  • Unlike Obama Administration, Virginia Will Enforce Immigration Laws

    Virginia Attorney General Ken Cuccinelli is having quite a day. As Todd Gaziano explains, a federal district court denied the U.S. Justice Department’s request that the court dismiss the lawsuit Cuccinelli filed on behalf of the citizens of Virginia against the unconstitutional mandates in Obamacare.

    News also broke today that Cuccinelli issued an official advisory opinion on July 30 that was another shot across the bow of the Obama Administration in the ongoing fight over enforcement of federal immigration laws.

    In response to an inquiry from a state representative, Cuccinelli advised all Virginia law enforcement officers that, just like Arizona police officers, they can “inquire into the immigration status of persons stopped or arrested.” Moreover, local officers can arrest any individual who has “violated a criminal law of the United States, including a criminal violation of the immigration laws.”

    Unlike the specious “legal” opinion issued by Judge Susan Bolton in the Arizona immigration case, Cuccinelli’s opinion is fully in accord with federal immigration law and prior court decisions that have held that local police officers can inquire into the immigration status of individuals they lawfully detain or arrest. On the ability to arrest those who have criminally violated federal immigration laws, Cuccinelli very pointedly explains that “it would be most surprising if state and local officers lacked the authority…to arrest individuals suspected of committing federal crimes.” If they did, then local law enforcement would have “to stand idly by and allow” bank robbers, kidnappers, or terrorists who have violated federal law “to proceed with impunity.” Why should criminal violators of federal immigration laws be somehow different? That is, of course, a ridiculous claim, although it has not prevented pro-illegal aliens groups and their spokesmen from criticizing Cuccinelli’s opinion.

    In the heart of the opinion, Cuccinelli makes it very clear that Virginia police “have the same authority to make the same inquiries as those contemplated by the new Arizona law. So long as the officers have the requisite level of suspicion to believe that a violation of the law has occurred, the officers may detain and briefly question a person they suspect has committed a federal crime.” The real problem, of course, will be if the federal government then refuses to pick up and deport illegal aliens who have been found by local police—an unfortunate problem that illustrates the importance of having someone in the White House who understands the President’s constitutional obligation to “take Care that the Laws be faithfully executed.”

    We should never forget that this issue has real consequences: two teenagers in Virginia Beach were killed in 2007 by a drunken illegal alien who rammed their car at a stoplight. He had been previously arrested and convicted for public drunkenness and DUI—if local police had checked his immigration status after those prior arrests and the federal government had picked him up and deported him back to Mexico, those two girls would likely be alive today.

    Hopefully, not only will local police officers in Virginia use the authority that Attorney General Cuccinelli has given them, but other state attorneys general will follow his lead and issue similar opinions. The Justice Department and the Obama Administration need to be confronted by states contesting their ill-advised and dangerous policy of not fully enforcing our immigration laws.

      Thank God for the courage and strength of authority to do the right thing in the name of protecting law abiding citizens.

      The Obama administration makes sure illegal immigrants are employed while getting American tax paid handouts to provide for their basic necessities on top of it, while the American youth go on rampages of violence and thievery.due to the lack of jobs available to them. hmm.       Our government knows everything about the AMERICAN CITIZEN, THE ONES THAT PAY THE GOVERNMENT SALAIRES. THE GOVERNMENT knows where we live, how much we make, what kind of car we drive, how many children we have or don't have. YOU name it, our government knows everything about their citizens.

      Our government does not have a clue how many illegals are in AMERICA, or where they have come from. Our government does not care . When did obamba's aunt come to AMERICA? Now we the tax payers will keep her up for the rest of her life.

      I am PROUD of this Commonwealth, we stand up for our people. Fed. law says if you are here legally you MUST have your ID (green card) on you at ALL TIMES. Judge Bolton was wrong on that ruling. Yesterday's paper informed of an accident in this county, 1 Nun dead, 2 in critical condition, WHY?? The driver of the other car was an illegal, here since 2006 or earlier, multiple DUI convictions, on ICE list to be deported, no lic.. This time he was double the limit for DUI, and crossed over and hit the Sisters head on, What more do we need?? This was the second one in the paper, another in another state. ICE needs to DO THEIR JOB, let police do theirs and work together. ILLEGAL, means you don't belong here.

      One does not have to look back to 2007 in Virginia to find an example of illegal immigration policy not enforced with severe consequences. Today's Washington Post offers this story from Virginia on Sunday, August 1.

I'm talking about "the "clothed" lapel pins of the state flag he handed out to his staff. Oh nooooo, look a picture of a breast. The horror. This decision by Cuccinelli, the lawsuit of the greenhouse gas curbs and the health care bill will be met with defeat, just like the Arizona law be met with the same. Cuccinelli and McDonnell can continue their backwards ways, for all I care. They will ensure that the next administration in this state will not be a republican one.

      Congratulations to General Ken Cuccinelli! He should have Eric Holder's job! How sad it is to learn that two girls lives could have been saved had someone done their homework and deported this illegal back to Mexico. Consider the state trooper who pulled over Timothy McVeigh for speeding after his destruction to the federal building…by Eric Holder's standards he couldn't have been detained for that charge.

      i came from canada in 1952 when i was 12 yrs old and i was told to carry my green card at all times and had to register with imigration every year people from all countries are supposed to do this .the democrats think if they give the mexicans amnesty they will vote for them.there are 330 million americans and only 20 million illegals that wont vote for anybody after they get what they want.so it becomes obvius the democrats arent even good at math..330 mad americans are more likely to vote than 20 million illegals who got what they want.

      That "controversial" bill that AZ passed has the same language that the Federal code has about borders and citizenship.

      By Obama directing the Fed to sue the state of AZ, he is basically siding with Mexico, and the drug cartels and the illegal's…..

      For the first time in known US history, we have a president and his Admin. who have taken the side of another country and government (i.e. Mexico)
