it. AZ thanks you as well.

    5. Don granger iowa says:

These are impeachable offenses. When will someone in the Senate have the backbone to file charges. Even if there is no chance of them going anywhere. At least then the media would have to cover this and let the whole country know what's going on.

    6. Teofil says:

He can't do this. As soon as he does our country is broken.

    8. Crystal in South Dak says:

Thank you Heritage for again laying things out in a clear way. I think most of us could point to laws that we do not like and think should be changed. That does not absolve us from the responsibility to follow those laws until they have been changed by the legislative process. Being in government-even the White House-makes the responsiblity even greater yet these are the very people who are ignoring the very laws that they have enacted for the rest of us to follow. As more and more of this information is coming out those people are seeing their power going away as November approaches. I wonder how many of those who have bragged about putting this group in office have begun to regret that action.

Sounds like dereliction of duty to me, at minimum. If he is aiding and abetting our enemies, we all know what that sounds like.

    11. J.C. Lewis, Muskogee says:

This sounds like one incident I had in counseling teenagers when I practiced "selective ignoring" of nicotine use at a non-approved time of day. I could have lost my job for non-enforcement of rules. What is the difference here re: illegal immigrants. Seems like the Justice Dept. should be fired.

    12. Keith. TX says:

I remember a movie (cannot remember the title) where a lottery is held and who ever is selected becomes president. Is this what the the person from PA wants? Granted, all too often, the people vying for the job are in it for the power that goes with it. One man i spoke with asked why any one would want to be president with all of the headaches and problems while the pay was not that great. Plain and simply, it is narcissism. They want to be the most powerful person in the room. But I don't think it is just narcissism that made Obama want to be the president. He has a very radical agenda with his plan to turn this country into a socialist utopia. He grew up listening to socialist propaganda and surrounded himself with those with the same ideas. Of course, all socialist societies end up failing but the new socialists convince themselves that it just was not done right the last 10, 20, or however many times because they have the right formula. The problem as I see it is that our representatives have stopped representing the the American people and only want to pad their pockets. It used to be that the people in Congress were there to serve for a short time and then get back to their private lives. They become enamored with the power, prestige, and visibility. The only way they could otherwise get this kind of attention is if they were actors or singers. Sadly, most have no talent and no one would want to watch them. Obamas policy of not exporting these who have come here illegally simply gives the Liberals a larger voter base. If though they are illegal, they will find some way to vote I am sure (think of ACORN).

    13. Pennypacker says:

Neo-Conservatives–or better put faux-conservatives–should love these types of immigration policies. GWB did the same. Oh! He may said one thing, but he and his administration did very much the same thing as Obama is acused of doing in this article. Wake up!!! You partisan people can't see the forest for the trees. You conveniently ignore the fact that several decades of fed gov leadership–regardless of party affiliation–have been derelict in their constitutional duty to protect and secure U.S. borders. Beyond that, it is the responsibility of individual states to discourage illegal residency within the constraints of the U.S. Constitution. Many states have accomplished this very goal to the extent that is possible–hmmm, if only our borders were secure. I do not particularly want to see a police force large enough deport 20 million illegals. Aside from the blinding monetary costs of supporting such a police state expansion, the costs to the freedom and liberty of legal U.S. citizens would be insurmountable.

Are you a conservative, or do ya just puke the company line? I am a real–REAL–conservative, and I support any fed gov leader that suggests fed gov step out of states business. The so-called "War on Drugs" is nothing but a police state extension, and a massive failure. As another poster stated, over a trillion dollars have been spent on it since the 70s and all it has accomplished is to militarize our society and increase violent crime and drug use–same as alcohol prohibition did. Why are we not up in arms over this massive failure of federal government??? Come on so-called conservatives, you claim to hate failed fed gov programs that squeeze all of us fiscally, well this is one right here. It is a bottomless pit of failure.

Racially motivated voter intimidation? This shouldn't be left to a white house appointee to decide. If there was indeed a dictate by a Justice Dept apointee, public outrage should be taken to your representatives in Congress and the Senate for an inquiry, and followed up by concerned citizens–voters still have some currency left at election time. The White House isn't supposed to rule this country alone. The checks and balance system works very well if utilized properly.

    14. Allan Cincinnati, OH says:

There is a difference between liberal, statists, and Conservatives. The Problem is there is no difference between the leaderships of the 2 parties. The Democrats have no guts, they just give away the taxpayers money and undermine our rights. The Republican leadership stands by, wrings their hands and begs us for money so they can try to stop the march to socialism. The UN has more in common with the Democrats. They both are impotent when stood up to.

    15. N. Paulsen, DE. says:

I knew this was coming. He reads like a book. He is about as qualified to be President as my dog. What a sorry time for America.

    17. Billie says:

The "left"IS THE democrat party and some rinos, who believe in less of some people just for votes, Government pretends to help by exploiting the crime wanting sympathy to the crime, while government left provokes the weakness illegals would overcome by nature had laws and expectations been enforced.

How dangerously disingenuous government leadership can be to the innocent lives they lead. Isn't it illegal to put a human life in harm's way? This is a man putting a country of peoples lives in harms way. In more ways than this.

As peanut butter is taken away from public children's lunches due to one child's allergy, constitutes no amnesty for illegals, as one persons choice to cross the border illegally is another one's choice to murder. All are deadly and ALL can be prevented

So this is for you and all the RACIST mofos.

You swine. You vulgar little maggot. You worthless bag of filth. You couldn't pour water out of a boot with instructions printed on the heel.

You are putrescent mess, a walking vomit. You are a spineless little

worm deserving nothing but the profoundest contempt. You are a jerk, a

cad, and a weasel. I take that back; you are a festering pustule on a

a revulsion, a big suck on a sour lemon.

I will never get over the embarrassment of belonging to the same

the very thought of you. You have all the appeal of a paper cut.

Lepers avoid you. You are vile, worthless, less than nothing. You are

a weed, a fungus, the dregs of this earth.

And did I mention that you smell?

You are a squeaking rat, a mistake of nature. You were not born. You were hatched into an unwilling world

that rejects the likes of you. You didn't crawl out of a normal egg,

i am just so sick of this imposter, we need to remove him from his position as soon as possible. no#1 law he broke was having the audacity to run for office when he shouldn't even have been here, he is an illegal.

    20. Ginger, USA says:

Fascists believe that ideas of right and wrong are not for them. Athey do what is necessary to get their job done. To the facets, ghe only guiding principle, is do whatever is necessary…no exceptions…no limits…there is no line a fascist will not cross. He is a chameleon, adopting whatever prescription works for his interests. He can appear Socialist, conservative, Liberal, or whathaveyou if he believes the conditions have. Hanged and a new prescription is necessary. He will switch without hesitation. Unfortunately, this is not an era when a man's word is his bond…it is a time of lying through one's teeth to get the most stuff and the most power…both sides of the isle are fascist to one degree or another…Mr. Obama is either quite blatant in disregarding the law or ignorant…I have to sY as a puppet dictator he is a mixture of arrogant and ignorant. Dangerous for all citizens, yes?

    21. Deb, Chicago, IL says:

Can we sue the Fed's and ICE for purposefully not enforcing our immigration laws and letting criminals walk free, especially when they are standing right in front of the judge, who knows this person is a criminal? Its so frustating to see illegals caught, brought before a judge and then just let go. There has to be a way to force this admin to enforce the laws. !! This is just totally disgusting

    22. Mack531 says:

Yeah– but look what is being said between the lines! Does the Obama Administration really think that by granting "amnesty" to these illegal immigrants, they suddenly become full fledged, voting U.S. citizens in less than 70 days before the November elections? That's a fraud on the face of it!

Gives you some insight into how their playbook is written.

Everyone who takes an objective look at this situation can say (if they're honest with themselves) that lax enforcement of our borders is a bi-partisan problem. Why? Because the government is like any other beast in nature. It likes to eat; and in this case, the food is new taxpayers! And the fact is, most Hispanics coming here legally or illegally are Catholic and conservative. Yeah, they may give the Dems a "gratitude vote" like they did Reagan back in the 80's during the last amnesty program, but sooner or later, they vote their true nature.

Obama could be shooting himself and the Democrats in the foot on this. Shake hands with the Law of Unintended Consequences, Barack! You'll be well acquainted with it by the end of the first week in November!

    23. Billie says:

True Christians and conservatives are law abiding and especially not infringing and government is the LAST PLACE THEY WOULD GO FOR HELP! Illegals are not living Christian like or conservatively. When they do go to vote, it is a hope they will come to realize how ugly the American government, democrat majority, has made them out to look.
