  • Unconstitutional Mandate Attacked from the Left

The Left is starting to recognize some of the perils of health care legislation that would create a whole new way for government to control its citizens.

Democracy for America (run by Howard Dean’s brother) is now warning its left-wing allies, “The bill doesn’t actually “cover” 30-million more Americans – instead it makes them criminals if they don’t buy insurance.”

How true. Projections are that 8-million to 14-million Americans would pay billions of dollars for failing to buy insurance under the House bill.

To Democracy for America, this is wrong, but only because a government-run “public option” insurance plan is out of the Senate version of the bill. However, restoring a public option doesn’t fix the wrongness of having government dictate how you must spend your money.

As The Heritage Foundation’s legal scholars have documented, such an individual mandate violates the U.S. Constitution by exceeding the limited and enumerated powers of the federal government.

Taxes are unpopular but people understand why they exist. Health care bills also want to dictate how we must spend our money. Whether you think you want it or need it or can afford it, you must buy health insurance.

But the proposed legislation promises to make that insurance more expensive than ever to buy. “Under the House and Senate bills, taxpayers are going to pay more for health insurance,” concludes Dennis Smith, who formerly administered the federal Medicaid program.

It’s a triple whammy. Pay higher taxes for health care reform. Pay higher premiums for health care coverage. And lose more of your personal freedom.

    3. Bobbie Jay says:

Obama's health care plan simply takes advantage of the personally responsible instead of incentivizing the personally irresponsible. The only reform there needs to be.

It takes LITTLE EFFORT on the government's part. All they have to do is hold people accountable to THEIR INDIVIDUAL EXPENSES OF THEIR OWN EXISTENCE! Look what the majority has done! Started out with corruption, continue to add more! Teach the cry babies and their $88000.00 income, to budget their money with the expense of (their claimed) priority of health care insurance.

    4. Sammy says:

The left had no issue with the constitutionality of the mandate to purchase when the public option was still on the table.

    5. joan, connecticut says:

We do need health care reform in America , but the current bill is not it! Why the big rush to pass a bill by Christmas? Is he because Obama's political capital will take a hit? This is no reason to saddle USA taxpayers with a millstone that will hurt small business and cause them to layoff workers, also force people to buy into the plan or be fined and threatened with jail.It represents putting one sixth of our economy into government hands, creating many new departments and commissions. Has anyone noticed, that threats are a way of life from Washington lately. Joe Lieberman and wife are feeling the brunt of threats against both of them, also Senator Ben Nelson {Nebraska} has been told that Brac commission { Base Closure committee] will look into closing the Stragetic Command base in his state. Has politics, always been this dirty or the level been raised. Mary Landeiu, of Louisiana, was against the health care bill but took an offer of 3 Hundred million dollars for her state. She changed her vote, in what is now called the second Louisiana Purchase. In the civilian world, this is bribery and would merit a trial. What is so vital in this bill { which nobody has read} that causes all this wheeling dealing? This bill, should be killed and rewritten, free of all the pork that will be inserted. How can anyone, with a conscience, not read the bill, render a vote?? Would you sign a document that you haven't read? It is unbelievable, that the Senators and House members do it every day, and think nothing of it. Its time for a clean sweep of all politicians who act above the law.

There are very few species in this World, that when angry, upset, or confused, eat their own, with the exception of Politicians.

    7. Louis L Cesar F Levy says:

What is extraordinary is people's SLEEP and INERTIA before something so DECEPTIVELY HUGE, so UNTHINKABLE in the First Democracy. Wake-up sleepers and dreamers; this deception is REAL.

    9. Sherry Dugas says:

Obama, Pelosi, Reid, and the liberal congress are the ruination of America.

    10. John in Phoenix says:

There is something we CAN do. 1st: Vote against any politician who voted for this penalty on the working class.

2nd: Support (read: time and financial) the groups who combat the criminals in DC.

    11. Drew Page, IL says:

Since it is the Christmas season, I would like to share my Christmas wish list.

I can't speak for others, but for my part, I want to see every liberal politician voted out of office and replaced by a conservative, be it a Democrat or a Republican.

I want a media that is, if possible, apolitical, one that will be a watchdog of all the people's interests and provide investigative reporting, regardless of which political party it may embarrass.

I want our lawmakers and law enforcers to either enforce our immigration laws or change them. I'm tired of seeing them ignored for the sake of political popularity.

I want our public school system to reincorporate studies of the U.S. Constitution into their curriculum. I want it to be just as difficult for a teacher to talk about political issues, such as global warming, as it is to talk about God, or the Ten Commandments.

I want to live among fellow citizens who only want to work and have an equal opportunity to succeed and who don't feel their fellow citizens owe them a living. I want to live in a country where study, hard work and persevernce (success) is rewarded and where refusal to learn, laziness and giving up (failure) isn't rewarded.

      Is it asking too much?
