  • Morning Bell: Politics Before Justice at Obama's DOJ

    On Friday of last week, following the announcement that Attorney General Eric Holder would appoint a prosecutor to re-investigate the CIA’s treatment of detainees, former Vice President Dick Cheney taped an interview with Fox News. During the interview, which aired yesterday on Fox News Sunday, Cheney describes Holder’s decision as an “outrageous political act” that will have “devastating” consequences within the CIA.

    Cheney is dead on. But unfortunately Holder’s political CIA witch hunt is just the latest example of a troubling pattern of politicization of the Justice Department under Holder.

    Voter Intimidation: On Election Day 2008, members of the New Black Panther Party dressed in military-style uniforms were filmed standing outside a polling place in Philadelphia. According to a complaint filed by career lawyers at the Justice Department, the New Black Panther Party violated section 11(b) of the Voting Rights Act by engaging “in coercion, threats, and intimidation” of voters, including “racial threats and racial insults” as well as brandishing “a deadly weapon.”

    One of the defendants named was Jerry Jackson, a Democratic Committeeman of the 14th Ward in Philadelphia. The front-line career lawyers in the Voting Section of the Civil Rights Division recommended that Justice seek sanctions against the party and three of its members after the government had already won a default judgment in federal court against the men. But then Associate Attorney General Thomas Perrelli, the politically appointed No. 3 official in the Obama Justice Department, intervened. Instead of following through and getting an injunction to prevent this behavior in future elections, the suit was dismissed against all defendants, but Jackson, who received a watered-down injunction to prevent him from carrying a weapon in a polling place. But only in Philadelphia and only until 2012!

    Public Corruption: In 2008, a federal grand jury began an investigation into a possible pay-to-play scheme in which lucrative work on New Mexico bond deals went to a Gov. Bill Richardson (D) donor. But then just last week, news leaked that that no one would be charged in the investigation with sources telling the Associated Press: “It’s over. There’s nothing. It was killed in Washington.” Heritage senior legal fellow Hans von Spakovsky explains why this is so troubling: “For anyone familiar with internal Justice Department procedures, this is particularly suspicious. The DOJ has a manual called “Federal Prosecution of Election Offenses” (I helped edit the latest edition when I was at Justice) that sets out the rules and procedures for U.S. attorneys when they are investigating these types of public-corruption cases. It is the U.S. attorney in New Mexico who would normally make the final call on a local public-corruption case, not ‘top Justice Department officials’ in Washington.”

    Undermining National Security: In 2004 the CIA Inspector General issued a report documenting alleged detainee abuse by CIA interrogators and contractors. The DOJ’s career, not political, prosecutors then examined that document and other incidents from Iraq and Afghanistan for legal accountability. In one case, the DOJ decided to prosecute, and has already obtained a criminal conviction of a CIA contractor. Furthermore, the CIA has also taken their own disciplinary action against others involved in the incidents. As Heritage senior fellow Peter Brookes explains, Holder’s decision to re-investigate the CIA will have a chilling effect on the morale at the agency and will leave officers in the field wondering whether they should be more concerned about getting terrorists or getting lawyers.

    Anyone familiar with Holder’s history should not be surprised by the politicization of the Justice Department under his leadership. In 1999, Holder promoted clemency for 16 members of FALN and Los Macheteros, terrorist organizations linked by the FBI to more than 130 bombings and six murders. Then in 2000 Holder played a prominent role in the pardon of Marc Rich, whose ex-wife gave considerable sums to the Democratic Party ($867,000) and the Clinton Library ($450,000).

    Now, as the head of DOJ, Holder’s political decisions are undermining core rule of law concerns including the integrity of elections, ethical governance, and national security. Holder reports directly to his boss, President Barack Obama. Someone needs to be held accountable.

      During Gulf War I, General Colin Powell said of the Iraqi military that it was a snake. First we were going to blind it, then we were going to kill it. We blinded it with HARM missiles, taking out the radar, then we bombed Baghdad at the beginning of the air way in January of 1991.

      The strategy here is similar, except now the target is the last bastion of resistance to Muslim hegemony — the small and diminishing number of Americans with the will to fight the war on terror. And the blinding will occur as the consequence of the destruction of the essential human intelligence gathering capability that was formerly provided by the CIA.

      Rasmussen's polling results of 57% are probably on the low side. 2010 will be a deciding moment

The investigation, by attorney General Holder, of the CIA men and women, who endangered their own lives, so that America would be safe from attack,is a travesty. Holders actions, speak louder then words! Holder pushed for a pardon of Mark Rich, a man who cheated the US government out of millions. He dropped the case against the new black panthers of Philadelphia, after they blatantly intimidated voters on election day 2008,which was a serious violation of US election laws. Former Texas Governor Richardson, is just another example of the corrupt politics we have come to expect.It appears to be a way of life in Washington, and in political life . All of these actions, make me feel sick,and wonder where this is leading to.The picture, isn't pretty, and I hope to God, that American patriotism prevails to put an end to this corrosion in our country.       I would challenge the author to explain how the Obama administration "repeatedly" did anything to affect a number that is a yearly statistic. I quote from your Quick Hits:

      I used to be concerned about how sensitive topics were being spun to incite (http://www.merriam-webster.com/dictionary/incite) or instigate(synonym) rather than inform.

      If we can't get the truth here where are we to go?

      It appears on all fronts that Prez. Obama is weakening our defenses, undermining the CIA and other agencies. Soon the plan to arm and train young people , who will perform better than our military will be put into place. We were already informed of this plan previously. WAKE UP!!!

      We must stand up for those we promised to protect ,which includes US citizens, yet we have caved to Russia and others. The current unrest in Iraq shows we pulled out too soon. A campaign promise however is being fulfilled to move the troops out. Our defense budget cuts will NOT pay for health care and the recent defense budget was one of the smallest as a % of GDP.

      There are many more cuts that can be made to save $. The Cash for Clunkers put more $ into foreign car manufacturers than U.S. manufacturers. That was NOT the way I expected my taxes to be spent.

      I keep reading everyone's concerns and everything hinges on defeating at least two bad bills. The Obamacare and Cap and Trade. If enough voices and public outcry prevents Obama from forcing congress to pass these bills into law, we will have enough time to change congress next year.

      You still have not provided the link or the quote from the NASBC that provides a quote that Obama is repeatedly doing what you imply was a quote from them.

      Your quote of the NASBC ended at:

      You sir, added and are not quoting either the Post or the NASBC or anyone else (properly) with this modicum of editorializing (opinion) by attempting to infuse:

      The Obama administration, while young, has already granted thousands of government contracts. Small businesses are saying that in awarding those thousands of contracts, the Obama administration is “repeatedly” failing to award enough of them to small businesses. What is your argument here?

      My argument/position here is simply: that if you are going to try to put your spin on what Small Businesses or the NFIB ( you might read their email as well….I try) or the NASBC or anyone says, credit yourself for that marginal opinion and give the readership the ability to read the article and make their own case/argument. I read the article and you misquote the NASBC in quick hits .

      My argument would also include that "our" "government" has failed small business and that it would be "our" hope (if you care to be included in this opinion) that the Obama administration will do it's utmost to attain or exceed the 23% mark. It has not happened in 5 the past five years but we hope this will end here in this administration.

      Living on this planet (Earth) has afforded me a modest education two successful businesses and real state investments, and the ability to recognize spin when I see it. If you want conservative values and successes, trying to call my comment out and quoting Barney Franks' planet comment is unoriginal and immature. The Bell will have to widen its base not shrink it. I read of secession, inaccurate name calling and incorrect political labeling and hatred in the comments in the Morning Bell. You can't hurt me with your inappropriate misdirecting insults and offensive intent. You can only succeed in alienating no less than one more conservative free thinking individual who sees one less example of good reporting and one mediocre example of an opinion column.

      We can meet outside this forum to discuss your off topic issues with me, your misgivings about my planet and your sensitivity to being called to answer if the NASBC said Obama "repeatedly fails".
