  • Morning Bell: Stop Enviro-Crony Capitalism...Stop the EPA

    Two competing solar power companies, Ausra and BrightSource Energy, recently filed plans to build plants in the California desert. Both firms’ plans affected wildlife habitat. But only Ausra’s plans were hit with complaints demanding expensive and cumbersome environmental studies. The reason? Ausra had rejected demands that it use only union workers to build its solar farm, while BrightSource pledged to hire labor-friendly contractors.

    As the New York Times reports today, big labor is using California’s environmental regulations to shake down power companies trying to build new plants in the state: “If they refuse, they say, they can count on the union group to demand costly environmental studies and deliver hostile testimony at public hearings. If they commit at the outset to use union labor, they say, the environmental objections never materialize.” As harmful as this racket is to California’s economy, new regulations proposed by the Obama administration will empower other special interest groups to shake down businesses nationwide.

    In April of this year, the Environmental Protection Agency began the process of regulating greenhouse gasses by classifying carbon dioxide as a pollutant pursuant to the Clean Air Act. According to the US Chamber of Commerce, regulating carbon through the Clean Air Act would expose at least one million mid-sized commercial buildings to draconian environmental regulations. One-fifth of all food service businesses, one-third of all health care businesses, one-half of the entire lodging industry, and even 10% of all buildings used for worship would be under the EPA’s hammer. The Heritage Foundation’s Center for Data Analysis has estimated that if the EPA regulated carbon objectively under the law, the economy would suffer annual job losses exceeding 800,000 for several years and a cumulative GDP loss of $7 trillion by 2029.

    But don’t worry, says Obama EPA Administrator Lisa Jackson. She told the New York Times earlier this year, “We are poised to be specific on what we regulate and on what schedule.” In other words, just as the Obama Treasury Department played political favorites when bailing out General Motors and Chrysler, rewarding big labor allies while punishing average investors and secured creditors, the Obama EPA is poised to play the exact same games while enforcing the Clean Air Act.

    There is something you can do to help stop this regulatory enviro-crony capitalism nightmare. Any regulatory framework created by the Obama EPA can be fought in court. And one factor that courts must consider when a regulation is challenged is how the government addressed citizen comments on the proposed regulation.

      I resent the politicians ignoring the concerns of citizens of AMERICA. They care more about illegals than the real AMERICAN. In 2010 we need a change in the congress!! They are the enemy of the hard working tax paying AMERICANS!!! It's bad enough to have terrorist thugs and Communist dictators trying to kill us!!!

      Just like the election,the fix is in. Doesn't anyone see a pattern here? The EPA has gotten way way out of control and it didn't start last week.

      Along with other government arms, these thugs should change thier name to the Sopranos. I don't think "making us an offer we can't refuse" is in any law book. This whole administration is corrupt,we all know this,so who's investigating?

      As Obamas government gets bigger and bigger,it seems we become more powerless. Lord help us.

      Everyone knows that "Big Labor" is good and "Big Capitalism" is bad. The term "labor friendly" translates into assorted goons, baseball bats, leg breaking and other trademark, union behavior we all must tolerate. Otherwise, someone else will have to start your car for you.

      I believe the hold Obama has on Congress and the American people is perpectuated by his unpresidented support from the press and the simple fact that he has a majority in both houses with willing "hatchet" men and women to do his bidding. One day, after the people realize that we have given this man way too much power with no checks and balances, we will look around and he'll be gone, all the money, ash trays and towels will have left with him. Congress will be in shambles and the country will look like Woodstock did back in 1969 after the show. The place will be trashed, the port-a-johns overflowing and the only ones left are those too weak to travel or those in Red Cross tents trying to survive their over-indulgence. Food, money and hope will be just a fuzzy memory. The roads will be littered with small, useless vehicles that run only on sunflower oil, and since there are no more farms to grow the sunflowers, there's no more sunflower oil. Bank buildings will have been converted into homeless shelters and the land will be cluttered with decaying car dealerships. Of the people remaining, nine out of ten will have some sort of government job. Nothing will get done because all the thinkers and doers, the ones who produce things, create jobs and build communities will have left these shores.

      We The People need to wake up make a stand, NOW.

      After eight-years of big business getting their way with self-regulation, destruction of the economy, attacks on our natural resouces and not putting forth the jobs they promised in exchange for enormous tax breaks it is time, the real backbone of america (labor) had an adult seat at the table.

      Not sure where some of those posting get their information, perhaps fox "news" or "cousin billy ray" but why do you resort to labels rather than dealing with the topic? Is it because speaking to the topic requires research and analysis?

      Those wanting to label somethign or someone "communist" or "socialist" need to at least look up the definition. For example, if raising the issue of "socialism" we need look no further than to the HUGE social program of our own military. It provides "jobs" to those who reportedly have no other choice. The government systematically pays youths thousands of dollars to "sign-up" and recruiters thousands more. For what, "patriotism"? Yet, i seriously doubt any on this site would label this an example of "socialism" or admit it was not of this administratins making. why is that?

      From my perch, the primary mistake Ausra made was selecting the bankrupt, liberal, state of California to build solar energy products. Travel east about 100 miles, and bingo, you're in the conservative, business-friendly, fiscally-more-responsible state of Arizona. Not Utopia, but home to abundant sunshine and a non-union work ethics. Yes, there still is the autocratic bureaucracy of the EPA to deal with – but why set yourself up for failure from the start? Entertaining an investment of brick and mortar on terra firma in a state that is driven by labor unions, gets these types of results.

      Remember, the growth of America's future small businesses will NOT be in the liberal, bankrupted, highly-taxed, highly-regulated, union-friendly states of CA, OR, WA, IL, WI, MI, OH, NY, PA, NJ, and NEW ENGLAND. Has anyone looked at the economic climate in these states the past 5 years???? They did not get in these postions by chance – they got there by political liberal design.

      I know from experience! I left Michigan, along with my small business and tax base, 3 years ago. Socialism, liberalism, progressivism (etc.) are all ideologies that are proven to suffocate innovation, productivity and profitabilty. Socialism and labor unions have helped to create Detroit's current economic woes, 23% city unemployment, 30+% city foodstamps and an exodus in Michigan's population by the millions the past few years.

      Not only does the EPA need to be stopped, but this administration needs to be reigned in…on everything….They are moving rapidly because they hope that we citizens won't see what they are doing behind the scenes…. There should be a limit on how long a person can serve in the senate or the house. No one should be allowed to make a career of these positions. Perhaps if their salaries were cut by 2/3's they wouldn't be so anxious to stay in Washington. We should set their salaries….not allow them to. Some of these people are getting rich,there. I'd like to know how that can be… I have a lot of questions, and I'm sure I'm not the only one.

Allowing and encouraging the Federal government to force states and citizens to bend and bow to it's will and pay money for things that were legal and everyday commonplace, makes citizens who have broken no law or acted immorally, to be shaken down. This is the manner of politics in the Second City. Thank you for electing a crony of Mayor Daley to the be President of the United States.       Sandy from San Francisco appears to be representative of the "left" in her thinking. Our problems go WAY back – long before Bush and Clinton. The problem has been the encroachment of government into our lives distorting the "Regulate Interstate Commerce" clause of the Constitution. I ask Sandy what governement programs have worked. My answer is: perhaps the InterState Highway system, NASA, and the military that protects her (regardless of how she feels about them). I am sure, in her view, all governemnt programs are stellar.

There was a time when you knew what the proper approach to promoting conservatism was.       The EPA is not hijacking the economy just as you are not offering up the whole truth. Neither of you is perfect yet they can and will work for and with you. Can you say the same to them?       I was a Professional Forester for 58 years. The EPA Act and Agency along with the California Environmental Quality Act has reduced the Forest Products Economy by 80%. This means the about 48% of the Land Area of California is no longer cared for or protected by trained scientists that understand the Natural Laws the control the life and death of the Forests.

      The Forest Fires are bigger and hotter because the Rural Fire Dept. doesn't use the right Control Strategy or the most Effective Fire Fighting Equipment. There are more dead and dying forest trees because scientific method of controlling Insects, Disease and Fire damage due to the lack of Forest Land Management.

      Older and old trees are more susceptible to damage from Insects, Disease and Fire but there are no Professional Foresters to practice Forestry the Science of Forest Management. Fires, Dead and Dying Trees produce Carbon Dioxide. Healthy, Vigorous Trees produce Oxygen.

      Well there is less oxygen being produce now that when the Forest Products Economy was in charge. Now California's Forest don't produce the Jobs, Income, Taxes or Healthy Trees they use to.
