  • Morning Bell: It Is Time To Prioritize Security Over Terrorist Rights

    Yesterday, the White House ordered the Department of Justice to begin considering places other than New York City to host the civilian criminal trial of 9/11 mastermind Khalid Sheikh Mohammed and four other terrorists. The New York Times describes a decision to move the trials out of New York as “a retreat by the administration” and reported that the Obama administration “was scrambling” to find a new way forward.

    This latest bit of self-inflicted national security chaos comes after Obama ally New York Mayor Michael Bloomberg announced yesterday that he did not want KSM’s trial in Manhattan. And Bloomberg was not the only Obama sympathizer to plead with the President to rethink his detainee policies. Six Senators, including Sens. Joseph Lieberman (I-CT), Blanche Lincoln (D-AR), Jim Webb (D-VA), John McCain (R-AZ), Susan Collins (R-ME) and Lindsey Graham (R-SC) all signed a letter saying of KSM and his conspirators:

    You will be providing them one of the most visible platforms in the world to exalt their past acts and to rally others in support of further terrorism.

    And the KSM trial debacle is not the only sign the Obama administration is putting their personal politics over protecting American citizens. Last week, the nation’s top intelligence official, Director of National Intelligence Dennis Blair, told a Senate committee that the Obama administration was wrong to question Flight 253 would-be-bomber Umar Farouk Abdulmutallab with civilian law officers instead of using specially trained interrogators from the recently-created High-Value Detainee Interrogation Group.

    These concerns were then echoed by 9/11 Commission heads former-Gov. Thomas Kean (R-NJ) and former-Rep. Lee Hamilton (D-IN), who said U.S. intelligence agencies should have been consulted before Abdulmutallab was granted constitutional protections under U.S. law, known as Miranda rights, and initially stopped talking to investigators.

    It is high time for the Obama administration to stop allowing their leftist base to undermine our national security. As Heritage fellow Cully Stimson explains, returning KSM to a military court would be a great place to start:

    It is time for the administration to acknowledge the folly of deciding to try KSM and others in federal court and refer them back to a military commission, where they belong. Then, the administration should give commissions the full resources that they have lacked, including world-class prosecutors and defense counsel.

    The tide is turning against the administration’s approach to terrorism. Perhaps that is why the President did not mention KSM during his State of the Union address. Americans don’t think terrorist deserve constitutional rights. Americans also know that military commissions are fair.

      This month, Obama signed an Executive Order granting Interpol's NYC office (and only this office) unprecedented powers over and above Congress, the NYPD, FBI, and CIA. Why was our sovereignty ceded to this organization? This Interpol office is also exempt from search and seizure, and the Freedom of Information Act.

      I feel that these unprecedented powers have something to do with the KSM trial.

      The cynic in me says that it has to do with arresting former Bush officials or CIA operatives after testifying to "torture".

Scott Brown's chief strategist said that their internal polls showed that national security and treatment of enemy combatants was the big issue in the last two weeks of the campaign, outweighing health-care. Brown focused on this during the last week of the campaign and pushed for military tribunals. The hearings on the Christmas bomber and the hopelessly PC "report" on Maj.       The push to find a new venue for terrorist trials seems to be a "not in my backyard" phenomenon, and to look toward trying them in a federal civilian court outside of New York. That's hardly an adequate solution.

      KSM is most definitely an enemy combatant, is not a U.S. citizen, and therefore is NOT entitled to trial in a civilian court or any rights enjoyed by American citizens.       Your comments referring to Jefferson do not apply. His comments were about American citizens who would give up their freedom. Foreign terrorist enemy combatants do not fall under any definition of American citizen. We are at war with these people, these are not civilian crimes. They should NEVER be given U.S.A. citizens rights, because they are not citizens here. They are enemy combatants and deserve military treatment. Only the facts are required, we do not need any rules of engagement, we need the truth. This is not about "beyond a reasonable doubt", it's about guilt or innocence. Only a military trail uses that premise. Civilian courts substitute "procedure and lawyering skills" for the truth.

      The administration argues that civil trials for KSM and the underwear bomber are justified because other prosecutions of terrorists have resulted in successful convictions. Others argue that suspected terrorists should be remanded to military jurisdiction to preserve the opportunity to gather intelligence. However practical in the outcomes, these seem to me to be two sides of the same coin, which is, the end justifies the means.

      The question that needs to be answered is whether this is a civil crime or an act of war. When an organization declares war on the US on two different occasions, and an individual is part of that organization or acts as an agent thereof, how can you conclude that the planning, support and/or commission of such acts are anything other than acts of war? KSM, his cohorts, the underwear bomber, and any others that are members of, act with the support of, or act as agents of an entity that has declared war on us, belong in the military justice system.

      Your article is right on. I, and I believe most Americans, want all terrorists to be tried in a Military Tribunal. If KSB is still tried in civil courts, it should be moved to a Military Base for the most cost-effective security. But the best solution is a Military Tribunal. It is very difficult to understand why liberals believe that someone accused of terrorist acts who is NOT an American citizen deserves any Constitutional rights.

      From reports I have read, the situation is worse than initially reported. Director of National Intelligence Dennis Blair supposedly corrected himself and stated that the High-Value Detainee Interrogation Group, described as one which would use "legal" methods such as the Army's Field Manual approach, had not been formed as promised last summer. If true, this is another promise not followed through by this Administration and therefore there was no telephone number for the FBI agents on the scene to call.

      The folloing is a letter I got from my Dad a few days ago. The last parapgraph is a true statement:

      "The FBI interrogation last December of Abdulmutallab, the African al Quada bomber was a monumental foul-up. It was worse than useless.

      First, as of last August, terrorists were supposed to be interrogated by an interagency HIG team under the direction of the FBI. However, the Administration has not yet decided whether "HIG" will conduct interrogations of all high-value captured terrorists or just those questioned overseas.

      Second, in any case, that "HIG" team has not yet even been organized and assembled — five months later — much less equipped, trained, and positioned.

      Third, the wrong people did the 50 minute interrogation when the African was babbling like a brook. Those doing it aimed their questions ONLY at getting the evidence to convict him in court — not effectively to find out what they could about the al Qaeda's secret plans, organization, happenings, etc. The FBI personnel doing the questioning did not know what to ask, what to listen for, and what to follow up on — to help fight our war against Al Quada.

      Fourth, even the "valuable information" the Administration says was obtained, probably is not admissible in evidence in a civilian court trial, since it was taken before the African's Miranda rights were read to him.

      Fifth, the questioning was permitted to last only 50 minutes before the civilian Miranda rights were read. No telling what could have been obtained if skilled, trained interrogators had been at work for 50 hours or even 12 hours.

      Sixth, our "do-gooders" to the contrary, our U.S. Constitutional protections re interrogation of prisoners only applies to American citizens — not to foreign combatants. And it only applies to "uniformed" combatants — not to enemies attacking us in civilian clothes, particularly when they are using stealth to carry out their missions. This is the first time since the American Revolution that America [or probably any other nation] has afforded such pretrial and trial procedures to an un-uniformed combatants. [Our skilled interrogators don't wound, maim, or kill enemy prisoners. I.e., they don't torture them with excruciating pain. It has been routine for our American military pilots to undergo waterboarding when being trained to survive being military prisoners -- to enable them to retain information when being waterboarded.]

      As a result of all this, the African may get off with just light punishment — or none at all — for the planned murder of hundreds on the airplane and probably hundreds in a Detroit suburb. And we, stupidly, have missed a golden opportunity to head off future attacks on our citizens — as we have been able to thwart many since the 9/11 attack. It isn't a local American civilian riot — it's a war declared by a mortal enemy to destroy America.

      Obama's priorities are wrong! America is in peril — even before the terrorists get the nuclear weapon! We've got to generate a ground swell to get our country back on track!

      I listened to the Governor of NY speak about the issue of the trial and in his interview he said that he thought the trial should be moved from the city in order to prevent possible harm to the people of the city, the terrible reminder of what had happened, and terrible traffic jams that would inevitably happen. He said one of the worse attacks on America happened in NYC and that it would be a terrible reminder to the people, and possibly create a new target for the perpetrators.

      I agree with the NY Governor. The people of NYC have been through enough. Move the trial elsewhere. This should never have been in the courts. It was a military move on the part of the enemy, and should have been treated as such by putting the trial in the military courts. Whichever court holds the trial, the very least that should be done is to move the trials out of NYC….take it to an unpopulated area….the desert seems right!

      Perhaps this would the point in time to review the criminal rights issue and the Miranda decision specifically. Could it be time for a case to equalize criminal rights with victims' rights? Obviously, terrorists from another country should never enjoy the same rights as American citizens, but we extend Constitutional protections to illegal immigrants so we started down the slippery slope years ago. I am not advocating coerced confessions and the like, but there can be a line drawn so that damning evidence is not dismissed when corroborating evidence is in place or inevitable discovery can be invoked.

      My concern is the definition of terrorism. Before we know it, the government may redefine terrorism as anyone who disagrees with our government. And that will open the floodgates to the end of the first amendment.

      I believe that the one thing that sets our country apart from others is that the individual is more important than the majority. Individual rights take precedent. I believe that human rights extend to all, not just Americans. I submit that if the U.S. wasn't so greedy and gobbled up most of the worlds resources, that perhaps we would not have this problem with terrorism.
