On balance, it appears she came across as what she is: An "emotionalist" who is in over her head as soon as cold, clear, multi-level, thinking is required. Somebody who evades the tough ones until her innermost being has "wriggled" through to an "intuition" with which she can feel comfortable. Such evasive mental habits become plain as daylight in tough questioning. Hurray for the confirmation process! Hope it does some good.

I caught a snippet on the car radio. One of the Senators (maybe Leahy) made a statement that Judge Alito had said that members of his family had been subjected to discrimination, and that he takes that experience into consideration in those types of cases. Apparently, the Senator's point was that, since we already have a judge that does so, another judge with the same psychology should be acceptable. The real point, of course, is that Alito should not have said such a thing, and should not allow that history to affect his decisions. The fact that he is already a judge, and therefore we can exercise no control over what he blends into his decisions, only serves to emphasize the point that the confirmation process is the last and only opportunity to ferret out judges that may intend to carry "empathy" and other such non-constitutional baggage aboard.
