  • Morning Bell: This Process is Undermining the Rule of Law

This week, NBC News and The Wall Street Journal released poll results that are disturbing but by no means surprising. The March 11th – 14th poll of 1000 American adults showed that only 17% of respondents approve of the job Congress is doing in Washington. And as bad as that number is, the reason why Congress’ approval rating is so low is even more disturbing: a full 76% of Americans simply do not trust the U.S. Congress. This was the lowest level of trust for any representative entity tested by NBC/WSJ.

It is no coincidence that these record low ratings come amid current debate over health care in Congress. Yesterday, former U.S. Attorneys General Edwin Meese III and William P. Barr released the following statement:

The convoluted and questionable method under discussion by both Houses of Congress for final passage of the long-debated health care legislation raises serious constitutional concerns, which, at best, will lead to protracted and wholly avoidable litigation and continued doubt about the bill’s validity. Members of Congress from both parties have criticized the use of such sleights of hand, and The Washington Post has rightly editorialized against such “unseemly” and “dodgy” maneuvers for the health care bill. Beyond the obvious practical concerns shared by all citizens, the use of such obscure “rules” for final passage is even harder to justify in light of the real constitutional doubt and the erosion of public confidence in government that it will cause.

Contrary to what President Obama and some congressional leaders have been repeating of late, the American people do care passionately that the process for consideration of health care reform be both constitutional and fair. At a bare minimum, article I, sec. 7, cl. 2 of the U.S. Constitution requires that before it becomes law “(1) a bill containing its exact text was approved by a majority of the Members of the House of Representatives; (2) the Senate approved precisely the same text; and (3) that text was signed into law by the President.” Clinton v. City of New York, 524 U.S. 417, 448 (1998).

The “deem and pass” and similar options under consideration in the House of Representatives plainly violate at least the spirit of the Constitution’s bicameralism and presentment requirements. Those constitutional requirements were intended to ensure democratic transparency with a straightforward up-or-down vote in each House on all bills that become law. More importantly, these requirements were designed to ensure that the new national government actually followed “the consent of the governed,” which the Declaration of Independence had declared to the world was the only basis of legitimate government.

The “deem and pass” options under consideration in the House and the subsequent use of a “reconciliation” process that is reserved for budget issues in acts already signed into law further erode confidence in the rule of law. Some past uses of the “deem and pass” or “self-executing” rules raise similar concerns, but none was as convoluted as the proposed use, and significantly, there may have been no one with legal standing to challenge prior uses in court. Many individuals will have standing to challenge any health reform legislation that restructures one-sixth of the American economy, and the contemplated use of the “deem and pass” maneuver in this instance may be combined with questionable procedural steps in the Senate that render it much more subject to challenge.

There is no need to engage in such procedural machinations, and no asserted reason for doing so exists other than to avoid the traditional legislative safeguards in the Senate and to obscure the appearance that Members of the House actually voted for the Senate bill, which is a prerequisite for genuine reconciliation. The constitutional requirement of bicameralism should not be jettisoned under any circumstances—and certainly not for such trivial and partisan reasons.

Members of Congress take an oath to uphold the Constitution. Members should violate neither the letter nor spirit of the Constitution, especially when there is so much at stake, not only as a policy matter, but when the very legitimacy of the legislative process is in question. Given that many parts of the underlying legislation itself raise substantial constitutional concerns, these “unseemly” and “dodgy” procedures underscore the justified concern the American people have that their elected representatives are blatantly disregarding the Constitution, and as a result, undermining the rule of law.

    1. J.C. Hughes, Texas says:

There's another big constitutional issue at stake here. Where in the constitution does it give federal government power over ordinary domestic affairs? Sounds like a total violation of the 10th Amendment. I sent an e-mail message yesterday evening to my democrat representative in the 23rd congressional district basically saying the same. My final message to him " .. stop this legislative travesty from reaching the president's desk." This is definitely one for the U.S. Supreme Court if it goes through.

    2. Charles, The Republi says:

It's a slow coup d'tat. Rush, Sean, Levin & others had been trying to warn the public before the election. How's that Hope & Change working? Ready for amnesty for illegals? Had enough of affirmative action, political correctness, tolerance & diversity? Has it set in, that obama, pelosi & reid don't care what you think? And they don't care about The Constitution. I can almost hear michelle obama proclaim, "Let them eat cake!"

    3. Jules Schwager PhD says:

This is lawyer talk and makes things more complicated then they are. Just go and read the Constitution, it is very simple and made so that everyone can understand it.

    4. Randa Perry, Tenness says:

We are gearing up for the Constitutional Crisis that Obamacare will fulminate. Great work Obama .. you rookie.

    5. J.C. Hughes, Texas says:

PS: Obama was quoted as saying HCR is the biggest DOMESTIC issue of our time facing federal government. And he's a noted Harvard "magna cum laude" trained attorney? Doesn't say much for that institution's lesson on America's federalist design. Either that or Obama completely skipped that course.

    6. John Ottley, Jr. Atl says:

How does this differ significantly from the way Hugo Chavez is running (ruining?) Venezuela?

    7. James Campbell Richm says:

Please provide a lnk to the full text of Messrs Meese & Barr's statement. Thank you

    8. John, Rhode Island says:

We all know the Constitution is violated every day. The existence of nearly all federal programs is testament to the fact that Congress has long since stopped caring about what the Constitution says.

Is voting these fools out of office the only recourse we as citizens have against such tyranny? By the time election season rolls around, the damage by these laws and such is already done and is more difficult to repeal later.

    9. James A, Canyon,TX says:

Shadows lengthen on our form of government. The Republic is dead if this deal passes. With all the fences down on law and order, the rogue animal in D.C. will plunder the land, eat the grass, drink the water, and grow fat.

What is needed is a new deal, not FDR's New Deal, but a total removal of many, many layers of government: Abolish Education, Energy,Commerce, Health and Human Services [in its present form], and return us to the simple days of The Republic.

Some leader will arise who will claim that prize for the Nation. I do not know his or her name but I know someone will rise.

"Demon Pass" stinks on ice, but is just the latest and most obvious trickery employed by this current crop of congresscreeps, whose motto seems to be, "Damn the people, full steam ahead, down the drain."

    11. Pam Heidenga says:

If this bill passes, I'm going to deem my taxes are paid. I think that you should make people more aware of what DEEM means.

    12. Richie Naples says:

The truth of the matter is the congress has been doing what they want for

years. The American public is just learning because they took everything

for granted as long as they were working and had food on the table. Now

that they realize that the government has caused us most of our troubles

and they are not working and food is not on the table. In most countries there would be rioting in the streets thank god we are above that so far.To

have a president that was elected by the word change without having the

media telling the truth about him and the media still not telling the truth.Thank god for the internet I have been talking to people for years about the government but they felt they couldn't do anything due to the

internet they do not feel alone. The government would be still be doing

what they want which they still do with all the earmarks etc but at least the

people and sites like yours informs.; Thank you.

    13. loves Dogs/Colorado says:

As long as we have nothing but CROOKS in Washington DC this country will keep going to hell in a handbag.
All politician that represent all states should only be allowed to be in Washington only when it's necessary—a few times a year. Otherwise they need their rears in THEIR states and with the people THEY represent so they actually KNOW what their people actually want and need. Each state should get what they need to run the state and NOTHING MORE. NO MORE GOODIES FOR ANYONE IN THE STATE OTHER THAN ALL THE PEOPLE OF THAT STATE.
LOBBIEST —- GONE unless they are truly needed. NOT TO BE IN SOME IDIOT POLITICIANS POCKET…..
I'm 65 and that's how I grew up. Same for my parents and grandparents and all family members that weren't involved in politics…..SAD SAD We've all been lied to for sooooooooooooooooooo many years. Without people like you–HERITAGE—–we would have remained dumb….

    14. Joy Cochran says:

I believe that Obama has made enough stupid mistakes in one year than anyone has ever made. Thia health care bill will be the biggest, the most asnine mistake he could made yet, besides ruining the America Constitution.

He will never get voted back in for another term because the people who was stupid enough to vote for him has already wished they hadn't. So he is on his way out. He didn't know enough about America to be her President so he made stupid mistakes. Apoligizing for America???!!!!!!! You just do not apoligize for America, because America is the ONLY country that has gone to almost every country and helped them when they needed help.

That alone shows proof that Obama IS NOT an American. He can't be because he knows nothing about America. He is a fool standing there going Duh????

Nancy will be out too, she is so stupid, she thinks that Obama will be President forever and she will have a side chair with him. She doesn't seem to be American either, so I wonder where she hailed from. Her, Obama and Harry Reid is going to be in for a great surprise, We are getting the Demcrats out of there, this year, we are voting for Obama's "change" we are going for change in the Senate, even the Republicans who voted with Obama on this Health Care bill will be out. We are going fight for America. We are going to go for "change" and see that it does change, we are not going to promise change like Obama did then ruin America like he did.

    15. Mike, FL says:

If this is so wrong why don't the major news organizations (TV, newspapers, magazines, etc.) rerport this?

    16. Betty, Fort Worth, T says:

I would like to know what our recourse is in getting the legal authority to file lawsuits and impeachment proceedings against all of these traitors. Who is Our representation in keeping the Constitution? Surely, someone in Government has that authority. I thought the Supreme Court would rule if someone filed an objection. Please start explaining what the legal procedures are to rid ourselves of this vermin in Congress and the 3 Stooges, Biden, Pilosi, Reid, and of course, His highness the Muslim, unpatriotic Prez.

    17. KC - New Mexico says:

May be it is time for the tea party and the majority of Americans who are in the middle between ultra conservative or liberal views stand up for the US Constitution and our laws. It is time to recall those who supposedly represent us but really on represent their party philosophy and big dollar funding such as the unions and other major dollar contributors to their pockets.

Yes – we need health care change, yes – we need jobs for Americans, yes – we need businesses who believe in their workers and keep jobs in this country, yes – we need to pay taxes in a fair and equal manner, and yes – we need members in government who listen to their constituents. The President promised change that has not happened but yes – we need change that significantly helps Americans and this country become leaders in our global environment.

Here is FOXNEWS – POLL Question for the day.

Health Care on Track for a Vote: Will It Pass?

Yes — Obama and Pelosi are doing whatever it takes to make this law.

No — In the words of Tip O'Neill: 'All politics is local' — and us 'locals' are ready to toss the 'yes' voters.

Not sure — Either way the system needs reform.

I don't care — We no longer have a say in what our 'representatives' do.

      FNEWS is Bias.

    19. Larry Peterson, Pine says:

RE: Thomas Jefferson—"In questions of power, then, let no more be heard of confidence in man, but bind him down from mischief by the chains of the Constitution" So, what does the party in power want to do? Pass a law without a "yay or nay" vote and say the hell with the Constitution. The Machiavellian philosophy of the "end justifies the means" is in full bloom and spits in the very face of this magnificent document. Our own president says it is "a bill of negative rights". SELF-SERVING EGO has seemingly taken over in Washington. It is so sad. I wish Novemebr was this afternoon.

    20. John Ft Worth Texas says:

Obama, Pelosi & Reid need to be removed from office!!

    21. NeoConVet says:

This single minded determination by the Left to pass this abortion of a health care legislation is EVIL. What else can it be to any rational thinking person, knowing the real numbers, lies and failures of this boondoggle?

    22. LINDA JOHNSTON - NOR says:

    23. Linda Wa State says:

Looked up what 'deem' means. I just means think, so nancy would like to 'think' the health care bill is passed. I think I hope not.

    24. Beverly Barnum, San says:

I call, I write, I post on blogs. As a private, but concerned citizen I do all that I can. I read about six hours a day and all my friends call me for updates on news of the day, for I read Internet liberal, conservative and even foreign press and magazines. This nation's feedback is mostly against Obamacare and further growth of government and debt. We are in for a heart transplant as a nation: replacing a heart of "can-do-anything" and accountability for our own destiny to one of radical socialism/nanny state mentality and for that we are all doomed. Former socialist nations are retreating from that particular failure, yet this country is being dragged kicking and screaming toward that failed direction by a man-child president with absolutely no common sense.

    25. MJ Gatti, Bonita Spr says:

Obviously, the will of the people is to scrap this 2700 page Health Care government takeover.

    27. Greg F., Prescott, A says:

Repeal language should be being drafted right now. When the "Cloward and Piven" (sp?) groups are voted out, this bill can follow them out the door in an expedient

time, like the very same day.

The muscle of states rights are being flexed while Federal powers are being lost by the second because of an arrogant disconnect from the people. It is all as it should be, and it was only a matter of time until the authority "of" Congress becomes the authority "from" the people once again.

    28. Lloyd Scallan - New says:

"Rule of Law, Oaths to support the Constitution, Spirit of the Constitution"! Do you think these people have any regards for those principals? Obama and the Dems are Socialist, Marxist, and Communist. "Chuck-you Schumer was recently recorded when he stated his intention to circumvent the Constitution.

Obama has complained the Constitution is "restrictive". Those in the Obama

administration are advocating doing away with the Bill of Rights. What makes anyone think these people will adhere to these principals when a vote on a bill that will change our American way of life is in the balance?

    29. s, says:

    30. Rick says:

      A question:

How can Student Loans be "rolled into" the Reconciliation Bill that adjusts the Health Care Reform "Law" by tweaking budget items only?

Doesn't Government-provided student loans increase the overall cost of this "Law"?

If this is allowed to pass muster, why don't Democrats "roll in" cap-and-trade" legislation and a new border security section as well?

I do not remember this in my High School Civics class.

Oh, that's right. We don't teach Civics anymore.

    31. Billy Wilks, Moss Po says:

Is it not within the confines of legality to assume that any congressman that votes yes can later be tried as a traitor when sane people regain control of our country.

    32. Jeff Witt, Cincinnat says:

Can the American people sue our representatives for failure to keep their oath of office?

A class action suite should get someone's attention.

We surround them..there is more of us than them!

    33. Mary.... WI says:

Great example Congress and Obama are demonstrating not only for the youth of this country but other nations across the world that it's OK to lie, cheat and "throw your weight around" in order to get your way. Congress and Obama are an embarassment to this country. They do not represent the majority of the people of the USA. They should all be impeached…… maybe some of them should be tried for treason for selling out this country.

    34. okiejim says:

Health Care is not the biggest crisis this country faces. The greatest threat to this country is the precepts of radical Islam and their Shariah Law. They have only one goal and that is to make everyone in the world a Muslim.

Frank J. Gaffney, Jr. explains the threat very succinctly in the April issue of The American Legion Magazine. An Islamic Brotherhood document titled the "Rulers" describes how the organization will try to overthrow the Constitution in five phases.

"Phase 1: Discreet and secret establishment of elite leadership."

"Phase 2: Gradual appearance on the public scene, and exercising and utilizing various public activities."

"Phase 3.: Escalation, prior to conflict and confrontation with rulers, through the mass media.

Phase 4: Open public confrontation with the government through the exercise of political pressure".

"Phase 5: Seizing power to establish an Islamic nation, under which all parties and Islamic groups will become united."

Mr. Gaffney continues by explaining that " The Muslim Brothers know that by masking their ideological agenda as a religious program, they can use Western civil liberties and tolerance as weapons in their stealthy Jihad…" They intend to let us destroy ourselves with the PC mindset that is pervasive in Washington

Our politically correct politicians are afraid to speak out against this Islamic threat, and the current administration wants to give terrorists the full protections of our Constitution. The extremists know they can use this weakness against us to defeat the " infidels:, and that is what is happening now because of our weak Congress and the leftist mindset of the Administration.

I'm not sure we can wait until November to save our country.

    35. JD, real world says:

We have lost our country if this monstrosity passes. The same loathesome, underhanded, American people be damned techniques here will be used to pass every other piece of destructive legislation these people covet. And there are many.

Obama has already said on record he won't rule out using the "Deem and Pass" approach on immigration reform which is next on his list.

Why even bother pretending anymore that we're a representative democracy? We have become a banana republic where a handful of liberal extremists are giving the finger to the people and to our laws and our Constitution.

    36. Annie Halland Bridge says:

Altho things are looking grim with this current healthcare legislation, please don't forget that "The prayers of a righteous man availeth much". Might we do a little confession and repentance for our nation and ourselves? Seems like my prayer life never really kicks in until things are the bleakest – and NOW IS THE TIME, for sure!

    37. Richard Cancemi, Arl says:

So-called Progressives (Socialists) have long viewed the Constitution with contempt.

America's affluence and highest standard of living have caused its citizens ,over the years, to be complacent while the termite-like efforts of the Progressives have been eating away at the Constitutional fundamentals that define America.

We are on the very brink of a Hugo Chaves takeover in the northern hemisphere.

Many Americans are awakening to the dangers of corrupt government officials, but, there are still too many Americans who who are ignorant of the Progressives' machinations.

We need to clean up our government, re-educate our population and children to offset the indoctrinating that has infected our schools at all levels. We must reduce Government intrusions and also reduce the power that out federal governors have usurped over the decades.

People need to realize that life under Obama and Pelosi and Reid will be slavery to a government that owns every aspect of our lives!

    38. Diane, Richmond Virg says:

More importantly, this failure to observe established process erodes the general public's willingness to obey the laws we pass. For instance, if people see that Congress totally ignores the rules in passing this legislation, what is to stop people from deciding that they just won't obey this law? You know, just ignore those rules that are inconvenient or not to their liking. As a lawyer, I see more and more people doing this every day. Importantly, what if people start doing that on a mass basis with taxes?

Congress simply must follow the established procedures and make sure that the laws they pass are needed, just, understandable and CONSTITUTIONAL. Otherwise, we are on the brink of total lawlessness.

    39. Kathleen, Bakersfiel says:

President Obama will move immediately from passing Obamacare to using Deem and pass and Reconciliation to pass Immigration Reform before the November Elections, in open defiance of the American people.

President Obama is taking control of the Nation by taking control of the voter demographic.

Hi is using Healthcare and Immigration Reform in concert to manipulate a shift in voter demographic FROM the disabled and senior citizens TO illegals.

The disabled and elderly are going to disappear as a voter demographic as their demise is accelerated from denial of care.

Illegals both here and on the way are of great value to the STATE.

They will bring to President Obama a vast voting block of compliant and unquestioning voters he will use to pass any laws he wants and transform the country into his own image of what it should be. They are therefore a much more efficient allocation of limited healthcare resources than the intransigent elderly or the disabled.

Why isn't President Obama afraid of the wrath of the American people?

Because he knows they will lose the ability to effect elections with the coming shift in voter demographic.

Why isn't President Obama afraid of losing all those seats to Republicans in November?

Because he knows Republicans won't be able to hold onto those seats they win, with the coming shift in voter demographic. Republicans are going to lose those seats permanently. When those seats go back into Democratic hands they will be filled by Representatives from that immense new voter demographic coming across that open border.

Why isn't President Obama afraid of losing the 2012 Presidential Elections?

Because he is young, his vision is long, and he is making an investment in the future. With the Healthcare and Immigration Reform laws he is putting into place by November, the massive voter demographic he is CREATING will know it was President Obama who gave them healthcare and the vote and, and will vote accordingly.

President Obama has to pass healthcare NOW, to get Immigration Reform passed before he loses seats in the November Elections. With those two laws in place, illegals coming across that open border in mass, will HAVE to be given healthcare and the vote.

It is insane to give illegals here healthcare and the vote when the border is open. No matter how Amnesty is presently, they will get the vote. The power is in the vote. No matter what language is in the healthcare bill, illegals will be covered. The Supreme Court will rule illegals must be covered under the "Equal Protection Under the Law" clause. There is no way to distinguish between those that are already here and those that will be arriving, and no motivation to do so. President Obama and LARAZA want them coming here and wants them voting.

So it really doesn't matter if all the seats go to Republicans this November. If President Obama is successful in passing Healthcare and Immigration Reform before the November Elections, he has won, and he knows it.

President Obama's true agenda with Healthcare and Immigration Reform is radioactive on the political correctness scale. It is human nature to turn away from such as this. He knows that and it gives him cover. Yet it is the truth of what he is doing that will set American free. He needs to be unmasked.

    40. Tom Berquist, Pennsy says:

Realize that progressives do not believe in a rigid constitution. They believe it is a living document that should be adjusted based on current political winds. Obama and Pelosi have said as much many times. I believe both should be impeached and put on trial for their abuse of the constitution.

    41. okiejim says:

My previous comment was not to say that we do not need some health care reform. We do need some form of reform, but an entire remake of the entire system that is working very well.

I t is to simply state that our government does not have its priorities straight. Congress and the President swore to preserve and defend the Constitution and to protect this country from enemies, foreign and domestic. That should be the number one priority of our government but it is not and has not been since the election of President Obama. And, for many in Congress, long before that.

    42. Bob Veigel, Arlingto says:

Obama could care less. He just makes up or 'deems' laws as he moves ahead on the destruction of America. Obama and his group of un-American thugs do whatever they want. Why intelligent people ever elected this dolt is beyond any rationale thinking.

    43. Drew Page, IL says:

Of course Congress has a horrible approval rating; I am astounded that it is as high as it is.

The flagrant bribery, the insulting of constituents who disagree with their representatives, the unwillingness to thoroughly read proposed legislation, their complete disregard for the Constitution and their own House and Senate rules, the delibetrate obfuscations buried in a bill several thousand pages long and the sheer arrogance to say "you'll find out what's in the bill, after it's been passed", is it possible that these things may have something to do with the Congressional "approval" rating?

    44. Phil Grant, Pearland says:

If this so called "reform bill" makes it to obama's desk (first he will have to take his feet off of it) then everyone in this country who can vote needs to actually VOTE. Elections do have consequences, and for all too long people have been big talkers, with not enough action to back it up.

If the bill is never voted on but goes through by the "deem and pass" crap, we have become a dictatorship. It will become too easy for them to do whatever they want any time they want.

    45. Bruce in Florida says:

Given Obama's agenda of "fundamentally transforming America" I fear that if the "deem and pass" tactic is successful it will set a precident for passing future and even more radical legislation. We must draw a line in the sand and stop this thing now!

    46. J.C. Hughes, Texas says:

Couldn't have said it better myself JD. And to Ken Jarvis, we're talking about our nation's constitutional government, not FOX news.

    47. Pete Kleff, Cypress, says:

Is This The Beginning of The End?

It seems as though the national debate over the “Obama health care reform” has been interminable. Indeed I have written a number of opinions on its various versions opposing it for innumerable philosophical reasons. But now a more serious matter raises its ugly, frightening visage.

Article I, Section 7, of the U.S. Constitution reads as follows: “Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States…”

As you may know, the House of Representatives and the Senate have each passed widely different versions of “Obama health care reform”. Neither bill can pass in the other chamber. This creates a dilemma for Mr. Obama. He has been quite open that his so-called “health care reform” will be his legacy. To this end, in both the House and Senate quite incredible incentives have been dealt out to wavering Democrats to obtain support. Nonetheless, in the face of mounting and significant opposition to “Obamacare” from the American public, Mr. Obama and Democrat leaders in the House have thus far been unable to gain adequate votes to pass the Senate bill in the House. Because the Democrats in the Senate no longer have a super majority, the Senate bill must pass in the House or “Obamacare” in its various renditions dies. Still to this point, Mr. Obama and the Democrat leadership have been unable to get enough votes to pass the Senate bill despite both unconscionable deals and open threats.

Enter left stage Congresswoman Louise Slaughter (D, NY), chair of the House Rules Committee, with the “Slaughter Solution”. Essentially her solution works like this. She will propose to the House a rule which will declare that the House “deems” the Senate bill has been passed by the House. Then, the House will vote on the rule, rather than the Senate bill. Ostensibly recalcitrant Democrats in the House can vote for the rule, and continue to maintain they did not actually vote for the Senate bill. The plan would be to send the Senate bill to Mr. Obama under the myth that it has “passed” both the House and the Senate.

Do they really believe the American public is so stupid as to not understand this sleight of hand trick by House Majority Leader Nancy Pelosi (D, CA)? Apparently so or perhaps she and her cohorts simply do not care. She in particular has made it very clear she was going to get “Obamacare” through the House no matter the cost.

When criticism is raised against this extraordinary and extralegal tactic, Ms. Pelosi et al respond that the same or similar tactic had been used when Republicans controlled the House. Regretfully she is correct. [In passing I am reminded of an old saw frequently resorted to by my Mother – “Two wrongs don’t make a right.”] But on close examination, it appears that on nearly all, if not all, those occasions it was in connection with budgetary matters and rarely resulted in close votes. Nonetheless, I oppose such tactic no matter who the controlling party is in the House. It makes a sham of House rules when such rule clearly violates the Constitution.

This brings me to the primary issue. Article I, Section 7, of the Constitution is clear and specific. A bill must “pass” both chambers of Congress before it goes to the President for a signature to become law. To “pass” means nothing more and nothing less than the bill itself must be presented for a vote and receive a majority of yes votes. There is simply no Constitutional basis for any other procedure. To be blunt, this procedure is unconstitutional and any purported bill “passed” using this tactic is invalid.

So it is deeply disturbing when Democrat stalwarts such as Representative Pelosi and Senator Harry Reid (D, NV) so blithely ignore the Constitution they were sworn to uphold. Indeed when asked by a reporter about the Constitutionality of certain legislation in the House, she responded, “Are you serious?” Or consider hidden provision inserted into the Senate bill by Senator Reid which purports to prohibit future Congresses from amending the Senate “health care” legislation.

But what is even more disturbing is the indifference of Mr. Obama to the U.S. Constitution, which he is also sworn to uphold. Yesterday in an exclusive interview with Brett Baier of Fox News in response to an enquiry about the Slaughter Solution, Mr. Obama stated he was not concerned about procedures, just whether the bill passed the House. This can only be interpreted as a conscious disregard of the Constitutional threshold of any and all federal legislation. Such a position is dangerous and frankly suggestive of autocratic rule.

So my enquiry is quite fundamental. Is this the beginning of the end of our Constitutional Republic?

    48. William Downey, JD L says:

The American people don't trust Congress? Amazing. How can you trust people that routinely exempt themselves from federal regulations, engage in bribery by buying votes, ignore the demand s of the voters, refuse to accept the fact that our present fiscal and legislative agenda is leading us to doom?

Elements of our health care, education need reform. The most important reform we can demand however is that the people we elect tor represent us actually vote the way we want.

    49. Tim Boley, Lancaster says:

President Obama and his band of liberals may win the battle but they will not win the war. Conservative Americans should send President Obama a letter someday thanking him for waking up the sleeping giant. America's greatness is due to conservative principles, capitalism and a belief in the strength and value of all it's citizens, not just a few "enlightened" idealogues.

    50. MN J says:

The attacks on our Constitution began as soon as Obama was sworn in. They'd been in place starting before the left decided he would be their candidate. Question since Day 1, "Who is behind him?"

He wooed college students and will now bankrupt them. He wooed seniors and now will impoverish them. He wooed academics – they'll be next. It's control, control, control.

IF [and it's an big IF] Republicans retake the house, watch for attacks on them beyond the pale. I do not understand why the media moguls think they will be exempt from these taxes and procedures. I am very concerned about Nov. 2010 regardless what the polls say. This group will do anything to keep control. Heck, here in MN, we had 17,000+ more ballots counted than people who voted. Yep, we did. And these ballots weren't for conservatives at any level. Can't prove whom they voted for but 17,000+ is a fact.

While O may not be as bright as he is purported to be [if so, where are his college grades?], he still is glib and his masters are using him very, very effectively. I do not agree with him but one should never underestimate the talents of others. This year's election will tell a lot. We'll see.

    51. Ken Hopkins says:

There must be a legal move that can be done, perhaps by a State attorney general, to remove a representative or a senator who violates their oath of office. (Ninth and Tenth Amendments) Not sure if there has been a precedent or not. Maybe someone at Heritage can shed light on this. Methinks we need an intense spotlight.

    53. Dale Cord Redondo Be says:

"HELLO"……………………There is a very simple rational solution to these crimes committed by these outlaws in our government. We arrest them, and prosecute them and then send them to prison, just as we always have arrested criminals guilty of committing felonies against the laws of our land and society, period. What don't you people understand about this? We know who they are, and where they are, if the law enforcement agencies need help like the F.B.I or local police in Washington, we the people will help them do the job we the tax payers are paying them for. To allow these outlaws to continue their crimes is to allow anarchy to rule the multitudes. Is this what you want? If it is….. your brains have short circuited and iniquity has over taken you!!

    54. Jim Roumeliotis - Hu says:

The people have spoken yet the congress does not listen. This measure must be defeated on the basis that it is a demeaning piece of law. If allowed to pass it will open the doors to future and upcoming bills written in the same tone. This must be a short war….no more battles.

    55. Martin/Georgia says:

Obama stated during the election that the Constitution was a constraint to his policies and goals. That set off red flags to me then -along with his distribute the wealth comment. Now Biden says they will "control" the insurance companies.

Time to reset the country folks!

    56. Dale Cord Redondo Be says:

This has to be the email forward of the year! Please take a few minutes to read and absorb just what this woman had to say, and then hopefully everyone will pass it to their entire mailing list, and theirs to theirs until it circles the nation! Time is short and arrogance, stupidity and ignorance abound…

The following letter read on Glenn Beck 's show, is rapidly circulating around the country. Americans everywhere identify with this 53-year-old woman.. She has given us a voice. Once you read this, you will want to forward it to all of your friends…

GLENN BECK: I got a letter from a woman in Arizona . She writes an open letter to our nation's leadership:

"I am a home grown American citizen, 53, registered Democrat all my life. Before the last presidential election I registered as a Republican because I no longer felt the Democratic Party represents my views or works to pursue issues important to me. Now I no longer feel the Republican Party represents my views or works to pursue issues important to me. The fact is I no longer feel any political party or representative in Washington represents my views or works to pursue the issues important to me. Instead, we are burdened with Congressional Dukes and Duchesses who think they know better than the citizens they are supposed to represent.

There must be someone. Please tell me who you are Please stand up and tell me that you are there and that you're willing to fight for our Constitution as it was written. Please stand up now.

You might ask yourself what my views and issues are that I would feel so horribly disenfranchised by both major political parties. What kind of nut-job am I? Well, these briefly are the views and issues for which I seek representation:

One, illegal immigration. I want you to stop coddling illegal immigrants and secure our borders. Close the underground tunnels.. Stop the violence and the trafficking in drugs and people. No amnesty, not again. Been there, done that, no resolution.

P.S., I'm not a racist. This is not to be confused with legal immigration.

Two, the STIMULUS bill. I want it repealed and I want no further funding supplied to it.. We told you No, but you did it anyway. I want the remaining unfunded 95% repealed. Freeze, repeal.

Three: Czars. I want the circumvention of our constitutional checks and balances stopped immediately. Fire the czars. No more czars. Government officials answer to the process, not to the president. Stop trampling on our Constitution, and honor it.

Four, cap and trade. The debate on global warming is not over. There are many conflicting opinions and it is too soon for this radical legislation. Quit throwing our nation into politically-correct quicksand..

Five, universal healthcare. I will not be rushed into another expensive decision that will burden me, my children, and grandchildren. Don't you dare try to pass this in the middle of the night without even reading it. Slow down! Fix only what is broken — we have the best health care system in the world — and test any new program in one or two states first.

Six, growing government control. I want states rights and sovereignty fully restored. I want less government in my life, not more. More is not better! Shrink it down. Mind your own business. You have enough to take care of with your real [Constitutional] obligations Why don't you start there.

Seven, ACORN. I do not want ACORN and its affiliates in charge of our 2010 census. I want them investigated. I also do not want mandatory escrow fees contributed to them every time on every real estate deal that closes — how did they pull that one off? Stop the funding to ACORN and its affiliates pending impartial audits and investigations. I do not trust them with taking the census with our taxpayer money. I don't trust them with any of our taxpayer money. Face up to the allegations against them and get it resolved before taxpayers get any more involved with them. If it walks like a duck and talks like a duck, hello. Stop protecting your political buddies. You work for us, the people. Investigate.

Eight, redistribution of wealth. No, no, no. I work for my money. It is mine. I have always worked for people with more money than I have because they gave me jobs — and that is the only redistribution of wealth that I will support. I never got a job from a poor person! Why do you want me to hate my employers? And what do you have against shareholders making a profit?

Nine, charitable contributions. Although I never got a job from a poor person, I have helped many in need. Charity belongs in our local communities, where we know our needs best and can use our local talent and our local resources. Butt out, please. We want to do it ourselves..

Ten, corporate bailouts. Knock it off. Every company must sink or swim like the rest of us. If there are hard times ahead, we'll be better off just getting into it and letting the strong survive. Quick and painful. (Have you ever ripped off a Band-Aid?) We will pull together. Great things happen in America under great hardship. Give us the chance to innovate. We cannot disappoint you more than you have disappointed us.

Eleven, transparency and accountability. How about it? No, really, how about it? Let's have it. Let's say we give the buzzwords a rest and have some straight honest talk… Please stop trying to manipulate and appease me with clever wording… I am not the idiot you obviously take me for.. Stop sneaking around and meeting in back rooms making deals with your friends. It will only be a prelude to your criminal investigation. Stop hiding things from me..

Twelve, unprecedented quick spending. Stop it now.

Take a breath. Listen to the people. Slow down and get some input from nonpoliticians and experts on the subject. Stop making everything an emergency. Stop speed-reading our bills into law. I am not an activist.. I am not a community organizer. Nor am I a terrorist, a militant or a violent person. I am a parent and a grandparent.. I work. I'm busy. I am busy, and I am tired. I thought we elected competent people to take care of the business of government so that we could work, raise our families, pay our bills, have a little recreation, complain about taxes, endure our hardships, pursue our personal goals, cut our lawn, wash our cars on the weekends and be responsible contributing members of society and teach our children to be the same all while living in the home of the free and land of the brave.

I entrusted you with upholding the Constitution. I believed in the checks and balances to keep from getting far off course. What happened? You are very far off course. Do you really think I find humor in the hiring of a speed reader to unintelligently ramble all through a bill that you signed into law without knowing what it contained? I do not.

It is a mockery of the responsibility I have entrusted to you. It is a slap in the face. I am not laughing at your arrogance. Why is it that I feel as if you would not trust me to make a single decision about my own life and how I would live it but you should expect that I should trust you with the debt that you have laid on all of us and our children. We did not want the TARP bill… We said no. We would repeal it if we could. I am sure that we still cannot. There is needless urgency and recklessness in all of your recent spending of our tax dollars.

From my perspective, it seems that all of you have gone insane. I also know that I am far from alone in these feelings. Do you honestly feel that your current pursuits have merit to patriotic Americans? We want it to stop. We want to put the brakes on everything that is being rushed by us and forced upon us. We want our voice back. You have forced us to put our lives on hold to straighten out the mess that you are making. We will have to give up our vacations, our time spent with our children, any relaxation time we may have had and money we cannot afford to spend on bringing our concerns to Washington . Our president often knows all the right buzzwords like unsustainable. Well, no kidding. How many tens of thousands of dollars did the focus group cost to come up with that word? We don't want your overpriced words. Stop treating us like we're morons.

We want all of you to stop focusing on your reelection and do the job we want done, not the job you want done or the job your party wants done. You work for us and at this rate I guarantee you not for long because we are coming. We will be heard and we will be represented.. You think we're so busy with our lives that we will never come for you? We are the formerly silent majority, all of us who quietly work, pay taxes, obey the law, vote, save money, keep our noses to the grindstone… and we are now looking at you.

You have awakened us, the patriotic freedom spirit so strong and so powerful that it had been sleeping too long. You have pushed us too far. Our numbers are great. They may surprise you. For every one of us who will be there, there will be hundreds more that could not come. Unlike you, we have their trust. We will represent them honestly, rest assured. They will be at the polls on voting day to usher you out of office.

We have cancelled vacations. We will use our last few dollars saved. We will find the representation among us and a grassroots campaign will flourish. We didn't ask for this fight. But the gloves are coming off. We do not come in violence, but we are angry. You will represent us or you will be replaced with someone who will. There are candidates among us who will rise like a Phoenix from the ashes that you have made of our constitution.

Democrat, Republican, independent, libertarian. Understand this.. We don't care. Political parties are meaningless to us Patriotic Americans are willing to do right by us and our Constitution, and that is all that matters to us now.. We are going to fire all of you who abuse power and seek more. It is not your power. It is ours and we want it back. We entrusted you with it and you abused it. You are dishonorable. You are dishonest.. As Americans we are ashamed of you. You have brought shame to us. If you are not representing the wants and needs of your constituency loudly and consistently, in spite of the objections of your party, you will be fired. Did you hear? We no longer care about your political parties. You need to be loyal to us, not to them.. Because we will get you fired and they will not save you.

If you do or can represent me, my issues, my views, please stand up. Make your identity known. You need to make some noise about it. Speak up. I need to know who you are. If you do not speak up, you will be herded out with the rest of the sheep and we will replace the whole damn congress if need be one by one.

We are coming. Are we coming for you? Who do you represent? What do you represent?

Listen. Because we are coming. We the people are coming.

    57. S Rubicon Southcentr says:

One thing is certain. Once these idiots are voted out of office (that assumes ACORN, its newly formed operations designed to hide it, & all those over 100 affiliated operations who share funds & activities like any other RICO operation), we must make any & every effort to educate our children on our constitution. At this time, far too many Americans do not understand that document nor do they understand what it would mean if its safeguards were removed &/or minimized.

The efforts of the do-gooders & ideological nitwits of the left seeking their utopian world while still on earth, confirm the age old adage…. death by a thousand cuts.

Slowly but surely our laws, our protections, our freedoms have been weakened by well meaning judges & by social engineers who seem to think equal outcomes is possible when in fact only God can accomplish that. Equal opportunity was America's advantage but leftists have many believing equal outcomes is the way it should be.

Worse is that we have some uber wealthy types who seek even more wealth, but they also seek power. They may or may not believe in certain forms of government, but in the end, their real goal is power. And, with no conscience they will go after their goals with no concern for the damage they do to individuals &/or to an entire nation or peoples.

So teaching our children & perhaps even a number of adults about our (their) constitution is incredibly important. Add to this, a monumental effort to investigate any & all who are even remotely associated with our congress & its antics, plus with our financial systems & its failures & activities prior to the recession, during the recession, and what they are up to after the recession.

(Notice I assume the recession will actually end even though much of the legislation proposed is bound to extend it for perhaps decades.)

    58. Spencer Wilcox, Mary says:

The only problem with Obama's declarations that the importance and goodness of his bill's "substance" trump concerns about the "process" is that at some point, erosion of process constitutes a breach of democracy. It is interesting to note that Obama's administration employed this argument to try to squash the efforts of the Hondurans trying to defend their Constitution, but did not lend ear to it when it came from Iranians who opposed Ahmadinejab's rigging of their election. A healthy majority of Americans who have voted or been polled in the last six months do not want his bill to pass. His bill stalls on the substance, so he changes the process to pass it, and then tells us not to be concerned about the process.

Obama, Pelosi, et. al. value this bill more than they value our democracy.

We have rejected the bill's substance. Obama cites all the good things it does, and then has the gall to cite the unprecedented hikes in insurance rates as another reason why we should pass it. The hikes are a result of the bill. They are but a taste of what is coming should it become law.

    59. Al Reasin says:

When I think of the disrespect from this congress and administration for my 4 generations of family that have served to defend our freedom and Constitution, including my son now in Iraq, and the millions of Americans who have died or been forever disabled for their sacrifice for American freedom over our county`s history, I get angry at our government and all chocked up for the sacrifice of our citizens over these many years, as I am now. These congress people need to stand in front of those thousands of white crosses in Europe and reflect on their own honor, our freedom and our country's worth as I have.

    60. L.C.Lawless Eaglevil says:

The way this H C bill is going , we the people WILL OWE OUR SOULS TO THE FED.GOV. we got to stop it one way or another.

    61. Tom C., Huntington B says:

the road to socialism is slowly drawing near. many years from now (and I am not joking), the correct name for this once great country of ours will be (appropriately) the United Socialist States of America.

    62. G. Lewis, Michigan says:

As revolting as the process of getting "Health Reform" bill passed through the Senate was, the process was still within the bounds of the Constitution. The "Deem and Pass" approach in the House of Representatives is not.

This goes beyond simple partisan politics, this is plain and simple an attempt – with all too much chance of success – to subvert, or perhaps, simply ignore the Constitution these U.S. Representatives swore to uphold.

If this winds up on the President's desk through "Deem and Pass," we need to work to have Nancy Pelosi, Louise Slaughter, and any other person who votes for this undermining of the Constitution expelled from the House of Representatives.

If we have to wait until next year and a Republican majority, so be it, but these people must go.

    63. John Atwood says:

Additional Constitutional questions arise because the mandate likely violates the takings clause of the Fifth Amendment because a status is being taxed without compensation or due process of law. Income may be taxed under the 16th amendment but that is not the tax imposed by the mandate and one's money is "property" being taken for a public purpose (national health care). I hope someone will fund the litigation to challenge the abuse of the Constitution.

    64. Linda Shiebler-Tenne says:

I just heard that the Arizona Attorney General has refused to support the Governor's request to assist their state in conjunction with other states in addressing the unsustainable mandates in this Health Care bill.

    65. okiejim says:

Mr. Gaffney continues by explaining that " The Muslim Brothers know that by masking their ideological agenda as a religeous program, they can use Western civil liberties and tolerance as weapons in their stealthy Jihad…"

    66. john Arizona says:

Gee, Obama and his administration are using scheming, underhanded, unconstitutional, and knee cap breaking tactics to get their agenda approved. Does this sound like Chicago politics at its best? What was the people of the USA thinking when we elected this band of bandits?

    67. bigdave says:

Everyone join with DALE CORD in Redondo Beach! Arrest them all from Obama on down, to every demorat/communist/progressive who has/is attempting to destroy this country and circumvent the WILL OF THE PEOPLE! Nancy Pelosi is an ugly, rich piece of excrement who could not care less about American values, much less families. Take their property, assets and put them back in the US treasury from whence it came then ship them off to Venezuela, or Kenya wnad let them do something GOOD for a change.

    68. ONTIME says:

I am impressed by the lofty words and the passion by which Americans every where are speaking out against a unethical, unconstitutional and unprecedented upheaval of American tradition, culture and law, it is momentous. Yet we are seemingly allowing this Constitutional deteroration to continue.

Let me ask, what does all this talk mean? Talk is cheap and we all know right from wrong, we also know what is happening and for the most part how it has come about, it is evidenced in recordings, videos and print, this is probably the most well documented bit of scurrilous inenteded political destruction known in history. Yet we seem to be sitting on our collective hands, I ask you why are we dallying?

We have the tools to remove this blasphemy from our midst and yet we have no one who is going to carry out the rule of law in order to implement the cure. Where are our brains, our courage and why are we hesitating? The man is not even qualified to be a POTUS and yet he is, there is great evidence and enough allegation to create the circumstances to remove him from this office and yet no one is showing the courage given to you by use of our own law. America, you have the means, the motive and the right to protect what is rightfully yours, to not do so means those who trusted you to take care of your own heritage were mistaken and all who follow will forever suffer. There will never be a America as great as this one.

    69. toledofan says:

This is a bad bill using a terrible process to get it passed. Why are we wasting so much valuable time on doing something that the majority of Americans know is not good for America and is in many respects is anti – Constitutional? Are we to think that because the majority of Congress are lawyers, shouldn't they know the law, if they did how can they vote YEA? It's hard to comprehend that we would put a guy into office that supports the tearing down of Constitution, wants to dramatically change America to resemble other failed countries and wants to expand the governments control beyond imagination. Pathetic.

what the liberals are county on) to get all flustered and angry at this mess

Adding to the comments of Martin from Georgia about Mr. O's dislike of the constraints of the Constitution and Biden's liking government control of insurance companies (along with every other industry and business they are confiscating).

Since the Student School Loan bill has been added to this health care destruction bill, it is not a stretch to conclude that students receiving these loans will be required to attend certain classes that will "Re-educate" them into the correct way of thinking and even which schools they must attend. Next step? How about ALL students MUST take the loans. Nothing is to be left to chance, you see.

    73. Ben C. Ann Arbor, MI says:

My question for the POTUS – "Will you take responsibility for both any success or failure of your healthcare bill?" The geriatric senators and representative who vote for this bill will be long gone – but you are a young man. In thirty yearse or so when we have abysmmal health care will you 'man-up" and admit you were wrong. My guess your answer will be "it was those Republicans and Tea Partiers that caused this mess." Your rhetoric is recorded for posterity and the truth will come out.

    74. Kevin Habib, Glen Bu says:

I'm amazed at how misguided this post and comments are and the size of hypocrisy.

There are complaints that 'deem and pass' is unconstitutional, yet it has been used hundreds of times by Congress, the large majority of times by Republicans, but suddenly, it's wrong.

There are complaints about reconciliation, but Republicans used it in 2001 and 2003 to pass stimulus packages that are twice the size of Obama's stimulus package from last year. Republicans were the first ever to use it in history of congress to add to the deficit (it was meant for deficit reduction).

When people are asked if they support 'obamacare' the majority say no. When they are asked if they support the individual provisions when explained, there is overwhelming support.

The people certianly have spoken, they elected the Dems a majority in Congress and health care was top 3 on all polls as their reason – so Dems are following through on their campaign.

The Republicans took a 6 trillion suplus and brought us into the worse economic crisis since the depression – there is no arguing against that fact. But suddently, one year later, they are the ones who know what to do with budgets?!?! Based on what – the destruction their policies have caused to the economy.

Have you noticed since the Dems took over how the economy has rebounded, how the DOW is up 60%, how monthly job losses have dropped 94%, how corporate spending increased 100% this year, how consumer confidence has jumped, how houshold value has jumped?

I'm telling you – turn off FoxNews. They are not news, merely an entertainment channel – the supreme court has deemed it so – please google 'Jane Akre' and see for yourself. FoxNews is nothign more than shell coproration for the insurance companies and prahamacueticals who don't want to have to provide coverage to the sick or old or to small businesses.

You also point to 17% approval and how terribly low it is. However, it is higher than the congressional approval in 2008. In july 2008, it hit 14%. IN October of 2008, it was 10%.

It's sad to see the comments about socialism and communism – it shows very little are thinking for themselves, but just spouting talking points they hear from people with alterior motives. Come on people – wake up!!!

Just like Boehner, AEI and the others – Heritage touted the CBO numbers when Elmendorf first published them last year and they did not look good. Now that they look good, the very same folks are sayign they are wrong.

Thankfully, Dems haev courage and will do what is right.

Good luck trying to repeal a bill that offers these immediate benefits:

Small Business tax credits (35% of premiums will be paid – in 2014, will be 50%)

End all recissions (bans insurance from dropping you when you get sick)

Ending discrimination against sick kids (insurers can;t deny coverage to kids with pre-existing conditions)

Free preventive care under Medicare (all preventive care for Mdcr beneficiares will be free)

Kids allowed to stay on parent's plan until 26 (Republican idea)

Bans lifetime caps and annual caps

Increases funds for community health centers

Free preventive care under new private plans

new independent appeals process (consumers will now have internal and extenal appeals process)

Ensuring Insurers spend at least 80% of profit on medical services

creation of high risk pool for people who have pre-existing conditions

And many more immediate benefits. America will look back with strong approval fro the Members who had the courage to pass this bill on Sunday – and judge those who were too scared to stand up to the private insurers and Freedom works and the for-profit hospitals!

I think most Americans would vote for this. " Congress shall make no law that applies to the Senators and Representatives that does not equally to the citizens of the United States." There are just a few that have not lined their own pockets and not looked down on the very citizens that elected them. The Supreme Court has upheld the changes congress made in it's procedures. The court apparently took recess from the English language that day. This group of 9 is supposedly conversant with "The Federalist Papers." The constitution is quite clear, as originally written, how votes are to be taken. That process has been changed, contrary to the benefit of the constitution. The Supremes have emboldened congress to write it's own rules regards voting. Balance of powers did not work in this case. Hence this perverted procedure we are facing.

It took a while to peruse all these great comments, and I'm still laughing about ML in Fl's earlier comment. He asked, “If this is so wrong why don’t the major news organizations (TV, newspapers, magazines, etc.) rerport this?”

Dear ML, to better understand the answer to your question, you have to know that, with the exception of FOXNews and a few besieged newspapers, the major U.S. news organizations you mention have become tools of the Progressive movement in America. As such, they operate under the caveat that any "news" that does not support a Progressive point-of-view is not news at all. Added to this mess is the fact that, to the current Administration and the Progressive media, any news organizations which do not fully support the Progressive agenda(s), are not legitimate news organizations at all. Therefore, any reporting which indicates that the shenanigans of the current Administration and Congressional Leadership are wrong, or even unconstitutional, is "deemed" (thought to be), by these erstwhile major news organizations, not to be news "worthy" at all. In other words, you're not apt to see any such reporting by most of the major news organizations.

Speaking of Progressives; for many generations now, the Constitution of the United States has been a pet peeve and a target of those who espouse the ideals and aspirations of what, in the last hundred years or so, has become known as the Progressive movement. Today, our beloved Constitution has become only a "temporary" inconvenience to this unholy alliance.

Keep in mind ML that it has never mattered what organizations or platforms the insidious ideology behind Progressivism needs to take over, be it Liberalism, Democrats, or the United Soviet Socialist Republic. Its aim and intent is complete power and control over all aspects of human "being." For us that means everything embodied in life, liberty, and the pursuit of happiness (including property). For Progressivism to succeed, every source of information and government model must eventually be co-opted by whatever form of Progressive organizations can wrest power and control over all the individuals who make up “We the People,” even If "We" were once a "free" people.

So, ML, please open your eyes and see just what it is that "We the People," under the ages old desire of hope and change, have finally brought upon ourselves. If it is what you so desire, then the failed hope of America’s Founding Fathers has served you well.

Ask yourself, though. Can this fiasco be reversed? Can all of our true, unalienable, God given rights be reclaimed? In the late 1700’s, King George III of England didn't think so. Enjoy the journey ML.

    88. Fred Thompson says:

One disagreement here. The end does not justify the means. The end will not provide incentives to reign-in health care costs. The end will not curb defensive medicine and skyrocketing malpractice awards. The end will not provide individual health care insurance that goes with the insured if he/she changes jobs. The end does add corruption to the political process by giving certain groups rewards to which they are not entitled. The end does create another entitlement which adds to the looming crisis of unfunded liabilities with which succeeding generations will be burdened. Contrary to news releases from the White House, the end will cost a boatload of money and add to the deficit. The end will ultimately cause a decline in the quality of health care available to our citizenry.

So on almost every conceivable account the end of ObamaCare is abhorrant. The means by which the House will try to pass it is despicable and unconstitutional. Shameful! But Pelosi is beyond shame.

This may seem a real stretch but I sense a hint of the use of the Clovis-Piven model in all of this.

      1) The so called "Slaughter Rule" is surfaced and bandied about. There is little doubt that using this rule to pass ObamaCare will result in a Constitutionality challenge of very serious proportions.

      2) The White House is hinting than other bill in process may be "passed" without the requisite Yea or Nay voting procedure. Again, each such passage would result in a Constitutional challenge/crises.

      3) The bill that come immediately to mind would be Cap and Trade, and Immigration Reform. Each has huge implications for the future of the United States as we know it. I'm sure these are not alone as potential "passees".

The result of all of this could be a monumental clogging of the SOTUS caseload pipeline. It could be years in the unraveling to the point of decision.

This Bill raises revenue, and it originated in the Senate. All Bills which raise revenue are to originate in the House. This would also seem to flatly violate the Constitution, and I hear/see nothing on this matter.

Also, the Constitution does not afford the Government the power to force us to buy any particular product.

Adding these issues to the 'Deem and Pass', that makes three glaring violations of the Constitution.

Linda Johnston — Congress does not get to make its own rules if those rules violate the Constitution.

    120. Tom, San Francisco says:

Kevin Habib, Glen Burnie, MD — Gentlemen, just because someone has done something unconstitutional does not make it okay for other to so: I refer to the case of "Two wrongs do not make a right".

Furthermore, it is my understanding that prior uses of 'Deem and Pass', the original Bill is deemed to have been passed, amendments are added to it, and the entire 'new' Bill is voted on, meaning the original combined with the amendments. In this case, the Senate Bill is to be deemed to have passed, and a set of amendments are being worked up. These amendments are not being added to the Senate Bill, and the amendments are the only thing being voted on. This is a huge difference. This would mean that the Bill going to the President would be the Senate Bill, and the Senate Bill only. The amendments the House is working on will not be a part of the Bill being signed in to law, as the Senate has not voted on them. So, the House is voting on amendments that will not be signed into law, and sending the Senate Bill which it will not have voted on to the President. The President will be signing into law a Bill that has passed one house of Congress.

Someone can correct me if I am mistaken, but this is how I understand the matter after much research.

    121. Kevin, North Carolin says:

Is it not also true that the government cannot produce a condition (through coercive taxation and the like) that it could not produce through outright legislation? I seem to recall reading a Supreme Court case about this.

For instance, what if Congress decided to raise income taxes by 1000% across the board, but then also made available a 1000% tax offset to every citizen who made their home available for quartering of soldiers. This would in effect coerce the population into allowing the quartering of soldiers in private homes, something the government is prohibited from doing outright by the 3rd Amendment. My understanding is that, because the government is prohibited by the 3rd Amendment from producing this condition (quartering of soldiers in private homes), it is likewise prohibited from producing that same condition through coercive measures designed to produce an ostensible "voluntary" act by the people.

If the government cannot outright require every person to purchase a good or service (even the much-abused Commerce Clause does not seem to support such an assertion), then doesn't it follow that it likewise cannot compel this same result through tax penalties?

Now, would you mind telling me how this is a 'good thing'? We're going to 'council' and 'recommend' 'end of life' to our older citizens, who have paid taxes, fought in wars, voted and are not only citizens of this country but HUMAN BEINGS AS WELL.

Then, the government is 'restricting' medical services to those with special needs?

God help us all. It's people like you who voted for Obama and who will be responsible for millions of deaths, the downfall of our economy, the government dictatorship over our privacy, patient/doctor relationships and reducing enlightened, caring people into nothing more than animals-the survival of the fittest., I hope you can sleep at night, because I sure as heck won't be able to knowing what you, people like you and this administration have stomped on our most vulnerable citizens, our children and this once great nation.

(which, if you read your history, Constitution and Bill of Rights is a REPUBLIC, not a democracy!)

    127. Bill, IN says:

Mike, FL – You are clueless. Your question does not even merit this response.

    128. Celestine, WA says:

I need to correct myself and add a few things.

Correction: I did not spell 'uninformed' correctly. And in my haste and outrage at the rhetoric being spewed, did not realize I should have been addressing two people.

Additions: Reid put a restriction in this bill that 'no future Congress may amend any portion of this bill'. (So, the Constitution should be 'flexible' and can be changed on a whim, but not this health care disaster? Hypocrisy at it's finest, way to go progressives!)

The CIC decided to 'piggyback' the take over of student loans on the Health Care bill, thus combining two separate pieces of major legislation into one, which no one in the House or Congress could possibly have had the time to read thoroughly before voting.

Then we have the IRS, Federal Reserve and FBI. None of these organizations are Constitutionally legal. The tax codes specifically state that only corporations are REQUIRED to pay taxes. Citizens are supposed to have the right to decide whether or not they will pay taxes, but that's not what we're told or how the IRS enforces things. Now with the health care 'madates' and 'fines' we are seeing 'taxation without representation'. Hello, King of England!

Lincoln long ago refused to establish the Federal Reserve; he knew the perils of a central banking system- what it would do to our financial independence, stability and nation as a whole. Now we see our great nation so far in debt that foreign nations and banks own a percentage of OUR country!

The only law enforcement officers who have any Constitutionally legal power are Sheriffs' because they are ELECTED officials. (Translation: police, state patrol and the FBI are not Constitutionally legal law officials. They are simply government agencies & employees- not law enforcement officers; a sheriff has jurisdiction over them.)

Now, here's what we have: government controlling our schools, banks, auto mobile industry, health care and student loans.

I'd ask 'what next' but am terrified of the answer.

Our country has been on the march to the left for decades. We (basically) already have a welfare state, which encourages broken homes (example: a married couple cannot get assistance in my state no matter if they're broke, homeless & hungry and by extension, so are their children; but if the husband and wife separate, then the state will give them assistance).

Our children are being indoctrinated, my 13 and 16 year olds' knowledge of what is right, wrong, their right to believe in and worship God, or the very existence and substance of the Constitution & Bill of Rights have come from me, not their government run, tax funded schools. Every time new textbooks are written, our country's history is altered and pieces left out. Our children are taught to be 'global citizens' and politically correct. Things like God, Christianity and Christmas are looked upon as 'shameful' or 'hate speech' yet every other major religion and their holidays are preserved and their virtues extolled.

Quite a few states have taken it upon themselves to ignore and outlaw the 2nd Amendment right to keep and bear arms. Of course it makes sense to have tougher gun control laws, because the criminals abide the laws, don't they? And it also makes sense to have a persons' information all on hand when you implement the need to confiscate their firearms in an effort to further 'protect' us from the evils of hunting and self defense.

(After all, you can't have citizens armed to protect themselves, their families or property-especially when the government is is on the verge of tyranny, now can you?)

Socialism, Progressives and Marxists have taken root in our government and have no plans to go anywhere, anytime soon, of their own volition. I am terrified for my country and my children. What kind of future have we given them? Debt beyond belief, no rights and the attitude that you should get everything for nothing. We'd make Hitler, Karl Marx & Friedrich Engels proud!

Thank God for the internet. (I suppose that's why they're going after it next.) If 'we the people' had known what 'business as usual' was like in Washington since the days of FDR, things would NOT be 'business as usual'!!

After all, if a common person (or 'useless feeder') can access information for free, what will those with all the money and power do? They will do whatever is necessary to protect their power, status and way of life against the sheer number of every day, law abiding, tax paying Americans, who are, rightfully, outraged at what they've done to our nation. All the while reassuring us of 'what's best', since we're too stupid to know for ourselves, and talking down to us like a two year old who doesn't have a full grasp of the English language yet.

The secret of 'we the people' having all of the power is NOT something they want us to know, it violates their delicate sensibilities and lets them know they are on the verge of losing everything they love -if we wake up and unleash our power. That fear drives them to keep us downtrodden, uninformed and in line.

What a great retirement present !! Thanks Obama ,Pelosi and Reid. You are really demonstrating your support for Democracy, and our Constitution. Ramroding it down our throats and not discussing or allowing appropriate Government individuals the chance to read it entirely, before it is passed, just shows us you want the same kind of Government that exists in China, Russia, Venezuela, Iran, etc. Now you will be pushing everything else that will support a Socialistic type Government to further ensure your long term goal of destroying America.

    134. Dale Cord says:

I believe these gangsters who are holding our government hostage will eventually push the "SLEEPING LION" to the point of their own destruction. When you give a man enough rope, he will inevitably hang himself. Many will die, but that is the price we have to pay, every so often for our Freedom. It has been recorded in our history books since our inception into this "Den of Iniquity" we call Earth "Human beings will destroy themselves, but if not for Divine intervention. Our epitaph will read: "Obama fiddled while America burned
