Defending Attorney General Eric Holder’s historically bad decision to prosecute Khalid Sheikh Mohammed and five other terrorists in civilian court, Sen. Patrick Leahy (D-VT) told CSPAN this morning: “For one thing, capturing Osama bin Laden, we’ve got enough on him we don’t need to interrogate him.” Watch:

This statement goes to the heart of why the Obama administration’s decision to use civilian criminal courts to deal with terrorists is a grave danger to the American people. If we caught him. it would be irresponsible NOT to interrogate Osama bin Laden as an enemy combatant. He would provide a treasure trove of intelligence value to our war effort that could save the lives of both American serviceman overseas and civilians here at home.
Holder claimed yesterday, “I know that we are at war.” But as Leahy’s statement shows the Obama administration is thinking like prosecutors whose only priority is winning convictions, not like general who are responsible for winning a war.

We do have a terrorist case thrown out of our criminal court due to a technicality involving the FBI. The case was against the home-grown terrorists, Bill Ayers and Bernadine Dorn.
Khalid Sheik Mohammed will more than likely be found not guilty because all the evidence against him will be inadmissible- was not properly arrested with reciting of Miranda rights, forced confessions, use of “torture”, etc. etc.
Mr. Obama and Mr. Holder both claimed even before the trial, that he was guilty and would be sentenced to die. Is this like the Stalin show trial where the outcome was already fixed before the trial. How would that not prejudice the case?
I am not even a lawyer and I can not see how the trail can result in anything but acquittal.
How can Mr. Holder claim that KSM will still be incarcerated even if found not guilty? How is that Constitutional?
There is a different agenda at play here.

This is issue is moot, I am sure that OBL is not in custody because he is either being used by the CIA/NSA to derive new intel with his movements/contacts, or he is dead.
and what, exactly would the BO administration use for interrogation techniques anyway, a cupcake induced sugar high, and feather tickles on his bare feet?
